का. आ. 430 ( अ ) .-राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी सं. का.आ. 637( अ.) , तारीख 4 सितम्बर , 1997 के साथ पठित औषध ( कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 के उप- पैरा ( 1 ) और (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा भारत सरकार के रसायन और उर्वरक मंत्रालय ( राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण ) के आदेश सं. का.आ. 1667 ( अ ) , तारीख 3 अक्तूबर , 2006 , को अधिक्रमण करते हुए, नीचे की सारणी के स्तंभ (5 ) में विनिर्दिष्ट कीमत को उक्त सारणी के स्तंभ (3 ) और (4 ) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितियों में से प्रत्येक की , उत्पाद शुल्क और स्थानीय कर, यदि कोई है , को छोड़कर अधिकतम कीमत के रूप में नियत करती है :

टिप्पणी :

( क ) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को छोड़ कर अधिकतम कीमत के रूप में नियत की जाती हैं और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों।

(ख ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है , वह प्रो - राटा प्राइजिंग आदेश का.आ. 83 ( अ) दिनांक 27-1-1998 के तहत आयेगी ।

( ग) अगर कम्पनी , विभिन्न प्रकार की पैकिंग सामग्री या उसमें विशेष लक्षण का दावा करती है तो उसे राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण के पास कीमत के अनुमोदन/नियत कराने के लिये आना होगा ।

( घ ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणामस्वरूप , निम्नलिखित आदेश जो कि इस आदेश से पूर्व जारी हुए हैं, स्वतः ही निरस्त हो जायेंगे ।

exclusive of excise duty , and local tax , if any, for scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in column (3 ) and (4) S.O. 430 (E) . In exercise of the powers , conferred by Sub - paragraphs ( 1 ) and (2) of paragraph 9 of the Drugs (Prices Control ) Order, 1995 read with No. S.O. 637(E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority ) No. S.O. 1667 (E) , dated 3rd October, 2006, the National Pharmaceutical Pricing Authority hereby fixes the prices as specified in column ( 5) of the table below as the ceiling price thereof:

(b) Pro- rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated27-1-1998 .

(c) Fordifferent packing material used or any special feature claimed, companies are required to approachNPPA for approval/fixation of specific prices.

(d) Consequent to the issue of ceiling price of the formulation pack( s) in this notification , the following price order(s) issued prior to this date of notification stand automatically withdrawn:

का.आ. 433( अ ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का.आ. 637( अ ) , तारीख 4 सितम्बर , 1997 के साथ पठित औषध ( कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 के उप- पैरा ( 1 ) और ( 2 ) और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा भारत सरकार के रसायन और उर्वरक मंत्रालय ( राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण ) के आदेश सं. का.आ. 619 ( अ ) , तारीख 29 जून , 2001 , सं. का.आ. 827 ( अ ) , तारीख 15 जून , 2005 और सं. का. आ. 1686 ( अं ) , तारीख 3 अक्तूबर, 2006, को जहां तक उसका सम्बन्ध नीचे की सारणी के विनिर्मित पैकों से है, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है , नीचे की सारणी के स्तंभ ( 5 ) में विनिष्टि कीमत को उक्त सारणी के स्तंभ ( 3 ) और (4 ) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितयों में से प्रत्येक की , उत्पाद शुल्क और स्थानीय कर , यदि कोई है, को छोड़कर अधिकतम कीमत के रूप में नियम करती है ।

(ख ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है , वह प्रो - राटा प्राइजिंग आदेश का.आ. 83( अ ) दिनांक 27-1-1998 के तहत आयेगी । :

(ग) अगर कम्पनी , विभिन्न प्रकार की पैकिंग सामग्री या उसमें विशेष लक्षण का दावा करती है तो उसे राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण के पास कीमत के अनुमोदन/नियत कराने के लिये आना होगा ।

(घ ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणामस्वरूप , निम्नलिखित आदेश जो कि इस आदेश से पूर्व जारी हुए हैं, स्वतः ही निरस्त हो जायेंगे ।

का.आ. 436( अ ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का.आ. 637 ( अ ) , तारीख 4 सितम्बर , 1997 के साथ पठित औषध ( कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 के उप- पैरा ( 1 ) और ( 2 ) और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारत सरकार के रसायन और उर्वरक मंत्रालय ( राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण ) के आदेश सं. का.आ. 1340( अ ) और 1341. ( अ ) , तारीख 16 सितम्बर , 2005 , को जहां तक उसका सम्बन्ध नीचे की सारणी के विनिर्मित पैकों सेहै, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है, नीचे की सारणी के स्तंभ ( 5 ) में विनिष्टि कीमत को उक्त सारणी के स्तंभ ( 3 ) और ( 4 ) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितयों में से प्रत्येक की, उत्पाद शुल्क और स्थानीय कर, यदि कोई है, को छोड़कर अधिकतम कीमत के रूप में नियम करती है । :

of India in the Ministry of Chemicals and Fertilizers and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers (National Phamaceutical Pricing Authority) No. S.O. 1340(E) and 1341 (E) , dated 16th September , 2005, in so far as it relates to formulation packs mentioned in the table below, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority hereby fixes the prices as specified in column (5) of the table below as the ceiling price exclusive of excise duty, and local tax, if any, for scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in column (3) and (4) thereof:
