सा.का.नि. 231 ( अ ).-केन्द्रीय सरकार, वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, वायुयान (खतरनाक माल का कहन ) नियम , 2003 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , नामशः:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम वायुयान ( खतरनाक माल का वहन ) संशोधन नियम, 2007 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।।
2. वायुयान ( खतरनाक माल का वहन ) नियम , 2003 में,-
(i) नियम 3 , उप- नियम (2 ) में,-
(क) पहले परंतुक से पूर्व , निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, नामशःः:-
" परंतु विस्फोटक के रूप में वर्गीकृत खतरनाक माल का वहन भारत में , से उसके भीतर या ऊपर से किसी भी विमान द्वारा नहीं किया जाएंगा , बशर्ते कि वह वायुयान नियमावली , 1937 के नियम 8 के अधीन केन्द्रीय सरकार द्वारा प्रदान की गई अनुमति के नियम व शतों के अधीन हो । "
(ख ) पहले परंतुक में, " परंतु " शब्दों को स्थान पर " परंतु यह और " शब्दोंको प्रतिस्थाषित किया जाएगा ।
(ग ) दूसरे परंतुक में " परंतु यह और " शब्दों के स्थान पर " परंतु यह भी " को प्रतिस्थापित किया जाएग्न ।

(ii) नियम 9 , उप - नियम ( 8 ) में, " नियम 3 का उप - नियम ( 2 ) " शब्दों के स्थान पर " नियम 3 के उप- नियम (4 ) " शब्दोंको प्रतिस्थापित किया जाएगा ।

टिप्पण 1.- मूल नियम अधिसूचना सं. सा.का.नि. 206( अ ) तारीख 5 मार्च, 2003 द्वारा प्रकाशित किए गए थे और बाद में सा.का.नि. 795 (अ) तारीख 6 अक्तूबर , 2003 , सा.का.नि. 796 ( अ ) तारीख 6 अक्तूबर, 2003 तथा सा.का.नि. 600 (अ ) तारीख 27 सितम्बर, 2006 द्वारा संशोधित किए गए थे ।

टिप्पण 2.- वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 14 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार ने लोकहित में नागर विमानन मंत्रालय में जारी दिनांक 19-03-2007 के अपने आदेश सं. ए की. 11012/002/2006-ए द्वारा इन नियमों के पूर्व प्रकाशन की शर्तों से छूट दी है ।

NOTIFICATION
New Delhi , the 19th March , 2007
GS.R. 231 (E) . In exercise of the powers conferred by Section 5 of the Aircraft Act , 1934 (22 of 1934 ), the Central Government hereby makes the following rules further to amend the Aircraft ( Carriage of Dangerous Goods ) Rules , 2003, namely:-.
1. ( 1 ) These rules may be called the Aircraft ( Carriage of Dangerous Goods ) ( Amendment) Rules, 2007.
(2 ) They shall come into force on the date of their publication in the Official Gazette .
2. In the Aircraft (Carriage of Dangerous Goods ) Rules , 2003 ,-
( i) in rule 3 , sub - rule (2) ,-
(a) before the first proviso, the following proviso shall be inserted , namely :-
"Provided that dangerous goods classified as explosives shall not be carried in any aircraft to , from , within or over India except in accordance with and subject to the terms and conditions of a permission in writing granted by the Central Government under rule 8 of the Aircraft Rules , 1937. " ( b) in the first proviso , for the words " Provided that " , the words " Provided further that " shall be substituted.
(c) in the second proviso for the words " Provided further that " , the words " Provided also that" shall be substituted .
( ii ) in rule 9 , sub -rule (8 ) , for the words " sub - rule (2 ) of rule 3 " , the words " sub - rule ( 4 ) of rule 3 " shall be substituted .

Note 1. The principal rules were published vide notification number G.S.R. 206 ( E ) dated the 5th March , 2003 and was subsequently amended vide number G.S.R. 795 (E ) dated 6th October . 2003, G.S.R. 796 ( E ) dated 6th October , 2003 and G.S.R. 600 (E) dated 27th September, 2006 .
Note 2. The Central Government in exercise of the powers conferred by proviso to Section 14 of the Aircraft Act , 1934 ( 2201 1934) has, in the public interest dispensed with the condition of previous publication of these rules vide itsOrder No. AV. 11012/ 002/ 2006 - A, dated 19th March, 2007 issued in the Ministry of Civil Aviation .

1. ( ! ) इन नियमों का संक्षिप्त नाम वायुयान ( संशोधन ) , नियम, 2007 है ।
( 2 ) यं राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. वायुयान नियमावली , 1937 में नियम 3 में, उप-खंड ( 17 ) का लोप किया जाए ।

NOTIFICATION

GS.R. 232 (E) . In exercise of the powers conferred by Section 5 of the Aircraft Act, 1934 (22 of 1934), the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937, namely:-
1. (1) These rules may be called the Aircraft (Amendment) Rules, 2007 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Aircraft Rules , 1937, in rule 3, clause (17) shall be deleted .
