का.आ. 451 ( अ ).-केन्द्रीय सरकार नें , भारत सरकार के पर्यावरण एवं वन मंत्रालय की अधिसूचना संख्या का.आ. 114(अ) , तारीख 19 फरवरी , 1991 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना के रूप में निर्दिष्ट किया गया है ) द्वारा तटीय आयामों को तटीय विनियमन इलाकों के रूप में घोषित किया था और उक्त इलाकों में उद्योग , सक्रियाएं और प्रक्रियाएं स्थापित करने और उनके विस्तार पर प्रतिबंध अधिरोपित किए थे;
और केन्द्रीय सरकार के ध्यान में लाया गया है कि देश में उर्वरकों की अत्यधिक कमी के कारण किसानों को कठिनाई का सामना करना पड़ रहा है ;
और भारत सरकार , पर्यावरण एवं वन मंत्रालय द्वारा मामले की जांच की गई है ;
और केन्द्रीय सरकार का उर्वरकों की महत्त्वपूर्ण आवश्यकता को ध्यान में रखते हुए किसानों के कष्टों के मद्दे नजर यह मत है कि उक्त अधिसूचना में उर्वरकों की कमी को अनुमत करने और उर्वरकों को तैयार करने के लिए, अपेक्षित कच्ची सामग्री के लिए संशोधन करना अपेक्षित है :
और पर्यावरण ( संरक्षण ) नियम , 1986 के नियम 5 के उप-नियम ( 4 ) में प्रावधान है कि जब कभी भी केन्द्रीय सरकार को ऐसा प्रतीत हो कि ऐसा करना लोकहित में है , वह उक्त नियम के नियम 5 के उप - नियम ( 3 ) के खण्ड (क ) के अधीन सूचना की अपेक्षा का त्याग कर सकती है ;
और केन्द्रीय सरकार की यह राय है कि उक्त अधिसूचना में संशोधन करने के लिए नियम 5 के उप - नियम ( 3 ) के खंड ( क) के अधीन सूचना की अपेक्षा का त्याग किया जाना लोकहित में है ;
अतः , अब केन्द्रीय सरकार , पर्यावरण ( संरक्षण) नियम, 1986 के नियम 5 के उप- नियम ( 3 ) और उप- नियम ( 4 ) के साथ पठितः पर्यावरण ( संरक्षण ) अधिनियम, 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा ( 1 ) और ( 2 ) के खंड ( V ) द्वाराः प्रदत्त शक्तियों का प्रयोग करते हुए पूर्वोत्तर अधिसूचना में निम्नलिखित संशोधन करती है :-
1. उक्त अधिसूचना में पैरा 2 में,-
(1 ) (क) उप- पैरा ( ii ) में उपबंध के बाद निम्नलिखित उपबंध को प्रतिस्थापित किया जाए नामतः:-
" बशर्ते कि उर्वरकों को प्राप्त करने और भण्डारण तथा उर्वरकों को तैयार करने के लिए अपेक्षित सामग्री , जैसे अमोनिया, फासफोरिक एसिड , सल्फर सल्फ्यूरिक एसिड , नाइट्रिक एसिड आदि, की अनुमति क्षेत्र के उस जोन में होंगी जिसे तटीय
विनियम क्षेत्र. 1 ( i ) के रूप में व्रर्गीकृत नहीं किया है । "
2 अनुबंध IIIमें,
(क) आरम्भ में " पैट्रोलियम उत्पादों की सूची और भण्डारण के लिए अनुमत " शब्दों के लिए " पैट्रोलियम उत्पादों की सूची और भण्डारण के लिए अनुमत रसायन " शब्दों को प्रतिस्थापित किया जाए ।
(ख ) मद (xiv ) के बाद निम्नलिखित मद को शामिल किया जाए, नामतः:
" ( xv ) उर्वरकों को तैयार करने के लिए उर्वरक और कच्ची सामग्री । ".

ofthe Environment (Protection) Act, 1986 (29 of 1986)
6. का.आ. 1122 ( अ ) , दिनांक 29 दिसम्बर , 1998 read with sub- rules (3) and (4) of rule 5 of the Environment
7. का.आ. 998 (अ ) , दिनांक 29 सितम्बर , 1999 (Protection) Rules , 1986. the Central Government hereby
makes the following amendments further to amend the said
8. का.आ. 730 (अ ) , दिनांक 4 अगस्त, 2000 notification , namely:-
9. का.आ. 900 ( अ ) , दिनांक 29 सितम्बर , 2000 1. In the said notification , in paragraph 2,-
10. का.आ. 329 (अ ) , दिनांक 12 अप्रैल , 2001 (1)(a) in sub- paragraph ( ii ) , after the proviso, the
11. का.आ. 988 ( अ ) , दिनांक 3 अक्तूबर , 2001 following proviso shall be inserted , namely :-
"Provided that facilities for receipt and storage of
12. का.आ. 550 ( अ ) , दिनांक 21 मई , 2002 fertilizers and raw materials required for manufacture.
13. का.आ. 1100( अ ) , दिनांक 19 अक्तूबर , 2002 of fertilizers like ammonia , phosphoric acid, 'sulphur ,

within the said Zone in areas not classified as Coastal

S.O. 451 ( E) . Whereasby notification of the Note: The principal notification was published in the
Government of India in the Ministry of Environment and Gazette of India vide number S.O. 114(E) , dated the

And whereas the issue has been examined by the 8. S.O. 730(E) , dated 4th August, 2000

And whereas the Central Government keeping in S.O. 988 (E ) , dated 3rd October , 2001

Andwhereas sub -rule (4) of rule 5 of the Environment 16. S.O. 635 (E) , dated 30th May, 2003
(Protection) Rules . 1986 provides that , whenever it appears
