प्रतिभूति संविदा (विनियमन ) अधिनियम , 1956 की भारा 11 ( 3 ) के अधीन कलकत्ता स्टॉक एक्सबेंज एसोसिएशन लिमिटेड की सम्मिति के अधिक्रमण की कालावधि को बढ़ाने के लिए अधिसूचना
फा. सं. भाप्प्रविशो/विधि/89596/2007. फा. सं. भाप्रविबो/विधि/77491 /2006 तारीख 29 सितंबर , 2006 की अधिसूवना (" उक्त अधिसूचना " ) द्वारा कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति ( " समिति " ) के अधिक्रमेण को भारतीय प्रतिभूति और विनिमय बोर्ड ( " भाप्रविबो " ) द्वारा 31 मार्च, 2007 तक बढ़ाया गया था और श्री टी. के. दास , आई.ए. एस. ( सेवानिवृत्त ) समिति की समस्त शक्तियों और कर्तव्यों का प्रयोग करने और पालन करने के लिए प्रशासक के तौर पर बने रहे ।
मैंने नोट किया है कि प्रशासक ने एक्सचेंज की कार्यप्रणाली में विभिन्न सुधारात्मक उपाय शुरू किये हैं , जिनमें से कुछ पर अविरत अनुवर्ती कार्यवाई अपेक्षित है । मैंने यह भी नोट किया है कि एक्सचेंज मुख्य कार्यपालक अधिकारी की नियुक्ति की प्रक्रिया में है । एक्सचेंज की कार्यप्रणाली को सुचारू बनाने की प्रक्रिया को, अपरस्परीकरण ( डीमयुचुअलाइजेशन ) की और नयी समिति के निर्वाचन तथा गठन की प्रक्रिया को भी पूरा करने के लिए, मेरा विचार है कि समिति के अधिक्रमण को 31 मार्च, 2008 तक की एक वर्ष की अतिरिक्त कालावधि के लिए बढ़ाया जाना अपेक्षित है ।
पूर्वोक्त को ध्यान में रखते हुए, प्रतिभूत्ति संविदा (विनियमन ) अधिनियम , 1956 की धारा 11 और केन्द्रीय सरकार द्वारा जारी तारीख 30 जुलाई, 1992 की अधिसूचना सं. का.आ. 573 के साथ पठित भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा -19 के अधीन मुझे प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिसूचना में यथा आदिष्ट कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति के अधिक्रमण को एतद्द्वारा 01 अप्रैल, 2007 से प्रभावी 31 मार्च, 2008 तक की एक वर्ष की अतिरिक्त कालावधि के लिए बढ़ाया जाता है । श्री जी. के. दास , आई.ए.एस. ( सेवानिवृत्ति) प्रशासक के तौर पर बने रहेंगे और समिति की समस्त शक्तियों और कर्तव्यों का प्रयोग और पालन करेंगे , इस प्रकार बढ़ायी गयी कालावधि के दौरान । श्री टी. के. दास ऐसे व्यक्तियों की सहायता ले सकेंगे जैसे वे प्रशासक के तौर पर अपने कर्तव्योंके निर्वहन में आवश्यक समझें

Mumbai , the 26th March, 2007
Notification under Section 11(3) of the Securities Contracts (Regulation ) Act , 1956 for Extending the period of Supersession of the Committee of the Calcutta Stock Exchange Association Limited .
No. SEBI / LE/ 89596 /2007.-Vide Notification F. No. SEBI/ LE/77491 / 2006 dated September 29 , 2006 ( " Said notification " ) the supersession of the Committee of The Calcutta Stock Exchange Association Limited ( " Committee " ) was extended by the Securities and Exchange Board of India ( " SEBI " ) upto March 31 , 2007 and Shri T. K. Das , IAS (Retd . ) continued as the Administrator to exercise and perform all the powers and duties of the Committee .
I have noted that the Administrator has initiated various corrective measures in the functioning of the exchange , some of which require sustained follow up action. I have also noted that the exchange is in the process of appointment of Chief Executive Officer . In order to complete the streamlining of the functioning of the exchange , the process of Demutualisation and also the election and constitution of a new Committee , I am of the considered view that the supersession ofthe Committee is required to be extended for a further period of one year upto March 31, 2008 .
In view of the aforesaid, in exercise of the powers conferred upon me under Section 19 of the Securities and ExchangeBoard of India Act , 1992 read with Section 11 of the Securities Contracts (Regulation ) Act , 1956 and Notification No. S.O. 573 dated July 30, 1992 issued by Central Government , the supersession of the Committee of The Calcutta Stock Exchange Association Limited as ordered in the said notification is hereby extended for a further period of one year upto March 31 , 2008 with effect from April 01, 2007 , Shri T. K. Das , IAS ( Retd.) shall continue as the Administrator and shall exercise and perform all the powers and duties of the Committee , during the period so extended . Shri T. K. Das may take assistance of such persons as he deems necessary in discharge of his duties as the Administrator .

मैंने यह नोट किया है कि प्रशासक ने एक्सचेंज की कार्यप्रणाली में विभिन्न सुधारात्मक उपाय शुरू किये हैं , जिनमें से कुछ पर अविरत अनुवर्ती कार्यवाई अपेक्षित है । मैंने यह भी नोट किया है कि भाप्रविबो द्वारा अप्रैल , 2006 में किए गए विशेष प्रयोजन वाले निरीक्षण के निष्कषों से, यूपीएसई में व्यापार, निगरानी , सूचीबद्धता , आदि से संबंधित कमियाँ प्रकट हुई थीं जिनका सुधार किए जाने की आवश्यकता है । एक्सचेंज की कार्यप्रणाली को सुचारू बनाने की प्रक्रिया को, अंपरस्परीकरण (डीम्युचुअलाइजेशन ) की, कार्यपालक निदेशक की नियुक्ति की और नये शासी बोर्ड के निर्वाचन तथा गठन की प्रक्रिया को भी पूरा करने के लिए , मेरा विचार है कि शासी बोर्ड के अधिक्रमण को 31 मार्च, 2008 तक की एक वर्ष की अतिरिक्त कालावधि के लिए बढ़ाया जाना अपेक्षित है ।

( सेवानिवृत्ति ) प्रशासक के तौर पर बने रहेंगे और शासी बोर्ड की समस्त शक्तियों और कर्तव्यों का प्रयोग और पालन करेंगे , इस प्रकार बढ़ायी गयी कालावधि के दौरान । श्री के. डी. गुप्ता ऐसे व्यक्तियों की सहायता ले सकेंगे जैसे वे प्रशासक के तौर पर अपने कर्तव्यों के निर्वहन में आवश्यक समझें ।

Notification under Section 11(3) of the Securities Contracts (Regulation) Act, 1956 for Extending the period of Supersession of the Governing Board ofthe Uttar Pradesh Stock Exchange Association Limited.
F. No. SEBILE/89594/2007. Vide Notification F. No. SEBI/LE/77022/2006 dated September 26, 2006 (" said notification " ) the supersession of the Governing , Board of The Uttar Pradesh Stock Exchange Association Limited ("Governing Board " ) was extended by the Securities and Exchange Board of India ( " SEBI " ) upto March 31 , 2007 and Shri K. D. Gupta, IRS (Retd .) continued as the Administrator to exercise and perform all the powers and duties of the Governing Board .
Ihave noted that the Administrator has initiated various corrective measures in the functioning of the exchange, some of which require sustained follow up action . I have also noted that the findings of the special purpose inspection carried out by SEBI in April 2006, revealed shortcomings pertaining to trading, surveillance, listing , etc. at UPSE which needs to be rectified. In order to complete the streamlining of the functioning of the exchange, the process of Demutualisation, appointment ofExecutive Director and also the election and constitution of a new Governing Board, I am of the considered view that the supersession of the Governing Board is required to be extended for a fúrther period of one year upto March 31, 2008 .
In view of the aforesaid, in exercise of the powers conferred upon me under Section 19 of the Securities and ExchangeBoard of India Act, 1992 read with Section 11 ofthe Securities Contracts (Regulation) Act, 1956 and Notification No. S.O. 573 dated July 30, 1992 issued by Central Government, the supersession of the Governing Board of the Uthar, Pradesh StockExchange Association Limited as ordered in the said notification is hereby extended for a further period of one year upto March 31, 2008 with effect from April 01 , 2007, Shri K. D. Gupta, IRS (Retd. ) shall continue as the Administrator and shall exercise and perform all the powers and duties of the Governing Board, during the period so extended. Shri K. D. Gupta may take assistance of such persons as he deems necessary in discharge of his duties as the Administrator .

No. SEBI/ LE/ 77764 / 2006 dated September 29, 2006 ( said notification " ) the supersession of the Council of Management of the Bhubaneswar Stock Exchange Limited ( " Council of Management " ) was extendedby the Securities and Exchange Board of India ( SEBI ) upto March 31 , 2007 and Shri Vivekananda Pattanayak, IAS (Retd . ) was appointed as the new Administrator to exercise and perform all the powers and duties of the Council of Management.
