का. आ. 459( अ ).-जबकि , भारत सरकार के श्रम और रोजगार मंत्रालय के 12 अक्तूबर , 2006 की अपनी अधिसूचना संख्या का. आ. 1756( अ ) के द्वारा श्री पी. सी. परख , पूर्व सचिव , कोयला मंत्रालय को मैसर्स भारत कोकिंग कोल लिमिटेड की कोयला खदानों, विशेष रूप से झारखंड राज्य के धनबाद जिले में भाटडीह कोलियरी में 06-09-2006 को हुई दुर्घटना जिसमें कई श्रमिकों की जान गई थी, के कारण और परिस्थितियों की जांच- पड़ताल करने के साथ- साथ दुर्घटना होने के कारणों की जिम्मेदारी तय करने और 3 माह की अवधि के भीतर रिपोर्ट प्रस्तुत करने के लिए नियुक्त किया था । जांच- पड़ताल की अवधि11-01-2007 तक के लिए तय थी ।

और, जबकि, जांच- पड़ताल करने तथा रिपोर्ट प्रस्तुत करने के लिए इस अवधि को बढ़ाना आवश्यक हो गया है ।
अतः , अब , केन्द्र सरकार , इस अवधि को12-01-2007 से 11-07-2007 तक छः माह की और अवधि अथवा जांच रिपोर्ट प्रस्तुत किए जाने के दिन/तारीख , जो भी पहले हो , तक के लिए बढ़ाती है । तदनुसार, जांच- पड़ताल करने और रिपोर्ट प्रस्तुत करने के लिए अध्यक्ष श्री पी. सी. परख की नियुक्ति की अवधि तथा श्री आर. शर्मा , पूर्व- महानिदेशक, खान सुरक्षा और श्री ओ. पी. लाल, पूर्व खान मंत्री, बिहार तथा आयोजक सचिव, इंटक के असेसरों के रूप में . नियुक्ति की अवधि भी छः महीने अर्थात् 11 जुलाई , 2007 अथवा जांच न्यायालयों द्वारा रिपोर्ट प्रस्तुत किए जाने के दिन/तारीख जो भी पहले हो , तक के लिए बढ़ायी जाती है ।

NOTIFICATION
New Delhi , the 28th March, 2007
S.O. 459 (E) . Whereas , the Government of India in the Ministry of Labour & Employment in their notifica- tion No. S. O. 1756 (E) dated 12th October , 2006 appointed Shri P. C. Parakh, former Secretary , Ministry of Coal to hold aformal inquiry into the causes and circumstances attend- ing the accident that occurred on 6th September, 2006 in the collieries of M/ s . Bharat Coking Coal Limited, more particularly in the Bhatdee Colliery in Dhanbad District of Jharkhand State, causing loss of lives and present a report within a period of three months . The duration of the enquiry was up to 11-01-2007.
And, whereas , it has become necessary to extend the period within which the inquiry is to be conducted and report presented.
Now, therefore, the Central Government do hereby extend thisduration for a further period of six months from 12thJanuary, 2007 to 11th July, 2007 or till the day/date on which the report of the Inquiry is submitted, whichever is earlier .Accordingly the period of appointment of Chair- man, Shri P. C. Parakh to conduct the inquiry and present the report and the period of appointment of Shri R. Sharma, Ex -Director General of Mines Safety and Shri O. P. Lal, Ex- Minister for Mines , Bihar and Organizing Secretary , INTUC as assessors is also extended for a further period of six months i. e. upto 11th July, 2007 or till the day /date on which the report of the Court of Inquiry is submitted , whichever is earlier .
