सं. टीएएमपी/31 /2005-जीसीटीपीएल, महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापसन प्रशुल्क प्राधिकरण , एतद्द्वारा , संलग्न आदेशानुसार, विशाखापट्टणम पत्तन न्यास पर अपने प्रश्चालनों के लिए विशाखा कंटेनर टर्मिनल प्राइवेट लिमिटेड के वर्तमान दरमान की वैधता को विस्तार प्रदान करता है ।

यह प्रकरण विशाखापट्टणम पतन न्यास ( वीपीटी ) पर अपने प्रचालनों के लिए विशाखा कंटेनर टर्मिनल प्राइवेट लिमिटेड (श्रीसीटीपीएल ) के प्रचलित दरमान की वैधता के विस्तार से संबन्धित है ।
2. वीसीटीपीएल के वर्तमान दरमान ( एसओआर ) को इस प्राधिकरण के आदेश सं. टीएएमपी/31 /2005 - वीसीटीपीएल दिनांक 30 अगस्त, 2005 द्वारा अनुमोदित किया गया था जिसको राजपत्र सं. 134 द्वारा भारत का राजपत्र दिनांक 19 सितंबर, 2005 में प्रकाशित किया गया था । उक्त आदेश के अनुसार, वर्तमान दरमान दिनांक 31 मार्च, 2007 तक वैध है । i
3. वीसीटीपीएल ने दिनांक 28 फरवरी , 2007 को अपने दरमान में संशोधन हेतु एक प्रस्ताव दाखिल किया है । प्रस्ताव को एक प्रशुल्क प्रकरण के रूप में पंजीकृत किया गया और प्रायिक परामर्श प्रक्रिया को प्रारंभ किया गया है ।
4. जैसा कि पहले कहा गया है , वीसीटीपीएल के वर्तमान दरमान की वैधता , दिनांक 31 मार्च, 2007 को समाप्त हो जायेगी । चूंकि , अपने दरमान में संशोधन हेतु वीसीटीपीएल से प्राप्त प्रस्ताव , अभी तक परामर्श अवस्था में ही है, और प्रस्ताव की संवीक्षा तथा विश्लेषण के लिए अधिक समय लगेगा , यह प्राधिकरण वीसीटीपीएल के वर्तमान दरमान की वैधता को आगे तीन महीने की अवधि के लिए 30 जून, 2007 तक अथवा वीसीटीपीएल द्वारा दाखिल किये गये प्रस्ताव का अंतिम निपटास इनमें से जो भी पहले हो तब तक विस्तार प्रदान करता है ।

No. TAMP/31/2005 - VCTPL .- In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of the Visakha Container Terminal Private Limited for its operation at the Visakhapatnam Port Trust as in the Order appended hereto.

This case relates to the extension of the validity of the existing Scale of Rates of the Visakha Container Terminal Private Limited ( VCTPL) for its operation at the Visakhapatnam Port Trust (VPT) .
2. The existing Scale of Rates (SOR) of the VCTPL was approved by this Authority vide Order No. TAMP/31/2005- VCTPL dated 30 August, 2005, which was published in the Gazette of India on 19 September, 2005 vide Gazette No. 134. As per the said Order , the existing SOR is valid till 31 March, 2007.
3. The VCTPL has filed a proposal for revision of its SOR on 28 February, 2007. The proposal is registered as a 'tariff casc ' and the usual consultation process has been initiated .
4. As stated earlier, the validity of the existing SOR of the VCTPL will expire on 31 March, 2007. Since the proposal ofthe VCTPL for revision of its SOR is still in the consultative stage , and scrutiny and analysis of the proposal will involve additional time, this authority extends the validity of the existing Scale of Rates of the VCTPL for a further period of three months till 30th June , 2007 or till final disposal of the proposal filed by VCTPL, whichever is earlier .
