सं. टीएएमपी/33/ 2004-वीएसएल. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण , एतद्द्वारा , संलग्न आदेशानुसार , विशाखापट्टणम पत्तनं न्यास में बर्थ संख्या ईक्यू-8 और ईक्यू-9 पर अपने प्रचालन के लिए वैज्राम सीपोर्ट लिमिटेड के वर्तमान दरमान की वैधता को विस्तार प्रदान करता है ।.

यह प्रकरण विशाखापट्टणम पत्तन न्यास में बर्थ संख्या ईक्यू-8 और ईक्यू 9 पर अपने प्रचालन के लिए वैकाग सीपोर्ट लिमिटेड के वर्तमान दरमान की वैधता के विस्तार से सम्बन्धित है ।
2. वीएसएल के प्रारंभिक दरमान ( एसओआर ) को पिछली बार इस प्राधिकरण के आदेश सं. टीएएमपी/33/2004 - बीएसएल दिनांक 15 मार्च, 2005 द्वारा अनुमोदित किया गया था । यह आदेश दरमान सहित , राजपत्र सं. 40 द्वारा , दिनांक 28 मार्च, 2005 को भारत के राजपत्र में प्रकाशित किया गया था । अनुमोदित दरमान की वैधता को उसके कार्यान्वयन की प्रभावी तिथि से लेकर दो वर्ष के लिए, निर्धारित किया गया या । तदनुसार, वीएसएल के बर्तमान दरमान की वैधता, अप्रैल , 2007 माह में समाप्त हो जायेगी ।
3. वीएसएल ने अपने दरमान के संशोधन के लिए दिनांक 1 फरवरी , 2007 को एक प्रस्ताव दाखिल किया है । प्रस्ताव को एक प्रशुल्क प्रकरण के रूप में पंजीकृत किया गया और प्रायिक परामर्श प्रक्रिया को आरंभ कर दिया गया है ।..
4. चूंकि, अपने दरमान में संशोधन हेतु , वीएसएल से प्राप्त प्रस्ताव अभी तक परामर्श अवस्था में ही है , और प्रस्ताव की संवीक्षा तथा विश्लेषण के लिए कुछ अत्रिक समय लगेगा, यह प्राधिकरण वीएसएल के वर्तमान दरमान की वैधता को, उसकी सम्माप्ति तिथि से 31 जुलाई, 2007 तक अथवा वीएसएल द्वारा दाखिल किये गये प्रस्ताव का अंतिम निपटारा इनमें से जो भी पहले हो , तब तक विस्तार प्रदान करत है ।

NOTIFICATION
Mumbai , the 29th March, 2007
No. TAMP /33/2004-VSL.In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of the Vizag Seaport Limited for its operation at the berth numbers EQ- 8 and EQ- 9 at the Visakhapatnam Port Trust as in the Order appended hereto .

i This case relatesto the extension of the validity ofthe existing Scale of Rates ofthe Vizag Seaport Limited ( VSL ) for its operation at the berth numbers EQ- 8 and EQ- 9 at the Visakhapatnam Port Trust ( VPT ) .
2. The initial Scale of Rates (SOR) of the VSL was last approved by this Authority vide Order No. TAMP/ 33/2004- VSL dated 15 March , 2005. The Order alongwith the SOR was published in the Gazette of India on 28th March, 2005 vide Gazette No. 40. The validity of the approved SOR was prescribed for 2 years from the effective date of its implementation. Accordingly, the validity of the existing SOR of the VSL will expire in the month ofApril, 2007 .
3. The VSI , has filed a proposal for revision of its SOR on 1 February , 2007. The proposal is registered as a ' tariff case ' and the usual consultation process has been initiated.
4. Since the proposal of the VSL for revision of its SOR is still in the consultative stage , and scrutiny and analysis ofthe proposal will involve some more time , this authority extends the validity ofthe existing Scale of Rates of the VSL from the date ofits expiry till 31 July, 2007 or till final disposal of the proposal filed by VSL , whichever is carlier .
