का.आ. 1573(अ) . जबकि भारतीय प्रतिभूति और विनिमय बोर्ड ने अधिसूचना का.आ. 1206( अ ) दिनांक 29 अगस्त, 2005 के द्वारा प्रतिभूति संविदा ( विनिमयन ) अधिनियम , 1956 ( जिसे यहां इसके बाद " अधिनियम " कहा गया है ) की धारा 4ख के अनुसार हैदराबाद स्टॉक एक्सचेंज लिमिटेड ( निगमीकरण और अपरस्परीकरण ) योजना , 2005 अधिसूचित की थी;
2. और जबकि अधिनियम की धारा 5 की उप- धारा (2 ) में यह प्रावधान किया गया है कि जहां विनिर्दिष्ट समय के भीतर किसी मान्यताप्राप्त स्टॉक एक्सचेंज को निगमित और अपरस्परीकृत नहीं किया गया हो , ऐसे स्टॉक एक्सचेंज को धारा 4 के तहत दी गई मान्यता समाप्त मानी जाएगी;
3. और जबकि हैदराबाद स्टॉक एक्सचेंज लिमिटेड ( जिसे यहां इसके बाद " एचएसई " कहा गया है ) विनिर्दिष्ट समय के भीतर अर्थात् 28 अगस्त, 2007 को अथवा उससे पूर्व , अपरस्परीकृत होने में असफल रहा है;
4. अतः , अब, अधिनियम की धारा ( 5 ) की उप - धारा (2 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा अधिसूचित करती है कि, एचएसई के निर्धारित समय के भीतर अपरस्परीकृत होने में असफल रहने के परिणामस्वरूप , अधिनियम की धारा 4 के तहत एचएसई को दी गई मान्यता समाप्त की जाती है ।

NOTIFICATION
New Delhi , the 19th September , 2007
S.O. 1573 (E) .- Whereas the Securities and Exchange Board of India vide notification S.O. 1206 (E) dated the 29th August , 2005 had notified the Hyderabad Stock Exchange Limited ( Corporatisation and Demutualisation) Scheme , 2005 in terms of section 4B of the Securities Contracts (Regulation) Act, 1956 (hereinafter referred to as " The Act " ) ;
2. And whereas sub - section (2) of section 5 of the Act provides that where a recognised stock exchange has not been corporatized and demutualised within the specified time, the recognition granted to such stock exchange under section 4 stands withdrawn;
3. And whereas the Hyderabad Stock Exchange Limited (hereinafter referred to as 'HSE ' ) has failed to be demutualised within the specified time , i.e. on or before the 28th August , 2007;
4. Now, therefore , in exercise of the powers conferred under sub - section (2) of section (5) of the Act , the Central Government hereby notifies that , consequent upon failure ofHSE in demutualising within the stipulated time , the recognition granted to HSE under section 4 of the Act stands withdrawn .
