प्रतिभूति संविदा ( विनियमन ) अधिनियम , 1956 की धारा 11 ( 3 ) के अधीन कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड के प्रशासक को नियुक्त करने के लिए अधिसूचना
फा. सं. भाप्रविबो/विधि/ 104533 / 2007.-फा. सं. भाप्रविबो/विधि/ 89596/ 2007 तारीख 26 मार्च , 2007 की अधिसूचना (" उक्त अधिसूचना " ) द्वारा कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड की समिति ( " समिति " ) के अधिक्रमण को भारतीय प्रतिभूति और विनिमय बोर्ड द्वारा 31 मार्च , 2008 तक बढ़ाया गया था और श्री टी. के. दास , आई.ए.एस. ( सेवानिवृत्त ) समिति की समस्त शक्तियों और कर्तव्यों का प्रयोग करने और पालन करने के लिए प्रशासक के तौर पर बने रहे ।
मैंने नोट किया है कि कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड ने अपनी अपरस्परीकरण ( डीम्यूचुअलाइजेशन ) की प्रक्रिया इसकी नियत तारीख अर्थात् 28 अगस्त, 2007 तक पूरी कर ली है और यह कि कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड से अब यह अपेक्षित है कि सम्यक् प्रक्रिया का अनुसरण करने के पश्चात् शासी बोर्ड का गठन करे , भारतीय प्रतिभूति और विनिमय बोर्ड के तारीख 21 सितम्बर , 2005 के पत्र के अनुसार ।
संक्रमण की कालावधि की निगरानी के लिए, प्रतिभूति संविदा ( विनियमन ) अधिनियम , 1956 की धारा 11 और केन्द्रीय सरकार द्वारा जारी तारीख 30 जुलाई , 1992 की अधिसूचना सं. का. आ. 573 के साथ पठित भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम , 1992 की धारा 19 के अधीन मुझे प्रदत्त शक्तियों का प्रयोग करते हुए , श्री सुनील मित्रा , आई.ए.एस. ( जो वर्तमान में पश्चिम बंगाल सरकार के पॉवर एंड नॉन कन्वेंशनल एनर्जी सोर्सेस विभाग के सचिव हैं ) को एतद्वारा श्री टी. के. दास के स्थान पर प्रशासक के रूप में नियुक्त किया जाता है । श्री सुनील मित्रा समिति की समस्त शक्तियों और कर्तव्यों का प्रयोग और पालन करेंगे , कलकत्ता स्टॉक एक्सचेंज एसोसिएशन लिमिटेड के अधिक्रमण की कालावधि के दौरान श्री मित्रा ऐसे व्यक्तियों की सहायता ले सकेंगे जैसा वे प्रशासक के तौर पर अपने कर्तव्यों के निर्वहन में आवश्यक समझें ।

NOTIFICATION

NotificationUnder Section 11 (3) of the Securities Contracts (Regulation) Act, 1956 for Appointing Administrator of CalcuttaStock Exchange Association Limited ( CSE)
F. No. SEBI / LE / 104533/ 2007.- Vide notification F.No. SEBI / LE / 89596 /2007 dated 26th March, 2007 (" said notification" ) the supersession of the Committee of the Calcutta Stock Exchange Association Limited (" Committee" ) was extended by the Securities and Exchange Board of India (" SEBI " ) upto 31st March , 2008 and Shri T. K. Das I.A.S. (Retd.) continued as the Administrator to exercise and perform all the powers and duties of the Committee.
I have noted that CSE has completed its demutualisation process by its due date i.e. 28th August , 2007 and that CSE is now required to constitute a Governing Board after following due procedure , as per SEBI's letter dated 21stSeptember, 2005.
Inorder to oversee the period of transition , in exercise of the powers conferred upon me under Section 19 of the Securities and Exchange Board of India Act, 1992 read with Section 11 of the Securities Contracts (Regulation ) Act, 1956 and Notification No. S.O. 573 dated 30th July, 1992 issuedby Central Government , Shri Sunil Mitra , I.A.S. (currently-Secretary , Department of Power and Non Conventional Energy Sources , Government of West Bengal ) is hereby appointed as Administrator in place of Shri T. K. Das . Shri Sunil Mitra shall exercise and perform all the powers and duties of the committee , during the period of supersession of the Calcutta Stock Exchange Association Ltd. Shri Mitta may take assistance of such persons as he deems necessary in discharge of his duties as Administrator .
