सा.का.नि. 632 (अ), केन्द्रीय सरकार, केन्द्रीय रेशम बोर्ड अधिनियम , 1948 ( 1948 का 61 ) की धारा 13 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय रेशम बोर्ड नियम , 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. ( i ) इन नियमों का संक्षिप्त नाम केन्द्रीय रेशम बोर्ड ( संशोधन ) नियम , 2007 है ।

(ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. केन्द्रीय रेशम बोर्ड नियम , 1955 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 2 में, -

( i ) खंड ( क ) में, " केन्द्रीय रेशम बोर्ड ( संशोधन ) अधिनियम , 1953 ( 1953 का 31 ) द्वारा यथासंशोधित " शब्दों के स्थान पर " समय समय पर यथासंशोधित " शब्द रखे जाएंगे ;

( ii ) हिंदी पाठ में संशोधन की आवश्यकता नहीं है;

( iii ) हिंदी पाठ में संशोधन की आवश्यकता नहीं हैं;

3. उक्त नियमों में , नियम 45 के पश्चात् निम्नलिखित नियम अंतःस्थापित किए जाएंगे , अर्थात्:-

46. सहयुक्त व्यक्ति के लिए फीस या भत्ते: अधिनियम की धारा 8क की उप- धारा ( 2 ) के अधीन समिति से सहयुक्त कोई व्यक्ति समय - समय पर यथासंशोधित वित्त मंत्रालय का.ज्ञा. सं. 6(26) ई. IV/59 , तारीख 5 सितम्बर, 1960 द्वारा जारी अनुदेशों के अनुसार बैठक में भाग लेने के लिए यात्रा भत्ता और दैनिक भत्ता प्राप्त करने का हकदार होगा ।

47. उत्पादक या व्यौहारी के रूप में रजिस्ट्रीकरण के लिए आवेदनः- ( 1 ) किसी किस्म या प्रकार के रेशम कीट बीज उत्पादन करने का आशय रखने वाला कोई व्यक्ति उत्पादक के रूप में रजिस्ट्रीकरण के लिए प्ररूप 12 में तीन प्रतियों में रजिस्ट्रीकरण समिति को आवेदन करेगा ।

(2) रेशम कीट बीज , कोष या पोषित रेशम कीट चौकी का व्यौहार करने का आशय रखने वाला कोई व्यक्ति व्यौहारी के रूप में रजिस्ट्रीकरण के लिए प्ररूप 13 में तीन प्रतियों में रजिस्ट्रीकरणं समिति को आवेदन करेगा ।

(3 ) उप-नियम ( 1 ) और उप- नियम ( 2 ) के अधीन प्रत्येक आवेदन-

(क) के साथ

(i ) नकद में या बैंक ड्राफ्ट या भारतीय पोस्टल आर्डर के माध्यम से संदेय एक सौ रुपए की फीस होगी;

( ii ) आवेदन में उल्लिखित दस्तावेज होंगे;

(ख) में , उस आवेदन में उल्लिखित सभी विशिष्टियां होंगी;

(ग ) आवेदन में उल्लिखित सभी शर्तें पूरी करेगा ।

48 आवेदन की परीक्षा ( 1 ) नियम 47 के उप- नियम ( 1 ) और उप- नियम ( 2 ) के अधीन आवेदन की प्राप्ति पर रजिस्ट्रीकरण समिति अधिनियम की धारा ४ङ की उप - धारा (3 ) और नियम 47 के उप- नियम ( 3 ) के उपबंधों को ध्यान में रखते हुए, आवेदन कीपरीक्षा करेगी।

49. रजिस्ट्रीकरण की प्रक्रिया: रजिस्ट्रीकरण समिति का यह समाधान हो जाने पर कि आवेदक रजिस्ट्रीकरण के लिए पात्र है और अधिनियम की धारा 8ङ की उप- धारा ( 3 ) और नियम 47 के उप- नियम ( 3 ) में उल्लिखित सभी अपेक्षाएं और शर्तें पूरी करता है , निम्नलिखित को रजिस्ट्रीकरण प्रमाणपत्र अनुदत्त करेगी-

(क) प्ररूप 14 में रेशम कीट बीज के उत्पादक को; और

( ख) प्ररूप 15 में रेशम कीट बीज , कोष या पोषित रेशम कीट चौकी के व्यौहारी को ।

50. जहां रजिस्ट्रीकरण मंजूर नहीं किया गया है वहां प्रक्रिया ( 1 ) जहाँ, यथास्थिति , उप - नियम ( 1 ) या उप - नियम ( 2 ) के अधीन किया गया आवेदन अधिनियम की धारा 8ङ की उप- धारा ( 3 ) और नियम 47 के उप-नियम ( 3 ) में उल्लिखितअपेक्षाओं और शर्तों को पूरा नहीं करता है वहां रजिस्ट्रीकरण समिति सुने जाने का उचित अवसर देने के पश्चात् नामंजूर कर सकेगी ।

उन आधारों को बताते हुए दी जाएगी जिन पर आवेदन को नामंजूर किया गया है ।

(2 ) रजिस्ट्रीकरण समिति द्वारा रजिस्ट्रीकरण प्रमाणपत्र के अनुदान से इंकार करने की संसूचना ऐसे इंकार के 30 दिन के भीतर आवेदक को उसमें

51. धारा 49 के अधीन किया गया रजिस्ट्रीकरण प्रत्येक पांच वर्ष के पश्चात् नवीकरणीय होगा ।

52. रजिस्ट्रीकरण का निलंबन या रद्दकरण:-रजिस्ट्रीकरण समिति सुने जाने का उचित अवसर देने के पश्चात् या तो रजिस्ट्रीकरण को निलंबित कर सकेगी या रद्द कर सकेगी यदि-

(क) ऐसा रजिस्ट्रीकरण दुर्व्यपदेशन से या तात्विक तथ्यों को छिपा कर या कपटपूर्ण ढंग से प्राप्त किया गया है; या

(ख) अधिनियम की धारा 8 ग या ४ङ के उपबंधों या उसके अधीन बनाए गए किन्हीं विनियमों या रेशम कीट बीज से संबंधित जारी की गई किसी अधिसूचना का उल्लंघन किया गया है;

(ग ) प्ररूप 14 या प्ररूप 15 में उल्लिखित शर्तों को भंग किया गया है ।

53. रजिस्ट्रीकरण के रद्दकरण का प्रभाव कोई उत्पादक या व्यौहारी जिसका रजिस्ट्रीकरण नियम 52 के अधीन रद्द कर दिया गया है ऐसे रद्दकरण की तारीख से , यथास्थिति, रेशम कीट बीज का उत्पादन नहीं करेगा या रेशम कीट बीज , कोष या पोषित रेशम- कीट चौकी का व्यौहार नहीं करेगा ।

रेशम कीट बीज के उत्पादक के रूप में रजिस्ट्रीकरण के लिए आवेदन [ नियम 47 ( 1 ) देखिए ]

(2) उत्पादन किए जाने के लिए प्रस्तावित रेशम कीट की किस्म या प्रकार की क्वालिटी ।

(3) उत्पादक एकक में उपलब्ध सुविधाएं ।

(4) इस आवेदन की तारीख को कार्य करने वाले कर्मचारियों/कर्मकारों की संख्या

(5) कोई अन्य ब्यौरे ।

(6) घोषणा :

( क ) मैं/हम घोषणा करता हूँ। करते हैं कि ऊपर दी गई सूचना मेरी / हमारी सर्वोत्तम जानकारी और विश्वास के अनुसार सत्य है और उसका कोई भाग मिथ्या नहीं है ।

(ख ) मैंने/हमने उत्पादित किए जाने वाले रेशम कीट बीज की किस्म या प्रकार के लिए और उत्पादन एकक के लिए क्वालिटी मानक तथा विनियम के अधीन यथाविनिर्दिष्ट इस आवेदन के अधीन रजिस्ट्रीकृत उत्पादन प्रक्रिया के बनाए रखने के लिए [ भाग II- खण्ड 3 (i) ]

केन्द्रीय रेशम बोर्ड अधिनियम, 1948 और केन्द्रीय रेशम बोर्ड नियम , 1955 के उपबंधों तथा यहाँ नीचे उल्लिखित निबंधनों और शर्तों (पता) को रेशम कीट बीज की किस्म या प्रकार के उत्पादक के रूप में उसके रजिस्ट्रीकरण के के अधीन रहते हुए , श्री/सुश्री लिए रजिस्ट्रीकरण प्रमाणपत्र अनुदत्त किया जाता है ।

रजिस्ट्रीकरण के निबंधन और शर्तें

1. रजिस्ट्रीकरण प्रमाणपत्र तक विधिमान्य है जब तक कि पूर्व में रद्द या निलंबित न कर दिया गया हो ।

2. उत्पादक किसी प्रमुख या सहजदृश्य स्थान पर इस रजिस्ट्रीकरण प्रमाणपत्र को संप्रदर्शित करेगा जहाँ अधिसूचित किस्म या प्रकार के रेशम कीट बीज का उत्पादन किया जाता है ।

3. उत्पादक केवल अधिसूचित किस्म या प्रकार के रेशम कीट बीज का ही उत्पादन करेगा ।

4. उत्पादक, यह सुनिश्चित करेगा कि रेशम कीट बीज की अधिसूचित किस्म या प्रकार के उत्पादन के लिए यथाविनिर्दिष्ट सुविधाएं क्वालिटी मानकों के बनाए रखने की अपेक्षाओं या शर्तों के अनुकूल हैं ।

5. उत्पादक , रजिस्ट्रीकरण प्राधिकारी को , उसके उन परिसरों के , जहाँ रेशम कीट बीज की अधिसूचित किस्म या प्रकार का उत्पादन किया जाता है , पते में किसी परिवर्तन की सूचना देगा ।

6. उत्पादक, रेशम- कीट बीज उसके उत्पादन के लिए उत्पादक द्वारा प्रयुक्त परिसरों के निरीक्षण के प्रयोजन के लिए रजिस्ट्रीकरण समिति या उसके प्राधिकार के अधीन कार्य करने वाले किसी अन्य प्राधिकारी को प्रत्येक सुविधा प्रदान करेगा ।

केन्द्रीय रेशम बोर्ड अधिनियम , 1948 , केन्द्रीय रेशम बोर्ड नियम , 1955 के उपबंधों तथा यहाँ नीचे उल्लिखित निबंधनों और शर्तों के अधीन रहते हुए , श्री/सुश्री (पता) को रेशम कीट बीज की किस्म या प्रकार/कोष/ पोषित रेशम कीट चौकी के व्यौहार के लिए उसके रजिस्ट्रीकरण के लिए रजिस्ट्रीकरण प्रमाणपत्र अनुदत्त किया जाता है ।

रजिस्ट्रीकरण के निबंधन और शर्तें

2. व्यौहारी किसी प्रमुख या सहजदृश्य स्थान पर इस रजिस्ट्रीकरण प्रमाणपत्र को संप्रद‌र्शित करेगा जहाँ वह रेशम कीट बीज की किस्म या प्रकार/कोष/पोषित रेशम कीट चौकी का व्यौहार करता है ।

3. व्यौहारी उन परिसरों के , पते में किसी परिवर्तन की रिपोर्ट रजिस्ट्रीकरण प्राधिकारी को करेगा जहाँ वह रेशम कीट बीज की अधिसूचित किस्म या प्रकार/ कोष/पोषित रेशम कीट चौकी के क्रय और विक्रय , निर्यात या आयात का कारबार करता है ।

4. व्यौहारी रेशम कीट बीज की अधिसूचित किस्म या प्रकार/ कोष/पोषित रेशम कीट चौकी के क्रय और विक्रय, निर्यात या आयात के कारबार के प्रयोजन के लिए उसके द्वारा प्रयुक्त किन्हीं परिसरों में रेशम कीट बीज/कोष/पोषित रेशम कीट चौकी के निरीक्षण करने के प्रयोजन के लिए रजिस्ट्रीकरण समिति या उसके प्राधिकार के अधीन कार्य करने वाले किसी अन्य अधिकारी को प्रत्येक सुविधा प्रदान करेगा ।

NOTIFICATION

New Delhi , the 28th September , 2007

G.S.R. 632(E) . In exercise of the powers conferred by Section 13 of the Central Silk Board Act , 1948 (LXI of 1948), the Central Government hereby makes the following rules further to amend the Central Silk Board Rules, 1955 , namely:-

1. (1) These rules may be called the Central Silk Board (Amendment ) Rules, 2007 .

They shall corne into force on the date of their publication in the Official Gazette . (ii)

2. inthe Central Silk Board Rules , 1955 (hereinafter referred to as the said rules ) , in rule 2,

(1) inclause (a), for the words , " as amended by the Central Silk Board (Amendment ) Act, 1953 (ΧΧΧΙ of1953)" , the words " as amended from time to time " shall be substituted;

(ii) in clause (b) and throughout the said rules , for the word , " Chairman " wherever it occurs , the word "Chairperson" shall be substituted;

(iii) in clause (c) and throughout the said rules , for the word , " Vice Chairman " wherever it occurs , the word "Vice-Chairperson " shall be substituted;

3. In the said rules , after rule 45 following rules shall be inserted namely:-

46. Fee or allowances for the associated person .--Any person associated by the Committee under sub - section (2) of section 8A of the Act shall be entitled to receive traveling allowance and daily allowance for attending the meeting in accordance with the instructions issued by the Ministry of Finance O.M. No.6 (26 ) -E.IV/59 , dated the 5th September , 1960, as amended from time to time.

47. Application for registration as producer or dealer :- ( 1 ) Any person intending to produce silk-worm seed of any kind or variety shall make an application to the Registration Committee in triplicate in Form - 12 for registration as a producer .

(2) Any person intending to deal in silk -worm seed, cocoon or chawki reared silkworms shall make an application to the Registration Committee in triplicate in Form -13 for registration as a dealer .

(3) Every application under sub - rules ( 1) and (2) shall

(a) be accompanied by

(1) a fee of rupeęs one hundred payable in cash or through Bank draft or Indian Postal Order;

(ii) documents mentioned in the application;

(b) contain all particulars mentioned in the application

48. Examination of application ( 1 ) On receipt of the application under sub - rules (1 ) and (2) of rule 47, the Registration Committee shall examine the application having regard to the provisions of sub -section (3 ) of section 8E of the Act and sub-rule (3) of rule 47.

49. Procedure for Registration .--- The Registration Committee on being satisfied that the applicant is eligible for registration and fulfills all the requirements and conditions mentioned in sub- section (3 ) of section 8E of the Act and sub - rule (3) of rule 47, shall grant a certificate of registration

(a) to the producer of silk - worm seed, in Form - 14; and

(b) to the dealer in silk-worm seed , cocoon or chawki reared silk- worms , in Form 15.

50. Procedure where registration is not granted.-( 1 ) Where an application made under sub -rule ( 1 ) , or as the case may be, sub - rule (2) does not fulfill the requirements and conditions mentioned in sub- section (3 ) of section 8E of the Act, and sub-rule (3) of rule 47 , the Registration Committee may reject the application after giving a reasonable opportunity of being heard.

(2) The refusal to grant registration certificate shall be communicated by the Registration Committee within 30 days of such refusal to the applicant stating therein the grounds on which the application has been rejected.

Suspension or cancellation of registration. The Registration Committee may, after giving an opportunity 51. The registration made under section 49 shall be renewable after every five years . 52.

of hearing, either suspend or cancel the registration if

(a) such Registration has been obtained by misrepresentation or by suppression of material facts or by fraudulent means ; or

(b) the provisions of sections 8C and 8E of the Act or any regulations made there under or any notification issued relating to silk- worm seed have been contravened;

53. Effect of cancellation of registration . Any producer or dealer whose registration has been cancelled under rule 52 shall , with effect from the date of such cancellation , not produce the silk - worm seeds , or as the case may be, deal in silk- worm seed , cocoon or chawki reared silk-worms .

4. The producer shall ensure that the facilities as specified for production of notified kind or variety of silk - worm seed meet the requirements or conditions for maintenance of quality standards .

5. The producer shall intimate to the Registration Authority any change in address of his/ her premises where production of notified kind or variety of silk - worm seed is undertaken.

6. The producer shall extend every facility to the Registration Committee or any other authority acting under his/her authority for the purpose of inspection of silk- worm seed premises used by the producer for production thereof.

Term and Conditions of Registration

1. The Certificate of Registration is valid upto unless previously cancelled or suspended.

2. The dealer shall display this certificate of Registration at a prominent and conspicuous place at the premises where he/she deals in kind or variety of silk - worm seed/cocoons / chawki reared silk-worms .

3. The dealer shall report to the Registration Authority any change in the address of the premises where he/she carries on the business by buying and selling , export or import of notified kind or variety of silk - worm seed/ docoons/chawki reared silk-worms .

4. The dealer shall extend every facility to the Registration Committee or any other officer acting under his authority for the purpose of inspecting the silk - worm seed /cocoon/chawki reared silk - worms in any premises used by him/ her for the purpose of business of buying and selling, export or import of notified kind or variety of silk-worm seed/cocoons/chawki reared silk -worms .
