सा.का.नि. 633 (अ). केन्द्रीय सरकार , सिगरेट और अन्य तम्बाकू उत्पाद ( विज्ञापन का प्रतिषेध और व्यापार तथा वाणिज्य, उत्पादन , प्रदाय और वितरण का विनियमन ) संशोधन अधिनियम , 2007 के साथ पठित सिगरेट और अन्य तम्बाकू उत्पाद ( विज्ञापन का प्रतिषेध और व्यापार तथा वाणिज्य, उत्पादन , प्रदाय और वितरण का विनियमन ) अधिनियम , 2003 ( 2003 का 34 ) की धारा 7 की उप- धारा ( i ) , धारा 8 की उप- धारा ( 2 ) , धारा 10 और धारा 31 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सिगरेट और अन्य तम्बाकू उत्पाद ( पैकेजिंग एवं लैबलिंग ) नियमावली , 2006 में संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सिगरेट और अन्य तम्बाकू उत्पाद ( पैकेजिंग एवं लैबलिंग ) (संशोधन ) नियम, 2007 है ।
2. अनुसूची के लिए निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात :-

क. विनिर्दिष्ट स्वास्थ्यचेतावनी के संघटक:-
हैं : विनिर्दिष्ट स्वास्थ्यचेतावनी के संघटक में निम्नलिखित सम्मिलित
( 1 ) स्वास्थ्य चेतावनी. चेतावनी " धूम्रपान जानलेवा है " (तम्बाकू उत्पादों के धूम्रपान के रूप में ) और " तम्बाकू
जानलेवा है " ( तम्बाकू उत्पादों के धुआं रहित/चबाने

तथा अन्य रूप में ) लाल पृष्ठभूमि में सफेद फोंट रंग (100 प्रतिशत मैजेंटा + 100 प्रतिशत पीला हो ) में दर्शाया जाएगा ।
( 2 ) तम्बाकू उपयोग के दुष्प्रभावों का चित्रात्मक प्रदर्शन, तम्बाकू के उपयोग से स्वास्थ्य पर दुष्प्रभावों को चित्रात्मक रूप में स्वास्थ्य चेतावनी के नीचे दिखाया जाएगा और वे बिल्कुल उसी रंग में होंगे जैसा कि इन नियमों के साथ लगी सीडी में सोफ्ट प्रति में प्रदान किया गया है ।
( 3 ) स्वास्थ्यसन्देश.-प्रत्येक विनिर्दिष्ट स्वास्थ्य चेतावनी में सफेद पृष्ठभूमि पर काले फोंट रंग में स्वास्थ्य सन्देश सम्मिलित होगा । स्वास्थ्यसन्देश को सफेद पृष्ठभूमि पर काले फोंट में आसानी से पढ़ी जा सकने वाली भाषा में मुद्रित किया जाना चाहिए और फोंट टाइप /फोंट आकार बिल्कुल इस नियमावली के साथ प्रदान की गई सोफ्ट प्रति के अनुसार होगा ।
ख. विनिर्दिष्ट स्वास्थ्य चेतावनियाँ इस प्रकार हैं-
( 1 ) तम्बाकू पैकों के धूम्रपान के रूप में- ( क ) धूम्रपान से कैंसर होता है

4. भाषा
(ख) आपके धूम्रपान करने से शिशुओं की मृत्यु होती है।

प्रत्येक स्वास्थ्य चेतावनी और स्वास्थ्य संदेश अंग्रेजी और क्षेत्रीय भाषा में विनिर्दिष्ट किया गया है । यह सुनिश्चित करने के लिए कि स्वास्थ्य चेतावनी और स्वास्थ्य संदेश के लिए चयनित भाषा/भाषाएं निर्माता द्वारा पैक पर प्रयुक्त भाषा/ भाषाओं के अनुरूप हैं , सी डी में उपलब्ध कराए गए संयोजनों में से उचित भाषा संयोजन का चयन किया जा चाहिए । जहां पैक पर एक से अधिक भाषा का प्रयोग होता है , विनिर्दिष्ट स्वास्थ्य चेतावनी और स्वास्थ्य संदेश प्रत्येक भाषा में पृथकतः दी जाएगी । परन्तु यह कि पैक पर दो से अधिक भाषाओं का प्रयोग नहीं किया जाएगा ।
5. मुद्रण
2. चबाने वाले/ धूआंरहित तम्बाकू उत्पादों के पैकेजों के लिए
( ग ) तम्बाकू दर्दनाक मौत का कारण है ।

यह सुनिश्चित किया जाना चाहिए कि इस अनुसूची के पैरा 3 के उप -पैरा ( 2 ) के अध्यधीन मुद्रण करते समय विनिर्दिष्ट स्वास्थ्य चेतावनी के समस्त घटकों के रंग , प्रगाढ़ता , स्पष्टता और आकार में किसी भी प्रकार का फेरबदल नहीं किया जाएगा ।

GSR 633 (E) . In exercise of the powers conferred by sub - section ( 1) of Section 7, Sub - section (2) of Section 8, Section 10 and Section 31 of the Cigarettes And Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce , Production , Supply and Distribution) Act, 2003 (34 of 2003 ), read with Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce , Production , Supply and Distribution) Amendment Act, 2007 the Central Government hereby makes the following Rules to amend the Cigarettes and other Tobacco Products ( Packaging and Labelling) Rules , 2006 , namely :-
टिप्पण : इन नियमों के साथ एक सीडी लगी है जिसमें इन स्वास्थ्य चेतावनियों की एक सॉफ्ट प्रति अन्तर्विष्ट है जिसका प्रयोग तम्बाकू उत्पाद पैकेजों में मुद्रण के लिए किया जाता है ।
1. Short title and Commencement . These Rules may be called the Cigarettes and other Tobacco Products (Packaging and Labelling) (Amendment) Rules , 2007.

2. For the schedule , the following shall be substituted , namely :-

( 1 ) यह सुनिश्चित करने के लिए कि चेतावनी सुपठनीय और सुस्पष्ट है तम्बाकू पैक के प्रत्येक पैनल पर विनिर्दिष्ट स्वास्थ्य चेतावनी 3.5 से.मी. x 4 से.मी. के न्यूनतम आकार में होगी ।
a. Components of specified health warning : ---
The components for the specified health warning shall include :-
(1) Health Warning : - The warning " Smoking Kills" (on smoking forms of tobacco products) ( 2 ) यह सुनिश्चित करने के लिए कि विनिर्दिष्ट स्वास्थ्य चेतावनी पैक के मुख्य प्रदर्शन भाग के पचास प्रतिशत भाग को घेरती है , विनिर्दिष्ट स्वास्थ्य चेतावनी के समस्त घटकों का आकार पैक के आकार के बढ़ने पर उसी अनुपात में बढ़ेगा ।

and "Tobacco Kills" ( on smokeless/chewing and other forms of tobacco products) shall appear in white font colour on a red background ( consisting of 100% magenta + 100% yellow).

(2) Pictorial Representation of ill effects of tobacco use .-Pictorial depiction of the ill effects of tobacco use on health, shall be placed below the health warning and should appear in colour exactly as in the soft copy provided in the CD accompanying these rules .
Note: These rules are accompanied by a CD that contains a soft copy of these health warnings for inclusion in printing of tobacco product packages .
3.Minimum size of the specified health warning.- (3) Health Message. Every specified health warning shall include the health message in black font colour on a white background . The health message should be printed in easy to read black font on a white background and the font type/font size shall be , exactly as per the soft copy provided along with these rules .
b . The specified health warnings are-
(1) The minimum size of the specified health warning on each panel of the tobacco pack shall be 3.5 cm x 4 cm to ensure that the warning islegible and prominent.
(1) For smoking forms of tobacco packs:--
(a) Smoking causes cancer

(2) The size of all components of the specified health warning shall be increased proportionally according to increase of the package size to ensure that the specified health warning occupies fifty per cent of the principal display area/s of the pack.

4. Language. Each health warning and health message has been specified in English and regional languages. Appropriate language combination should be selected from the combination provided in the CD to ensure that the language/ s selected for health warning and health message are in conformity with the language/ s used on the pack by the manufacturer . Where more than one language is used on the pack, the specified health warning and health message shall be given separately in each of the language/ s . Provided that not more than two languages shall be used on the pack .
(2) For chewing/ smokeless forms of tobacco packages:-

5. Printing. It mustbe ensured that the colour , intensity, clarity and size of all the components of the specified health warning are not tampered with while printing subject to sub -paragraph (2) of paragraph 3 of this Schedule .
