का.आ. 1692(अ).-यतः नेशनल लिब्रेशन फ्रंट ऑफ त्रिपुरा तथा उसके अनेक विंगों ( जिसे इसमें इसके पश्चात् एन.एल.एफ.टी. कहा गया है ) तथा ऑल त्रिपुरा टाइगर फोर्स ( जिसे इसमें इसके पश्चात् ए.टी.टी.एफ. कहा गया है ) का स्पष्ट लक्ष्य त्रिपुरा के अन्य सशस्त्र अलगाववादी संगठनों के सहयोग से और सशस्त्र संघर्ष के माध्यम से त्रिपुरा को भारत से अलग करके एक अलग राष्ट्र की स्थापना करना तथा अलगाव के लिए त्रिपुरा के स्थानीय लोगों को भड़काना और इस प्रकार त्रिपुरा को भारत से अलग करना है;
और यतः , ऑल त्रिपुरा टाइगर फोर्स ( एटीटीएफ ) तथा इसका राजनैतिक विंग द त्रिपुरा प्यूपल्स डेमोक्रेटिक फ्रंट ( टीपीडीएफ) त्रिपुरा के भारत संघ में विलय का विरोध करते रहे हैं तथा त्रिपुरा के भारत में विलय को ' अवैध ' बताते हुए तथा त्रिपुरा की ' संप्रभुता एवं स्वतंत्रता ' का समर्थन करते हुए पूर्वोत्तर क्षेत्र के कुछ अन्य भूमिगत संगठनों के साथ संयुक्त वक्तव्य जारी करते रहे हैं;
और यतः , केन्द्र सरकार का मत है कि एन.एल.एफ.टी. और ए.टी.टी.एफ. :
( i) अपने लक्ष्यों को प्राप्त करने के लिए विद्रोही तथा हिंसक गातिविधियों में लिप्त हैं और इस प्रकार इन्होंने सरकार के प्राधिकार को क्षति पहुंचाई है और लोगों में डर एवं आतंक फैलाया है;
( ii ) ने यूनाईटेड लिब्रेशन फंट आफ असम ( उल्फा ) और मणिपुर के मैतई उग्रवादी गुटों जैसे अन्य विधि विरूद्ध संगठनों का समर्थन प्राप्त करने के उद्देश्य से उनसे संबंध स्थापित किए हैं ;
( iii) हाल के पिछले कुछ समय में अपने उद्देश्य एवं लक्ष्य की प्राप्ति के लिए हिंसक तथा विधि विरूद्ध गातिविधियों में लिप्त रहे हैं जो कि भारत की सम्प्रभुता तथा अखंडता के लिए हानिकर हैं;
और यतः , केन्द्रीय सरकार का यह भी मत है कि उनकी हिंसक एवं विधि विरूद्ध गतिविधियों में निम्नलिखित शामिल हैं,-
(क) नागरिकों तथा पुलिस एवं सुरक्षा बलों के कार्मिकों की हत्या;
(ख) त्रिपुरा में व्यवसायियों एवं व्यापारियों सहित जनता से जबरन धन ऐंठना;
( ग) सुरक्षित आश्रय , प्रशिक्षण , शस्त्र एवं गोलाबारूद आदि की प्राप्ति के प्रयोजन के लिए पड़ोसी देश में शिविर स्थापित करना तथा उन्हें बनाए रखना;
( घ ) त्रिपुरा में जनजातीय एवं गैर जनजातीय समुदायों के बीच सांप्रदायिक संघर्ष उत्पन्न करना एवं उसमें वृद्धि करना ।

और , यतः , केन्द्र सरकार का यह मत है कि एन.एल.एफ.टी. और ए.टी.टी.एफ. की उपरोक्त गतिविधियां भारत की संप्रभुता एवं अखंडता के प्रतिकूल हैं तथा ये विधि विरुद्ध संगम है;
अतः अब , विधिविरुद्ध ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उप - धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा नेशनल लिब्रेशन फ्रंट ऑफ त्रिपुरा ( एन.एल.एफ.टी. ) को इसके सभी गुटों, शाखाओं और प्रमुख संगठनों सहित तथा आल त्रिपुरा टाइगर फोर्स ( ए.टी.टी.एफ. ) को इसके सभी गुटों, शाखाओं और प्रमुख संगठनों सहित विधि विरुद्ध संगम घोषित करती है;
और यतः केन्द्र सरकार का यह भी मत है कि यदि एन.एल.एफ.टी. तथा ए.टी.टी.एफ. की विधिविरुद्ध गतिविधियों पर तत्काल नियंत्रण न किया गया तो इन संगठनों को निम्नलिखित कार्यों के करने का अवसर मिल जाएगा :-
(i ) अलगाववादी , विद्रोही एवं हिंसक गतिविधियों को बढावा देने के लिए अपने काडरों को संगठित करना;
(ii ) भारत की संप्रभुता एवं राष्ट्रीय अखंडता के प्रति वैमनस्य भाव रखने वाली शक्तियों के साथ मिलकर राष्ट्र विरोधी गतिविधियों का प्रचार करना;
( iii ) नागरिकों की हत्याएं करने में संलिप्त रहना तथा पुलिस एवं सुरक्षा बलों के कार्मिकों को निशाना बनाना;
( vi ) अंतर्राष्ट्रीय सीमा पार से और अधिक गैर कानूनी हथियार एवं गोलाबारूद प्राप्त करना और लाना;
( v ) अपनी गतिविधियों के लिए जनता से बड़ी राशि इकट्ठी करना तथा जबरन धन ऐंठना ।
और यतः केन्द्र सरकार की , उक्त स्थितियों के मद्देनजर , यह राय है कि एन.एल.एफ.टी. और ए.टी.टी.एफ. को तत्काल प्रभाव से विधि विरुद्ध संगम घोषित करना आवश्यक है, और तदनुसार , उक्त अधिनियम की धारा 3 की उप- धारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार 'एतद्वारा यह निदेश देती है कि यह अधिसूचना उक्त अधिनियम की धारा 4 के अंतर्गत किए जाने वाले किसी भी आदेश के अध्यधीन , सरकारी राजपत्र में इसके प्रकाशन की तारीख से लागू होगी ।

NOTIFICATION

SiO . 1692 (E ) . Whereas the National Liberation Front of Tripura and the various wings thereof (hereinafter referred to as the NLFT ) and All Tripura Tiger Force (hereafter referred to as the ATTF) have as their professed aim, the formation of a separate nation by secession of Tripura from India through armed struggle in alliance with other armed secessionist organizations of Tripura and incite indigenous people of Tripura , for secession and thereby the secession of 'Tripura from India;

And whereas , the ATTF and its political wing the Tripura Peoples Democratic Front (TPDF) has been protesting against merger of Tripura into Indian Union and has been issuing joint statement with some other Under Ground outfits of North Eastern Region criticizing merger of Tripura into India as ' illegal ' and upholding the ' sovereignty and independence ' ofTripura;
And whereas , the Central Government is of the opinion that the NLFT and the ATTF have, ---
(i) been engaging in subversive and violent activities, thereby undermining the authority of the Government and spreading terror and violence among the people for achieving their objectives ;
(ii) established linkages with other unlawful associations , viz . , the United Liberation Front of Asom (ULFA) and Meitei Extremist Outfits of Manipur with the aim of mobilizing their support;
(iii) in pursuance of their aims and objectives in recent past engaged in violent and unlawful activities which are prejudicial to the sovereignty and integrity of India;
And whereas , the Central Government is also of the opinion that their violent and unlawful activities include,- (a) Killing of civilians and personnel belonging to the Police and Security Forces ;

(b) Extortion of funds from the public including businessmen and traders in Tripura;
(c) Establishing and maintaining camps in neighbouring countries for the purpose of safe sanctuary , training, procurement of arms and ammunitions , etc.;
(d) Causing and fomenting communal clashes between the Tribal and non - tribal communities in Tripura ;
Andwhereas , the Central Government is of the opinion that the aforesaid activities of the NLFT and the ATTF are detrimental to the sovereignty and integrity of India and that they are unlawful associations;
Now, therefore, in exercise of the powers conferred by sub- section (1 ) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the National Liberation Front of Tripura (NLFT) alongwith all its factions , wings and front organizations and the All Tripura Tiger Force (ATTF) alongwith all its factions , wings and front organizations to be as unlawful associations ;
And whereas, the Central Government is also of the opinion that if there is no immediate curb and control of the NLFT and the ATTF will take the opportunity to ,-
(i) mobilize their cadres for escalating their secessionist , subversive , and violent activities ;
(ii) propagate anti - national activities in collusion with forces inimical to India's sovereignty and national integrity;
(iii) indulge in killings of civilians and targeting of the Police and Security Forces personnel;
(iv) procure and induct illegal arms and ammunitions from across the international border;
(v) extort and collect huge funds from the public for their unlawful activities;
And whereas, the Central Government, having regard to the above circumstances , is of the opinion that it is necessary to declare the NLFT and the ATTF as unlawful associations with immediate effect ; and accordingly , in exercise of the powers conferred by the proviso to sub-section (3) of Section 3, of the said Act , the Central Government hereby directs that this notification shall, subject to any order that may be made under Section 4 of the said Act , have effect from the date of its publication in the Official Gazette .
