का.आ. 1687(अ). कीटनाशी अधिनियम , 1968 की धारा 5 के अधीन गठित रजिस्ट्रीकरण समिति ने देश में कीटनाशकों के सतत उपयोग या अन्यथा का पुनर्विलोकन करने के लिए एक विशेषज्ञ समूह गठित किया था;

और केन्द्रीय सरकार ने उक्त विशेषज्ञ समिति की सिफारिशों पर विचार करने और कीटनाशी अधिनियम, 1968 (1968 का 46) के अधीन गठित रजिस्ट्रीकरण समिति से परामर्श करने के पश्चात् यह संतुष्ट हो जाने पर कि डियाजिनोन का उपयोग मनुष्य के स्वास्थ्य और पर्यावरण के लिए परिसंकटमय है ;

अतः अब केन्द्रीय सरकार, कीटनाशी अधिनियम, 1968 (1968 का 46) की धारा 28 के साथ पठित धारा 27 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करत हुए , निम्नलिखित आदेश करने का प्रस्ताव करती है, अर्थात् : --

प्ररुप आदेश

1. (1 ) इस आदेश का संक्षिप्त नाम डियाजिनोन के प्रयोग पर निर्बंधन आदेश, 2007 है ।

(2) यह राजपत्र में इसके प्रकाशन की तारीख को प्रवृत्त होगा ।

2. (1 ) कोई व्यक्ति डियाजिनोन का प्रयोग घरेलू उपयोग सिवाय कृषि में नहीं करेगा ।

(2) रजिस्ट्रीकरण प्रमाणपत्र के सभी धारक, लेबलों ओर पत्रकों पर " कृषि में उपयोग पर पाबंदी ' स्पष्ट अक्षरों में चेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाण वापस करेगा ।

(3) यदि कोई व्यक्ति जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, खंड (2) निर्दिष्ट छह मास की अवधि में रजिस्ट्रीकरण समिति को प्रमाणपत्र लौटाने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण का प्रमाणपत्र नवीकृत नहीं किया जाएगा या उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।

3. प्रत्येक राज्य सरकार उक्त अधिनियम और उसके अधीन अधारे गए नियमों के सुसंगत उपबंधो के अधीन ऐसे उपाय करेगी, जो इस आदेश के निष्पादन के लिए वह करना आवश्यक समझे ।

4. प्रारूप आदेश को जो केन्द्रीय सरकार प्रस्तावित करती है, ऐसे सभी व्यक्तियों की जानकारी के लिए जिसके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप आदेश पर उस तारीख से जिसको इस आदेश की भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएग्ग ।

5. उक्त प्रारूप आदेश के संबंध में, कोई व्यक्ति, किसी सुझाव या आक्षेप करने की वांछा करता है तो उसको इसके लिए विनिर्दिष्ट अवधि के भीतर केन्द्रीय सरकार द्वारा विचार करने के लिए संयुक्त सचिव, ( पौध संरक्षण) कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) कृषि भवन , नई दिल्ली को भेज सकेगा ।

S.O. 1687 (E ) .-Whereas , the Registration Committee constituted under Section 5 of the Insecticides Act, 1968 had constituted an Expert Group to review the continued use or otherwise of pesticides in the country;

And whereas the Central Government , after considering the recommendations of the said Expert Group and after consultation with the Registration Committee set up under the Insecticides Act , 1968 ( 46 of 1968 ) is satisfied that the use of Diazinon involves health hazards to human beings and environment ,

Now, therefore, in exercise of the powers conferred by sub - section (2 ) of section 27 read with section 28 of the Insecticides Act , 1968 ( 46 of 1968 ) , the Central Government hereby proposes to make the following Order , namely: -

DRAFT ORDER

1. (1) This Order may be called the Restriction on Use of Diazinon Order , 2007 .

(2) It shall come into force on the date of its publication in the Official Gazette .

2. (1) No person shall use Diazinon in agriculture except for household use.

(2) All the holders of certificate of registration shall return the certificate of registration to the Registration Committee for incorporation of the warning in bold letters " BANNED FOR USE ON AGRICULTURE " on labels and leaflets.

(3) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2 ) , within a period of six months, the certificate of registration granted to them shall not be renewed or action shall be taken under section 14 of the said Act.

3. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State.

4. The Draft Order, which the Central Government proposes to make, is hereby published for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft Order shall be taken into consideration after the expiry of a period of forty five days from the date on which the copies of the Gazette of India containing the Order are made available to the public .

5. Any person desirous of making any suggestion or objection in respect of the said draft Ordermay forward the same for consideration of the Central Government within the period so specified to the Joint Secretary ( Plant Protection) , Ministry of Agriculture, Department of Agriculture and Cooperation, Krishi Bhavan, New Delhi .

(2 ) रजिस्ट्रीकरण , प्रमाणप्रत्र के सभी धारक, लेबलों ओर पत्रकों पर " कृषि में उपयोग पर पाबंदी' स्पष्ट अक्षरों में चेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाण वापस करेंगे ।

(3) यदि कोई व्यक्ति जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, खंड (2) निर्दिष्ट छह मास की अवधि में रजिस्ट्रीकरण समिति को प्रमाणपत्र लौटाने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण का प्रमाणपत्र नवीकृत नहीं किया जाएगा, उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।

(2) यह राजपत्र में इसके प्रकाशन की तारीख को प्रवृत्त होगा ।

(3) रजिस्ट्रीकरण समिति, नए रजिस्ट्रीकृत व्यक्तियों सहित सभी रजिस्ट्रीकृत व्यक्तियों से मैटाजिरोन के लिए प्रदत्त रजिस्ट्रीकरण के प्रमाणपत्रों को वापस ले लेगी ।

(4) यदि कोई व्यक्ति जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, खंड (3 ) निर्दिष्ट छह मास की अवधि में रजिस्ट्रीकरण समिति को प्रमाणपत्र लौटाने में असफल रहता है, तो उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।

(3) The Registration Committee shall call back the certificates of registration granted for Metoxuron from all registrants including new registrants.

.(4) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3 ), within a period of six months , action shall be taken under section 14 of the said Act .

2. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State.
