का.आ. 1724( अ ) यथा- संशोधित विदेश व्यापार नीति , 2004-2009 के पैराग्राफ 1.3 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार , एतद्वारा , विदेश व्यापार नीति, 2004-2009 (19-04-2007 तक अद्यतन ) में निम्नलिखित संशोधन करती है :
1. ईपीसीजी स्कीम के तहत निर्यात दायित्व से सम्बन्धित पैरा 5.4 ( झ ) निम्नलिखित धारा द्वारा प्रतिस्थापित किया जाता है :
" निर्यात दायित्व माल के निर्यात , आवेदक द्वारा विनिर्मित/प्रदान की गई सेवाओं द्वारा पूरा किया जाएगा ।
स्कीम के तहत निर्यात दायित्व बढ़ाई गई अवधि , यदि कोई हो , सहित सम्पूर्ण निर्यात दायित्व अवधि के भीतर उसी और वैसे ही उत्पादों के लिए पिछले तीन लाइसेंसिंग वर्षों में उसके द्वारा किए गए निर्यातों के औसत स्तर के अतिरिक्त होगा; प्रक्रिया पुस्तक, खण्ड-1 के पैरा 5.7.6 में उल्लिखित श्रेणियों को छोड़कर । यह औसत पिछले तीन वर्षों में उसी और ऐसे उत्पादों के लिए निर्यात निष्पादन का योगात्मक माध्म होगा ।
निर्यात दायित्व उसी फर्म/ कम्पनी या समूह कम्पनी/प्रबन्धित होटल जिनके पास ईपीसीजी प्राधिकार है द्वारा विनिर्मित अन्य माल (मालों ) द्वारा भी पूरा किया जा सकता है ।
तथापि, ऐसे मामलों में , लगाया गया अतिरिक्त निर्यात दायित्व प्रक्रिया पुस्तक खण्ड-1 के पैरा 5.7.6 में छूट के बावजूद वास्तविक और स्थानापन्न उत्पाद ( उत्पादों ) सेवा ( सेवाओं ) दोनों के लिए पिछले तीन वर्षों में यूनिट/कम्पनी /समूह कम्पनी/प्रबन्धित होटल द्वारा प्राप्त किए गए औसत निर्यात होंगे । "
2. इसे लोकहित में जारी किया जाता है ।

S.O. 1724 ( E ) . In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation ) Act , 1992 read with paragraph 1.3 of the Foreign Trade Policy ( FTP), 2004-2009 , as amended , the Central Government hereby makes the following amendments in FTP , 2004-2009 (Updated as on 19-4-2007 ) :
1. Paragraph 5.4 (i ) related to Export obligation under EPCG scheme stands replaced by the following clause :
"Export obligation shall be fulfilled by export of goods , manufactured / services rendered by the applicant .
Export obligation under the scheme shall be , over and above , the average level of exports achieved by him in the preceding three licensing years for the same and similar products within the overall export obligation period including extended period , if any ; except for categories mentioned in paragraph 5.7.6 of Handbook of Procedures , Vol. 1. Such average would be the arithmetic mean of export performance in last three years for the same and similar products .
Export obligation may also be fulfilled by exports of other good (s) manufactured or service (s ) provided by the same firm/company or group company / managed hotel which has the EPCG authorisation .
However , in such cases, additional export obligation imposed shall be over and above average exports achieved by the unit / company /group company /managed hotel in preceding three years for both the original and the substitute product (s )/ service(s ) despite exemption in Para 5.7.6 of HBP , Vol . 1. "
