पाद टिप्पण : 1. भारतीय प्रतिभूति और विनिमय बोर्ड ( निक्षेपागार और सहभागी ) विनियम , 1996 , मूल विनियम, का.आ. सं. 345 (अ) , 16 मई , 1996को भारत के राजपत्र , असाधारण भाग II, खंड 3 , उप-खंड ( ii ) में प्रकाशित हुआ था ।
2. भाप्रविबो ( निक्षेपागार और सहभागी ) विनियम, 1996 तत्पश्चात् सं. 11/एल सी/जी एन/2007/4485.--बोर्ड , भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम , 1992 ( 1992 का 15 ) की धारा 30 द्वारा प्रदत्त शक्तियों का प्रयोग करतें हुए, एतद्वारा भारतीय प्रतिभूति और विनिमय बोर्ड ( निक्षेपागार और सहभागी ) विनियम, 1996 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्
(क) 7 फरवरी , 1997 को भाप्रविबो ( निक्षेपागार और सहभागी ) (संशोधन ) विनियम , 1997, सं. का.आ. 91 (अ ) , द्वारा 1. इन विनियमों को भारतीय प्रतिभूति और विनिमय बोर्ड ( निक्षेपागार और सहभागी ) ( संशोधन ) विनियम , 2007 कहा जा सकेगा ।
2. वे राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
(ख ) 5 सितम्बर , 1997 को भाप्रविबो ( निक्षेपागार और सहभागी) ( दूसरा संशोधन ) विनियम , 1997 , सं. का.आ. 640( अ ) , द्वारा
(ग ) 5 जनवरी , 1998 को भाप्रविबो ( निक्षेपागार और सहभागी ) (संशोधन ) विनियम, 1998 , सं. का.आ. 18 (अ ) , द्वारा 3. भारतीय प्रतिभूति और विनिमय बोर्ड ( निक्षेपागार और सहभागी ) विनियम, 1996 में , विनियम 7 में , खण्ड ( ग ) के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा , अर्थात्:
(घ) 21 जनवरी , 1998 को भाप्रविबो (निक्षेपागार और सहभागी ) (दूसरा संशोधन ) विनियम, 1998 , सं. का.आ. 76( अ ) , द्वारा
(ङ) 20 मई , 1999 को भाप्रविबो ( निक्षेपागार और सहभागी ) (संशोधन ) विनियम, 1999 , सं. का.आ. 357 ( अ ) , द्वारा
(च ) 7 जुलाई, 1999 को भाप्रविबो (निक्षेपागार और सहभागी ) ( दूसरा संशोधन ) विनियम, 1999 , सं. का.आ. 546 (अ) , द्वारा
(छ ) 21 सितम्बर, 1999 को भाप्रविबो ( निक्षेपागार और सहभागी ) (तीसरा संशोधन ) विनियम, 1999 , सं. का.आ. 775( अ) , द्वारा " परंतु यह कि निक्षेपागार ऐसा क्रियाकलाप कर सकेगा जो निक्षेपागार के रूप में इसके क्रियाकलापों से आनुषंगिक न हो , जैसा केन्द्रीय सरकार द्वारा या वित्तीय क्षेत्र में विनियामक द्वारा निक्षेपागार के प्रति नियत किया जा सकेगा, प्रत्येक क्रियाकलाप से विनिर्दिष्ट स्ट्रेटेजिक बिजनेस यूनिट की स्थापना के माध्यम से, बोर्ड के पूर्विक अनुमोदन से और ऐसी शर्तों के अध्यधीन जो बोर्ड द्वारा विहित की जाएं, जिनमें एक पृथक् कंपनी को ऐसे क्रियाकलाप का अंतरण ऐसे समय के भीतर सम्मिलित है जो बोर्ड द्वारा विनिर्दिष्ट किया जाए, उन मामलों को ध्यान में रखते हुए जो विनियम 13 में यथा उल्लिखित निक्षेपागार के दक्ष और सुव्यवस्थित कार्य से सुसंगत हैं ।
(ज ) 26 दिसम्बर, 2000 को भाप्रविबो ( निक्षेपागार और सहभागी ) (संशोधन ) विनियम , 2000 , सं. का.. 1160 ( अ ) , द्वारा
स्पष्टीकरण : इस खण्ड के प्रयोजनों के लिए , स्ट्रेटेजिक बिजनेस यूनिट कंपनी की संगठनात्मक यूनिट होगी , जिसका अपना

No. 11 /LC/GN/2007 / 4485 .--In exercise of the powers conferred by Section 30 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby makes the following Regulations to further amend the Securities and Exchange Board of India (Depositories and Participants) Regulations , 1996, namely :-
(g) On September 21 , 1999 by SEBI (Depositories and Participants ) (Third Amendment ) Regulations , 1999 vide No. S.O. 775(Ε) .
1. These Regulations may be called the Securities and Exchange Board of India (Depositories and Participants) (Amendment) Regulations , 2007 .
(h) On December 26, 2000 by SEBI (Depositories and Participants ) (Amendment ) Regulations , 2000 vide No. S.O. 1160(E).
2. They shall come into force on the date of their publication in the Official Gazette.
(i) OnMay 29, 2001 by SEBI ( Investment Advice by Intermediaries) (Amendment) Regulations , 2001 vide No. S.O. 476 (E) .
3. In the Securities and Exchange Board of India (Depositories and Participants) Regulations , 1996, in regulation 7 , after clause (c) , the following proviso shall be inserted, namely :-
(j ) On September 27, 2002 by SEBI (Procedure for Holding Enquiry by Enquiry Officer and Imposing Penalty) Regulations , 2002 vide No. S.O. 1045(E).
(k) On June 16, 2003 by SEBI (Depositories and Participants) (Amendment ) Regulations , 2003 vide No. $ .O . 696(Ε) .
(1) On September 2, 2003 by SEBI (Depositories and Participants) (Second Amendment) Regulations , 2003 vide S.O. No. 1014 (E) .
"Provided that a depository may carry out such activity not incidental to its activities as a depository, as may be assigned to the depository by the Central Government or by a regulator in the financial sector , through the establishment of Strategic Business Unit (s ) specific to each activity with the prior approval of the Board and subject

to such conditions as may be prescribed by the Board, including transfer of such activity to a separate company within such time as may be specified by the Board, having regard to the matters which are relevant to the efficient and orderly function of the Depository as mentioned inregulation13.
