का.आ. 1736(अ).- केन्द्रीय सरकार पर्यावरण ( संरक्षण) अधिनियम , 1986 (1986 का 29) की धारा 3 की उप- धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार की अधिसूचना संख्यांक का.आ. 1533 (अ) तारीख 14 सितम्बर, 2006 के अनुसरण में संघ क्षेत्र पर्यावरण प्रभाव निर्धारण प्राधिकरण ( यू टी आई ए ए ) , दमन, दीव, दादर और नगर हवेली संघ शासित क्षेत्र ( जिसे इसमें इसके पश्चात् प्राधिकरण , दमन, दीव , दादर और नगर हवेली संघ शासित कहा गया है) का गठन करती है जिसमें दमन, दीव, दादर और नगर हवेली संघ शासित क्षेत्र सरकार द्वारा नाम निर्देशित तीन सदस्य अर्थात् अध्यक्ष, सदस्य और सदस्य सचिव समाविष्ट होंगे , जो निम्नलिखित हैं : -

2. अध्यक्ष और सदस्यों की पदावधि इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी ।
3. प्राधिकरण , दमन, दीव, दादर और नगर हवेली संघ शासन ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रक्रियाओं का अनुसरण करेगा जो अधिसूचना संख्याक का.आ. 1533 (अ) , तारीख 14 सितम्बर , 2006 में दी गई है ।
4. प्राधिकरण , दमन, दीव, दादर और नगर हवेली संघ शासन इस आदेश में दमन, दीव , दादर और नगर हवेली संघ शासन के लिए गठित संघ शासित विशेषज्ञ मूल्यांकन समिति (यू टी ई एसी) की सिफारिशों के आधार पर अपने निर्णय देगी ।
5. दमन, दीव, दादर और नगर हवेली संघ शासन अभिकरण को प्राधिकरण के सचिवालय के रूप में कार्य करने के लिए अधिसूचित करेगा और यह सभी वित्तीय और संभारिक सहायता, जिसके अंतर्गत आवास सुविधा , परिवहन, और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवाएगी । प्राधिकरण के अध्यक्ष और सदस्य को बैठक फीस , यात्रा भत्ता/ महंगाई भत्ता दमन , दीव, दादर और नगर हवेली संघ शासन द्वारा नियमानुसार संदत्त होगा ।
6. उक्त प्राधिकरण की सहायता के लिए केन्द्रीय सरकार दमन, दीव, दादर और नगर हवेली संघ शासन से परामर्श करके राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति, दमन, दीव, दादर और नगर हवेली संघ शासन का गठन करती है ( जिसे इसमें इसके पश्चात् यू टी ई ए सी कहा गया है ) जिसमें निम्नलिखित सदस्य समाविष्ट होंगे: -

7. अध्यक्ष और सदस्यों की पदावधि , इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी और यू टी ई एसी , दमन, दीव, दादर और नगर हवेली संघ शासन का प्रत्येक तीन वर्ष के पश्चात् पुर्नगठन किया जाएगा ।
8. यू टी ई एसी , दमन, दीव, दादर और नगर हवेली संघ शासन ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रक्रियाओं का अनुसरण करेगी जो अधिसूचना संख्यांक का.आ. 1533 (अ) तारीख 14 सितम्बर , 2006 में दी है ।
9. यू टी ई एसी , दमन, दीव , दादर और नगर हवेली संघ शासन सामूहिक दायित्व के सिद्धांत पर काम करेगी । , अध्यक्ष, प्रत्येक मामले में एकमत होने का प्रयास करेगा और यदि एकमत नहीं हो सकता तो बहुमत का विचार अभिभावी होगा ।
10. दमन, दीव, दादर और नगर हवेली संघ शासन, अभिकरण को यू टी ई एसी , दमन, दीव, दादर और नगर हवेली संघ शासन के सचिवालय के रुप में कार्य करने के लिए अधिसूचति करेगा और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत स्थान सुविधा , परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवायेगी । यूटीईएसी के अध्यक्ष और सदस्यों को बैठक फीस , यात्रा भत्ता/महंगाई भत्ता दमन, दीव, दादर और नगर हवेली संघ शासन द्वारा राज्य के नियमों के अनुसार संदत्त किया जाएगा ।

S.O. 1736 ( E ) . In exercise of the powers conferred by sub - section ( 3) of section 3 of the Environment (Protection ) Act , 1986 (29 of 1986 ) and in pursuance of the Government of India notification number S.O. 1533( E) dated the 14th September, 2006 , the Central Government hereby constitutes the Union Territory Level Environment Impact Assessment Authority ( UTEIAA) , UT of Daman , Diu , Dadra and Nagar Haveli (hereinafter referred to as the Authority, UT of Daman , Diu , Dadra and Nagar Haveli ) comprising of three members namely , Chairman , Member and Member Secretary nominated by the Union Territory Government of UT of Daman , Diu , Dadra and Nagar Haveli as under:

2. The Chairman and Members shall have the term of three years from the date of publication of this notification in the Official Gazette.
3 . The Authority, UT of Daman , Diu , Dadra and Nagar Haveli shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 ( E) dated the 14th September , 2006.
4. TheAuthority, UT of Daman , Diu , Dadra and Nagar Haveli shall base its decision on the recommendations of the Union Territory Level Expert Appraisal Committee ( UTEAC) constituted for the UT of Daman , Diu , Dadra and Nagar Haveli in this order.
5. The UT of Daman , Diu , Dadra and Nagar Haveli shall notify the agency to act as secretariat for the Authority and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect of all its statutory functions. Sittingfee , Travelling Allowance / Dearness Allowance to the Chairman and Member of the Authority shall be paid by the State Government of UT of Daman , Diu , Dadra and Nagar Haveli as per State rules.
6. To assist the said Authority , the Central Government , in consultation with the Government of UT of Daman , Diu , Dadra and Nagar Haveli , hereby constitutes the Union Territory Level Expert Appraisal Committee , UT of Daman , Diu , Dadra and Nagar Haveli ( hereinafter referred to as UTEAC ), which shall comprise the following Members:

7 . The Chairman and Members shall have the term of three years from the date of publication of this notification in the Official Gazette and UTEAC , UT of Daman , Diu , Dadra and Nagar Haveli shall be reconstituted after every three years .
8. The UTEAC , UT of Daman , Diu , Dadra and Nagar Haveli ' shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 ( E) dated the 14th September, 2006.

9. The UTEAC, UT of Daman , Diu , Dadra and Nagar Haveli shall function on the principle of collective responsibility . The Chairperson shall endeavour to reach a consensus in each case , and if consensus cannot be reached , the view of the majority shall prevail .
10. The UT of Daman , Diu , Dadra and Nagar Haveli shall notify the agency to act as secretariat for the UTEAC , UT of Daman , Diu , Dadra and Nagar Haveli and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect to all its statutory functions. Sitting fee , Travelling Allowance / Dearness Allowance, to the Chairman and Members of the UTEAC shall be paid by the UT of Daman , Diu , Dadra and Nagar Haveli as per State rules .
