S.O. 1749 (E) . Whereas as per the provisions contained under Section 5(1) of the Foreign Contribution (Regulation) Act, 1976, no organization of a political nature , not being a political party, shall , accept any foreign contribution, except with the prior permission of the Central Government.
का.आ. 1749(अ) .-यह कि विदेशी अभिदाय (विनियमन ) अधिनियम, 1976 की धारा 5 ( 1 ) के अन्तर्गत किए गए प्रावधानों के अनुसार, राजनीतिक प्रकृति का कोई भी संगठन , जो राजनीतिक दल नहीं है , केन्द्र सरकार की पूर्वानुमति के बिना किसी प्रकार का विदेशी अभिदाय स्वीकार नहीं करेगा ।
2. यह कि मातृछाया , श्री शान्तादुर्गा प्रसाद , धावली , कावले, पोण्डा, गोवा-403 401 नामक संगठन के दो पदाधिकारी, विश्व हिन्दू परिषद्-जिसे विदेशी अभिदाय ( विनियमन ) अधिनियम, 1976 की धारा 5 ( 1) के अन्तर्गत राजनीतिक प्रकृति का संगठन , किन्तु राजनीतिक दल नहीं, घोषित किया गया है - के सक्रिय कार्यकर्ता हैं; सन्दर्भित अधिनियम के प्रयोजनार्थ उक्त संगठन , " राजनीतिक प्रकृति का संगठन , किन्तु राजनीतिक दल नहीं " , पाया गया है ।
2. Whereas two of the office bearers of the association, namely, Matruchhaya , Shri Shantadurga Prasad, Dhavali, Kavale , Ponda , Goa - 403 401 are active members ofVHP , an association declared as an organisation ofa political nature not being a political party under Section 5(1) of the Foreign Contribution ( Regulation) Act, 1976; the said association has been found to be " an organisation of a political nature, not being a political party" for the purpose of the said Act .
3. अतः अब , केन्द्र सरकार , विदेशी अभिदाय ( विनियमन ) अधिनियम, 1976 की 'धारा 5 की उप- धारा ( 1 ) की व्याख्या द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अधिनियम की सन्दर्भित धारा में उल्लिखित प्रावधानों के प्रयोजनार्थ, सन्दर्भित संगठन को , इसकी सभी शाखाओं और इकाइयों सहित , एतद्वारा , " राजनीतिक प्रकृति का संगठन, किन्तु राजनीतिक दल नहीं" , के रूप में विनिर्दिष्ट करती है ।
3.Now, therefore, in exercise ofpowers conferred by the explanation to sub- section ( 1) of Section 5 of the Foreign Contribution (Regulation) Act, 1976 (49 of 1976) , the Central Government hereby specify the said association including its branches and units to be " an organisation of a political nature, not being a political party " for the purpose of the provisions contained in the said section of the Act .
4. अतः , राजनीतिक प्रकृति का संगठन, किन्तु राजनीतिक दल नहीं, होने के नाते , मातृछाया , श्री शान्तादुर्गा प्रसाद , धावली , कावले , पोण्डा, गोवा-403 401 ( इसकी सभी शाखाओं और इकाइयों सहित ) द्वारा विदेशी अभिदाय स्वीकार करने के लिए, विदेशी अभिदाय (विनियमन ) अधिनियम , 1976 की धारा 5 ( 1 ) के अनुसार केन्द्र सरकार की पूर्वानुमति लेना अपेक्षित है ।
4.Matruchhaya, Shri Shantadurga Prasad , Dhavali , Kavale, Ponda , Goa-403 401 (including its branches and units) being an organisation of a political nature , not being a political party is , therefore , required to obtain prior permission of the Central Government as per Section 5(1) of the Foreign Contribution (Regulation ) Act, 1976 to receive foreign contribution .
