सा.का.नि. 669(अ). केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम , 1985 ( 1985 का 13 ) की धारा 35 की उप- धारा ( 2 ) के खंड ( ग ) और धारा 36 क के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महाराष्ट्र प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 में और संशोधन करने के लिए एतद्द्वारा निम्नलिखित नियम बनाती है, अर्थात्: -
1..( 1 ) इन नियमों का नाम महाराष्ट्र प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) संशोधन नियम , 2007 है ।
(2) ये 1 अप्रैल, 2004 को प्रवृत्त हुए समझे जाएंगे ।
2. महाराष्ट्र प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 में नियम 8 में उप -नियम (2 ) के स्थान पर निम्नलिखित उप- नियम रखा जाएगा , अर्थात्:-
" ( 2 ) उप-नियम ( 1 ) के अधीन पेंशन की संगणना सेवा के प्रत्येक पूरे वर्ष के लिए सात हजार चौहत्तर रुपए ( चार हजार सात सौ सोलह रुपए पेंशन के रूप में और दो हजार तीन सौ अट्ठावन रुपए महंगाई पेंशन के रूप में ) प्रतिवर्ष की दर से की जाएगी । "
बशर्ते कि " इस नियम के अंतर्गत भुगतान योग्य पेंशन की कुल राशि पेंशन के संराशीकृत भाग , यदि कोई हो, सहित किसी ऐसी पेंशन की राशि को मिलाकर किसी उच्च न्यायालय के एक न्यायाधीश के लिए निर्धारित पेंशन की अधिकतम राशि से अधिक नहीं होगी जो अधिकरण में पद धारण करते समय आहरित की गई हो अथवा आहरित किए जाने के लिए अधिकृत हो । "
स्पष्टीकारक ज्ञापन
केन्दीय सरकार ने महाराष्ट्र प्रशासनिक अधिकरण के सदस्यों की पेंशन को 1 अप्रैल , 2004 से संशोधित करने का निर्णय लिया है । तद्नुसार, महाराष्ट्र प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1986 भूतलक्षी प्रभाव से, अर्थात् 1 अप्रैल , 2004 से संशोधित की जा रही है ।
2. ऐसे सदस्यों के मामले में, जो 31-3-2004 को सेवानिवृत्त हो चुके हैं उनकी वर्तमान पेंशन का 50 प्रतिशत के समान मंहगाई राहत , अर्थात् 4716 रुपए का 50 प्रतिशत पेंशन के साथ सम्मिलित किया जाएगा और महंगाई पेंशन के रूप में पृथक से दर्शित किया जाएगा तथा महंगाई 4277 G1/2007 (1) THE GAZETTE OF INDIA : EXTRAORDINARY

राहत की विद्यमान दर से इसकी कटौती की जाएगी । 1-4-2004 से सेवानिवृत्त सदस्यों के मामले में वे 7074 रुपए पेंशन के साथ केन्द्रीय सरकार द्वारा घोषित होने वाले महंगाई राहत के हकदार होंगे और महंगाई पेंशन का कोई अलग घटक नहीं होगा ।
3. यह प्रमाणित किया जाता है कि प्रस्तावित संशोधन को भूतलक्षी प्रभाव दिए जाने से महाराष्ट्र प्रशासनिक अधिकरण के किसी सदस्य पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

G.S.R. 669 (E ). In exercise of the powers conferred by sub - section ( 1 ) , read with clause ( c) of sub - section (2) of Section 35 and Section 36A, of the Administrative Tribunals Act, 1985 ( 13 of 1985) , the Central Government hereby makes the following rules further to amend the Maharashtra Administrative Tribunal ( Salaries and Allowances and Conditions of Service of Chairman, Vice- Chairmen and Members ) Rules , 1986 , namely:-
1. (1) These rules may be called the Maharashtra Administrative Tribunal ( Salaries and Allowances and Conditions ofService of Chairman , Vice - Chairmen and Members) Amendment Rules , 2007 .
(2) They shall be deemed to have come into force on the 1st day of April , 2004 .
2. In the Maharashtra Administrative Tribunal ( Salaries and Allowances and Conditions of Service of Chairman , Vice- Chairmen and Members ) Rules , 1986 , in rule 8 for sub - rule ( 2) , the following sub - rule shall be substituted namely : --
"2. Pension under sub - rule 1 shall be calculated at the rate of rupees seven thousand seventy four per annum (rupees four thousand seven hundred and sixteen as Pension plus rupees two thousand three hundred and fifty eight as Dearness Pension) for each completed year of service . "
Provided that " the aggregate amount of pension payable under this rule together with the amount of any pension including commuted portion of pension , if any, drawn or entitled to be drawn while holding office in the Tribunal shall not exceed the maximum amount of pension prescribed for a judge of a High Court .
EXPLANATORY MEMORANDUM
The Central Government has decided to revise the pension of Members of the Maharashtra Administrative Tribunal with effect from the 1st April , 2004. Accordingly the Maharashtra Administrative Tribunal ( Salarics and Allowances and Conditions of Service of Chairman , Vice - Chairmen and Members ) Rules , 1986 are being amended retrospectively, that is with effect from the 1st April , 2004 .
2. In the case of members who retired upto 31-3-2004, Dearness Relief equal to 50 per cent ofthe present pension i.e. 50 per cent of Rs . 4716 will be merged with pension and shown distinctly as Dearness Pension and would be deducted fromthe existing rate of Dearness Relief. In the case of members retiring with effect from 1-4-2004, they will be entitled to a pension of Rs . 7074 plus Dearness Relief as may be announced by the Central Government and there will be no separate element ofDearness Pension .
4. It is certified that no Member of the Maharashtra Administrative Tribunal is likely to be affected adversely by the proposed amendment being given retrospective effect .

स्पष्टीकारक ज्ञापन

सा.का. नि. 672 (अ) .-केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम , 1985 ( 1985 का 13 ) की धारा 35 की उप - धारा (2 ) के खंड ( ग ) और धारा 36 ' क ' के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , आन्ध्र प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1989 में और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्: -
1. ( 1 ) इन नियमों का नाम आन्ध्र प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्योंका वेतन और भत्ते तथा सेवा की शर्तें ) संशोधन नियम , 2007 है ।
(2 ) ये 1 अप्रैल, 2004 को प्रवृत्त हुए समझे जाएंगे ।
2. आन्ध्र प्रदेश प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1989 में नियम में उप - नियम ( 2 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा , अर्थात्:-
" (2 ) उप नियम ( 1 ) के अधीन पेंशन की संगणना सेवा के प्रत्येक पूरे वर्ष के लिए सात हजार चौहत्तर रुपए ( चार हजार सात सौ सोलह रुपए पेंशन के रूप में और दो हजार तीन सौ अट्ठावन रुपए महंगाई पेंशन के रूप में ) प्रतिवर्ष की दर से की जाएगी । "
बशर्ते कि " इस नियम के अंतर्गत भुगतान योग्य पेंशन की,कुल राशि पेंशन के संराशीकृत भाग , यदि कोई हो, सहित किसी ऐसी पेंशन की राशि को मिलाकर किसी उच्च न्यायालय के एक न्यायाधीश के लिए निर्धारित पेंशन की अधिकतम राशि से अधिक नहीं होगी जो अधिकरण में पद धारण करते समय आहरित की गई हो अथवा आहरित किए जाने के लिए अधिकृत हो । "
स्पष्टीकारक ज्ञापन
केन्द्रीय सरकार ने आन्ध्र प्रदेश प्रशासनिक अधिकरण के सदस्यों की पेंशन को । अप्रैल , 2004 से संशोधित करने का निर्णय लिया है। तदनुसार, आन्ध्र प्रदेश प्रशासनिक अधिकरण (अध्यक्ष , उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें ) नियमावली , 1989 भूतलक्षी प्रभाव से , अर्थात् 1 अप्रैल , 2004 से संशोधित की जा रही है ।

2. ऐसे सदस्योंके मामले में, जो 31-3-2004 को सेवानिवृत्त हो चुके हैं उनकी वर्तमान पेंशन का 50 प्रतिशत के समान मंहगाई राहत, अर्थात् 4716 रुपए का 50 प्रतिशत पेंशन के साथ सम्मिलित किया जाएगा और महंगाई पेंशन के रूप में पृथक से दर्शित किया जाएगा तथा महंगाई राहत की विद्यमान दर से इसकी कटौती की जाएगी । 1-4-2004 से सेवानिवृत्त सदस्यों के मामले में वे 7074 रुपए पेंशन के साथ केन्द्रीय सरकार द्वारा घोषित होने वाले महंगाई राहत के हकदार होंगे और महंगाई पेंशन का कोई अलग घटक नहीं होगा।
3. यह प्रमाणित किया जाता है कि प्रस्तावित संशोधन को भूतलक्षी प्रभाव दिए जाने से आन्ध्र प्रदेश प्रशासनिक अधिकरण के किसी सदस्य पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

EXPLANATORY MEMORANDUM
The Central Government has decided to revise the pension of Members of the Andhra Pradesh Administrative Tribunal with effect from the 1st April , 2004. Accordingly , the Andhra Pradesh Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice - Chairmen and Members ) Rules, 1989 are being amended retrospectively, that is with effect from the 1st April , 2004.

In the case of members who retired up to 31-3-2004, Dearness Relief equal to 50 per cent of the present pension i . e. 50 per cent of Rs . 4716 will be merged with pension and shown distinctly as Dearness Pension and would be deducted from the existing rate of Dearness Relief. In the case of members retiring with effect from 1-4-2004, they will be entitled to a pension of Rs . 7074 plus Dearness Relief as may be announced by the Central Government and there will be no separate element of Dearness Pension .
