फा. सं. एएआई/विधायी/जीएचआरईजी/2007 . भारतीय विमानपत्तन प्राधिकरण अधिनियम , 1994 ( 1994 का 55 ) की धारा 42 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय विमानपत्तन प्राधिकरण ( सामान्य प्रबंध, भूमि संचलन सेवाओं के लिए प्रवेश ) विनियम, 2000 का उन बातों के सिवाय अधिक्रमण करते हुए , जो ऐसे अधिक्रमण के पूर्व की गई हैं या किए जाने से छोड़ दी गई हैं, भारतीय विमानपत्तन प्राधिकरण केन्द्रीय सरकार के पूर्व अनुमोदन से निम्नलिखित विनियम बनाता है , अर्थात्:-
1. संक्षिप्त नाम, प्रारंभ और लागू होना ( 1) इन विनियमों को भारतीय विमानपत्तन प्राधिकरण ( सामान्य प्रबंध , भूमि संचलन सेवाओं के लिए प्रवेश) विनियम, 2007 कहा जाएगा ।
(2) ये विनियम सरकारी राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
(3) ये विनियम भारतीय विमानपत्तन प्राधिकरण द्वारा व्यवस्थित सभी विमानपत्तनों और सिविल एन्क्लेवों को लागू होंगे ।
परंतु ये विमानपत्तनों पर रक्षा स्थापनों या एन्क्लेवों या अहातों ( एन्कलोजरों) को लागू नहीं होंगे ।
2 . परिभाषाएं - इन विनियमों में जब तक संदर्भ से अन्यथा अपेक्षित न हो -
( क) " एप्रन " से यात्रियों अथवा कार्गो (स्थोरा) को चढ़ाने अथवा उतारने , ईंधन लेने, पार्क करने या अनुरक्षण के प्रयोजन के लिए वायुयान को ठहराने के लिए आशयित विमानपत्तन एन्क्लेव अभिप्रेत हैं;
(ख) "प्राधिकरण " से भारतीय विमानपत्तन प्राधिकरण अधिनियम, 1994 ( 1994 का 55) की धारा 3 की उप धारा ( 1 ) के अधीन गठित भारतीय विमानपत्तन प्राधिकरण अभिप्रेत है ;
( ग) "अध्यक्ष " से धारा 3 की उप धारा ( 3) के उप खंड ( 1 ) के अधीन नियुक्त प्राधिकरण का अध्यक्ष अभिप्रेत हैं;

( घ) " सिविल एन्क्लेव " से संघ के किसी सशस्त्र बल का किसी विमानपत्तन पर आबंटित क्षेत्र , यदि कोई हो, अभिप्रेत है , जिसका व्यक्तियों द्वारा ऐसे विमानपत्तन से किसी हवाई परिवहन सेवा का उपयोग करने अथवा बैगेज या कार्गो को ऐसी सेवा द्वारा संभालने के लिए उपयोग किया जाता है और ऐसे क्षेत्र पर कोई भवन या संरचना समाविष्ट करने वाली भूमि सम्मिलित है;
(50 ) "भूमि संचलन" से अभिप्रेत है: -
(i ) इन विनियमों की अनूसूची । में विनिर्दिष्ट रूप में क्रियाकलाप सहित रैंप संचलन;
( ii ) इन विनियमों की अनुसूची- ।। में विनिर्दिष्ट रूप में क्रियाकलाप सहित यातायात संचलन;
(iii)अध्यक्ष द्वारा अभिहित कोई अन्य क्रियाकलाप चाहे वह रैंप संचलन का या यातायात संचलन का भाग रूप हो;
(च) " संयुक्त वेंचर कंपनी " से किसी विमानपत्तन पर भूमि संचलन सेवाएं प्रदान करने के उद्देश्य से स्थापित कोई कंपनी अभिप्रेत है और उसकी समनुषंगी भी इसके अंतर्गत है ।
(छ) " युक्ति चालन क्षेत्र " से विमानपत्तन , एयरोड्रोम , सिविल एन्क्लेव का वह भाग अभिप्रेत है जो किसी विमानपत्तन पर उड़ान भरने या लैंडिंग करने या टैक्सींग के लिए उपयोग किया जाता है, किंतु एप्रन इसके अंतर्गत नहीं आता है ;
(ज) " संचलन क्षेत्र" से किसी विमानपत्तन या एयरोड्रोम या सिविल एन्कलेव का भाग अभिप्रेत है जो कि युक्ति चालन क्षेत्र और एप्रन सहित वायुयान के सतही संचलन के लिए आशयित है ;
(झ) " राष्ट्रीय वाहक " से नागर विमानन मंत्रालय , भारत सरकार द्वारा राष्ट्रीय वाहक के रूप में अभिहित कोई एयरलाइन है ;
(♂) "अनुसूची" से इन विनियमों से संलग्न सूची अभिप्रेत है ;
(ट) " टर्मिनल भवन" से विमानपत्तन या सिविल एन्क्लेव का वह भवन या क्षेत्र अभिप्रेत है जिसका यात्रियों के चढ़ने या उतरने अथवा जांच प्रक्रिया के लिए प्रयोग किया जाता है ।
3. विमानपत्तन पर भूमि संचलन सेवाएं ( 1) वाहक महानगरीय विमानपत्तनों अर्थात् दिल्ली, मुंबई , चेन्नई , कोलकाता, बैंगलोर और हैदराबाद स्थित विमानपत्तनों पर भूमि संचलन सेवाएं निम्नलिखित में से किसी एक की सेवाएं लेकर क्रियान्वित कर सकेंगे अर्थातः
( i) भारतीय विमानपत्तन प्राधिकरण या इसकी कोई संयुक्त वेंचर कंपनी;

(ii) राष्ट्रीय वाहक अर्थात् भारतीय राष्ट्रीय विमान कंपनी लिमिटेड (नेशनल एविएशन कंपनी ऑफ इंडिया लिमिटेड) की समनुषंगी कंपनियां या भूमि संचलन सेवा में विशेषज्ञता प्राप्त इसकी संयुक्त वेंचर कंपनियांः
परन्तु तृतीय पक्षकार द्वारा संचलन की अनुमति इन समनुपंगी कंपनियों या उनके संयुक्त वेंचरों को प्राधिकरण के साथ राजस्व अंश- भाजन के आधार पर निष्पादन मानक के समाधानप्रद रूप में अनुपालन के अधीन दी जाएगी जैसा प्राधिकरण और इन कंपनियों को परस्पर स्वीकार्य हो ;
(iii) केंद्रीय सरकार द्वारा सुरक्षा क्लीयरेंस तथा निष्पादन मानक के पालन के अध्यधीन रहते हुए राजस्व अंश भाजन के आधार पर प्रतिस्पर्धा बोली के माध्यम से चुने गए कोई अन्य भूमि संचलन सेवा प्रदाता ।
(2) विनियम 3 के उप विनियम ( 1) में वनिर्दिष्ट इकाइयों के अतिरिक्त अन्य सभी विमानपत्तनों पर विदेशी एयरलाइनों को अपवर्जित करते हुए, एयरलाइनों को स्वयं संचलन की अनुमति दी जा सकेगी ।
(3) सभी संबंधित अभिकरणों को यह सुनिश्चित करना होगा कि आधुनिकतम उपकरणों का प्रयोग किया जाता है तथा " सर्वोत्तम प्रथा " अपनायी जाती है ।
(4) इस समय भूमि संचलन में अंतर्ग्रस्त एयरलाइनों और इकाइयों जो इन विनियमों के अंतर्गत नहीं आती है को 01 जनवरी , 2009 से स्वयं संचलन या तृतीय पक्षकार के माध्यम् से संचलन करने की अनुमति नहीं दी जाएगी ।
4. विमानपत्तनों में प्रवेश पर निर्बंधन किसी विमानपत्तन या सिविल एन्क्लेव पर और टर्मिनल भवन या संचलन क्षेत्र में भूमि पर संचलन सेवाएं उपलब्ध कराने या किसी वाहन या अन्य उपकरण के प्रचालन हेतु प्रवेश और ठहरना निम्नानुसार निर्बंधित होगा -
(क) एयरलाइन या वायुयान (वायुयानों) का स्वामी या उसका सद्भाविक पूर्ण कालिक कर्मचारी या विनियम 3 के उप विनियम ( 1 ) में उल्लिखित कोई एजेंसी;
(ख) कोई अन्य वाहक या एजेंसी जो या जिसे प्राधिकरण द्वारा उनके वास्तविक पूर्णकालिक कर्मचारियों के माध्यम से भूमि पर संचलन गतिविधियों के लिए लिखित रूप में विशेष रूप से अनुमति दी गई हों;
(ग) प्राधिकरण या संयुक्त वेंचर कंपनी अथवा इसके द्वारा प्राधिकृत की गई अभिहित एजेंसी के वास्तविक पूर्णकालिक कर्मचारी ।

5. भूमि संचलन के लिए निबंधन और शर्तें प्राधिकरण सुरक्षा, संरक्षा, मांग , उपलब्ध अवसंरचना , भूमि तथा अन्य सुसंगत बातों को ध्यान में रखते हुए प्रत्येक विमानपत्तन पर भूमि संचलन एजेंसी ( वित्तीय और तकनीकी दोनों) तथा नियुक्त की जाने वाली ऐसी एजेंसियों की संख्या के लिए निबंधन और शर्तें ( जिसके अंतर्गत वित्तीय बातें भी हैं) , पात्रता मानदंड अधिकथित करेगा ।
6. नागर विमानन सुरक्षा ब्यूरो की निर्बंधन अधिरोपित करने की शक्ति नागर विमानन सुरक्षा ब्यूरो ऐसे निर्बंधन अधिरोपित कर सकेगा या जो सुरक्षा के आधार पर इस निमित्त आवश्यक हों ।
7 . सुरक्षा अनुदेश मानने की बाध्यता अपेक्षा की जाएगी कि वे नागर विमानन सुरक्षा ब्यूरो द्वारा जारी अनुदेशों जो इन विनियमों के उपबंध ' क' में अंतर्विष्ट हैं या जो समय - समय पर परिवर्तित या प्रतिस्थापित या उपांतरित या संशोधित किए जाएं , का पालन करेंगे । विनियम 3 में विनिर्दिष्ट सभी संबंधित एजेंसियों से
8. अन्य शर्ते - इन विनियमों के प्रावधानों का अनुपालन करने वाली एजेंसियों के अतिरिक्त अन्य सभी संबंधित एजेंसियों से यह अपेक्षा की जाएगी कि वे वायुयान अधिनियम , 1934 तथा उसके अधीन बनाए गए नियमों तथा समय - समय पर जारी निदेशों , आदेशों और परिपत्रों में अंतविष्ट उपबंधों का पालन करेंगे ।

विषयः- विमानपत्तनों पर भूमि संचलन एजेंसियों की तैनाती संबंधी अनुदेश
इस ब्यूरो की जानकारी में यह बात लायी गई है कि देश में विमानपत्तनों पर अनेक भूमि संचलन एजेंसियां पूर्व सुरक्षा क्लीयरेंस और पृष्ठीभूमि- जांच के बिना कार्य कर रही हैं । देश में चल रहे अधिभारित सुरक्षा वातावरण और आतंकवादी इकाइयों से नागर विमानन को होने वाले खतरे को ध्यान में रखते हुए उचित पृष्ठभूमि- जांच , समुचित प्राधिकारी से सुरक्षा क्लीयरेंस तथा भारतीय विमानपत्तन प्राधिकरण /विमानपत्तन प्रचालक द्वारा प्राधिकृत किए बिना विमानपत्तनों पर प्राइवेट भूमि संचलन एजेंसियों के प्रवेश से गंभीर सुरक्षा और कानूनी समस्याएं पैदा हो सकती हैं। अतः , यह निर्णय किया गया है कि विमानपत्तनों पर भूमि संचलन एजेंसियों की तैनाती और प्रवेश से संबंधित निम्नलिखित अनुदेशों को सभी संबंधित एजेंसियों / विभागों द्वारा . कार्यान्वित किया जाएगा ।
(i) विमानपत्तन प्रचालक , वायुयान प्रचालक या किसी अन्य एजेंसी , जिसका विमानपत्तन पर विधि मान्य कृत्य है द्वारा विमानपत्तन पर किसी भूमि संचलन एजेंसी को तब तक कार्य करने की अनुज्ञा नहीं दी जाएगी, जब तक नागर विमानन सुरक्षा ब्यूरो से सुरक्षा क्लीयरेंस प्राप्त नहीं कर ली जाती है ।

ii) भूमि संचलन विनियम, 2000 दिनांक 17.01.2000 के अनुसार भारतीय विमानपत्तन प्राधिकरण /विमानपत्तन प्रचालक, नागर विमानन सुरक्षा ब्यूरो से सुरक्षा क्लीयरेंस के पश्चात् ही ऐसी भूमि संचलन एजेंसियों को विहित निबंधनों और शर्तों पर लाइसेंस जारी कर सकता है तथा भूमि संचलन एजेंसियों के लिए मानदंड तथा प्रत्येक विमानपत्तन पर नियुक्त किए जाने के लिए ऐसी एजेंसियों की संख्या का अवधारण संरक्षा, सुरक्षा, मांग , उपलब्ध अवसंरचना, भूमि और अन्य सुसंगत बातों को ध्यान में रखते हुए किया जाएगा जो कि भारतीय विमानपत्तन प्राधिकरण द्वारा भारतीय विमानपत्तन प्राधिकरण भूमि संचलन विनियम (2000 ) की धारा 5 के अनुसार अधिकथित की जाएं ।

(iii) वायुयान प्रचालक भूमि संचलन एजेंसियों के साथ, इन इकाइयों को नागर विमानन सुरक्षा ब्यूरो से पूर्व सुरक्षा क्लीयरेंस प्राप्त होने तथा भारतीय विमानपत्तन प्राधिकरण/विमानपत्तन प्रचालक से अनुमोदन प्राप्त होने के पश्चात् ही संविदा करेगा ।
( iv) यदि भारतीय विमानपत्तन प्राधिकरण/विमानपत्तन प्रचालक या वायुयान प्रचालक का किसी नई भूमि संचलन एजेंसी को नियुक्त करने का इरादा है तो ऐसी एजेंसी का ब्यौरा उस कंपनी के प्रोफाइल के साथ कम से कम 03 माह पहले नागर विमानन सुरक्षा ब्यूरो को भेजा जाना अपेक्षित है, जिससे कि भूमि संचलन एजेंसी की पृष्ठभूमि की जांच नागर विमानन सुरक्षा ब्यूरो द्वारा अन्वेषण ब्यूरो (आई.बी. ) और स्थानीय पुलिस से करायी जा सके ।
(v) विमानपत्तनों में कार्य करने वाली भूमि संचलन एजेंसियों की बाबत पृष्ठभूमि जांच आवश्यक है । इसलिए भारतीय विमानपत्तन प्राधिकरण / वायुयान प्रचालक ऐसी प्रत्येक भूमि संचलन एजेंसी, जो उनके द्वारा पहले ही भूमि संचलन कृत्यों के लिए लगायी जा चुकी हैं, का ब्यौरा कंपनी की प्रोफाइल तथा निदेशक मंडल एवं प्रबंधन के पते, टेलीफोन नंबरों आदि के साथ भेजें, जिससे कि नागर विमानन सुरक्षा ब्यूरो द्वारा ऐसी एजेंसियों के पूर्ववृत्त का सत्यापन कराने के लिए आवश्यक कार्रवाई की जा सके । यदि किसी कंपनी के बारे में प्रतिकूल सूचना मिलती है तो उसे विमानपत्तन पर कार्य करने के लिए अनुमति प्रदान नहीं की जाएगी तथा उसे विमानपत्तन से हटाया जाएगा ।
(vi ) सुरक्षा संबंधी कृत्यों को जो कि नागर विमानन सुरक्षा ब्यूरो द्वारा राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम में विनिर्दिष्ट हैं तथा समय - समय पर संशोधित किए गए हैं, भारतीय विमानपत्तन प्राधिकरण /विमानपत्तन प्रचालकों और वायुयान प्रचालकों द्वारा भूमि संचलन एजेंसियों को नहीं सौंपा जाएगा ।
(vii ) नागर विमानन सुरक्षा ब्यूरो द्वारा भूमि संचलन एजेंसियों के कर्मचारियों को विमानपत्तन प्रवेश परमिट तब तक जारी नहीं किया जाएगा, जब तक उन्होंने नागर विमानन सुरक्षा ब्यूरो द्वारा विहित विमानन सुरक्षा जागरूकता कार्यक्रम को पूरा नहीं कर लिया हो, उनकी पृष्ठभूमि की जांच पूरी नहीं हो गई हो तथा उनके विरुद्ध कोई प्रतिकूल रिपोर्ट न हो ।

NOTIFICATION

F. No. AAI/ LEGAL/ GHREG/ 2007 .--In exercise of the powers conferred by Section 42 of the Airports Authority of India Act, 1994 (55 of 1994) , and in supersession of the Airports Authority of India ( General Management , Entry for Ground Handling Services ) Regulations, 2000 , except as respects things done or omitted to be done before such supersession, the Airports Authority of India with the previous approval of the Central Government hereby makes the following regulations , namely:
1. Short title , commencement and application . ( 1 ) These regulations may be called the Airports Authority of India (General Management, Entry for Ground Handling Services ) Regulations , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
(3) They shall apply to all airports and civil enclaves managed by the Airports Authority of India:
Provided that they shall not apply to defence installations or enclaves or enclosures at the airports .
2. Definitions . In these regulations , unless the context otherwise requires , -
(a) "Apron" means a defined area of the Airport Enclave intended to accommodate aircraft , for the purpose of loading or unloading of passengers or cargo refueling, parking or maintenance ;
(b) "Authority " means the Airports Authority of India constituted under sub - section (1) of section 3 of the Airports Authority of India Act, 1994 ( 55 of 1994) ;
(c) "Chairperson" means the Chairperson of the Authority appointed under clause ( a ) of sub - section (3) of section 3 ;
(d) " civil enclave " means the area, if any, allotted at an airport , belonging to any armed force of the Union , for use by persons availing of any air transport services from such airport , or for the handling of baggage or cargo by such service , and includes land comprising of any building and structure on such area:

(e) "ground handling" means-
ramp handling including activities as specified in the Schedule I to these regulations;
(ii) traffic handling including activities as specified in the Schedule II to these regulations;
(iii) any other activity designated by the Chairperson to be a part either of ramp handling or traffic handling ;
(f) "Joint Venture Company " means a company established with the objective of providing ground handling services at an airport and includes its subsidiary ;
(g) "maneuvering area " means that part of an airport or an aerodrome or civil enclave to be used for the take off or landing or taxiing of aircraft but does not include apron;
(h) "movernent area" means part of an airport or an aerodrome or civil enclave intended for surface movement of aircraft including the maneuvering area and apron;
"national carriers " means any airline designated as national carrier by the Government of India , Ministry of Civil Aviation; (i)
(j ) " Schedule" means the Schedule annexed to these regulations;
(k) "terminal building " means the building or area of the Airport or Civil Enclave which is used for embarkation or disembarkation or processing of passengers .
3 . Ground handling services at airport . - (1 ) A carrier may carry out ground handling services at metropolitan airports , that is , the airports located at Delhi , Mumbai , Chennai , Kolkata, Bangalore and Hyderabad, by engaging the services of any of the following , namely: -
(i) Airports Authority of India or its Joint Venture Company ;
( ii) subsidiary companies of the national carrier , that is, National Aviation Company of India Limited or its joint ventures specialized in ground handling services:
Provided that third party handling may be permitted to these subsidiaries or their Joint Ventures on the basis of revenue sharing with the Authority subject to satisfactory observance of performance standards as may be mutually acceptable to the Authority and these companies ;

(iii) any other ground handling service provider selected through competitive bidding on revenue sharing basis , subject to security clearance by the Central Government and observance of performance standards.
(2) At all other airports , in addition to the entities specified in sub - regulation (1) of regulation 3 , self handling may be permitted to the airlines , excluding foreign airlines.
(3) All concerned agencies shall ensure that the state- of- the - art equipment are used and ' best practices ' are followed .
(4) Airlines or entities presently involved in ground handling which are not governed by these regulations shall not be permitted to undertake self- handling or third party handling with effect from the first day of January , 2009 .
4. Restrictions on entry into airports . Entry into and remaining in the movement area or terminal building and at any airport and civil enclave for providing ground handling services or for operating any vehicle or other equipment shall be restricted to -
(a) the airline or owner of aircraft or his bonafide whole time employee or any of the agencies referred to in sub - regulation ( 1 ) of regulation 3;
(b) any other carrier or agency who or which has been specially permitted in writing by the Authority to undertake ground handling activities through their bonafide whole time employees;
(c) the bonafide whole time employees of the Authority or Joint Venture Company or the designated agency authorised by it .
5. Terms and conditions for ground handling . The Authority shall lay down terms and conditions (including financial consideration) , eligibility criteria for ground handling agency (both financial and technical ) and number of such agencies to be appointed at each airport keeping in view the safety security , demand, available infrastructure , land and other relevant consideration .
6. Power of the Bureau of Civil Aviation Security to impose restrictions . - Bureau of Civil Aviation Security may impose such restrictions as may be necessary in this behalf on grounds of security .
7. Obligation to follow the security instructions . All concerned agencies , as specified in regulation 3 , shall be required to follow the instructions issued by the Bureau of Civil Aviation Security as contained in Annexure ' A' to these 13

regulations or as may be altered or substituted or modified or amended from time to time.
8. Other conditions . - All concerned agencies besides complying with the provisions of these regulations shall also be required to follow the provisions contained in the Aircraft Act, 1934 and rules made thereunder and directions , orders and circulars issued from time to time .

Subject: - Instructions on deployment of ground handling agencies at theairports .
It has been brought to the notice of this Bureau that there are number of ground handling agencies working at the airports in the country and background checks . In view of the without prior security clearance current surcharged security environment in the country and threat to civil aviation from terrorist outfits , induction of private ground handling agencies into the airports without proper background checks, security clearance from the appropriate authority and authorization by the AAl / Airport Operator , may lead to serious security and legal problems . It has , therefore , been decided that the following instructions relating to deployment and induction of shall be implemented by all ground handling agencies at the airports concerned agencies / departments .
(i ) No ground handling agency shall be allowed to work at the airport in future by the Airport Operator , Aircraft Operator or any other agency which has legitimate functions at the airport , unless prior security clearance is obtained from the BCAS .
(ii) Asper the Ground Handling Regulations 2000 dated 17.1.2000 , the AAI / Airport Operator may issue a license only after security clearance from the BCAS to such ground handling agencies on prescribed terms and conditions and eligibility criteria for ground handling agencies and the number of such agencies to be appointed at each airport shall be determined keeping in view the safety , security , demand , available infrastructure , land and other relevant considerations to be laid down by the AAl in accordance with the Section 5 of the AAI Ground Handling Regulations (2000) .

(iii) Aircraft operator shall enter into contract with the ground handling agencies only after prior security clearance to these entities from the BCAS and approval from the AAI / Airport Operator .
(iv) In case AAl / Airport Operator or Aircraft Operator intend to appoint a new ground handling agency , the details of such agency are required to be sent to BCAS alongwith the profile of such company at least 3 months in advance so that the background check of the ground handling agency can be done by the BCAS through IB and local police .
(v) Background check in respect of the ground handling agencies working in the airports is necessary. Therefore AAI / Aircraft Operator shall send the details of the each existing ground handling company, already engaged by them for ground handling functions alongwith the company profile and address , telephone numbers etc of Board of directors and management so that the necessary action could be taken by the BCAS to get the antecedents verified of such agencies . In case any company comes to adverse notice , the same shall not be allowed to work at the airport and shall be liable to be removed from the airport .
(vi ) Security related functions as specified by the BCAS in the National Civil Aviation Security Programme and amended from time to time shall not be entrusted to the ground handling agencies by the AAI / Airport and Aircraft Operators .
(vii) Airport Entry Permits to employees of the ground handling agencies shall not be issued by the BCAS unless they have completed the BCAS prescribed Aviation Security Awareness programme , their background check has been completed and there is no adverse report againstthem.
