का.आ. 1792(अ).-कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 5 के अधीन गठित रजिस्ट्रीकरण समिति ने देश में नाशकजीवमारों के सतत् उपयोग या इससे अन्यथा का पुनर्विलोकन करने के लिए एक विशेषज्ञ समूह गठित किया था;
और केन्द्रीय सरकार का उक्त विशेषज्ञ समूह की सिफारिशों पर विचार करने के पश्चात् और उक्त अधिनियम के अधीन गठित रजिस्ट्रीकरण समिति से परामर्श करने के पश्चात् यह समाधान हो गया है कि डोज़ोमेट का उपयोग मनुष्य और पर्यावरण के स्वास्थ्य के लिए परिसंकटमय है;
वह प्रारूप आदेश , जो केन्द्रीय सरकार बनाने का प्रस्ताव करती है , ऐसे सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है जिनके उससे प्रभावित होने की संभावना है , और यह सूचना दी जाती है कि उक्त प्रारूप आदेश पर उस तारीख से , जिसको उस आदेश वाले भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं , पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
उक्त प्रारूप देश के संबंध में, कोई सुझाव या आक्षेप करने का इच्छुक कोई व्यक्ति इस प्रकार विनिर्दिष्ट अवधि के भीतर उन्हें केन्द्रीय सरकार द्वारा विचार किए जाने के लिए संयुक्त सचिव ( वनस्पति संरक्षण ) , कृषि मंत्रालय , कृषि और सहकारिता विभाग , कृषि भवन , नई दिल्ली-110001 को भेज सकेगा ।
अतः अब केन्द्रीय सरकार , कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 28 के साथ पठित धारा 27 की उप - धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करने का प्रस्ताव करती है, अर्थात्:---
प्रारूप आदेश
1. संक्षिप्त नाम. इस आदेश का नाम डोजोमेट के उपयोग पर निर्बंधन आदेश , 2007 है ।
2. ( 1 ) कोई व्यक्ति चाय में डोजोमेट का उपयोग नहीं करेगा ।
(2) रजिस्ट्रीकरण प्रमाणपत्र के सभी धारक, लेबलों और पत्रकों पर स्पष्ट.अक्षरों में " चाय में उपयोग के लिए प्रतिबंधित " चेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करेंगे ।
( 3 ) यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है , छह मास की अवधि के भीतर खंड ( 2 ) में निर्दिष्ट रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण प्रमाणपत्र नवीकृत नहीं किया जाएगा या उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।

3. प्रत्येक राज्य सरकार उक्त अधिनियम और उसके अधीन बनाए गए नियमों के उपबंधों के अधीन सभी ऐसे उपाय करेगी , जो राज्य में इस आदेश के निष्पादन के लिए वह आवश्यक समझे ।

NOTIFICATION
New Delhi , the 23rd October , 2007
S.O. 1792(E) . Whereas , the Registration Committee constituted under Section 5 of the Insecticides Act , 1968 ( 46 of 1968) had constituted an Expert Group to review the continued use or otherwise of pesticides in the country;
And whereas the Central Government , after considering the recommendations of the said Expert Group and after consultation with the Registration Committee set up under the said Act is satisfied that the use of Dazomet involves health hazards to human beings and environment ;
The Draft Order , which the Central Government proposes to make , is hereby published for information of all persons likely to be affected thereby ; and notice is hereby given that the said Draft Order shall be taken into consideration after the expiry of a period of forty - five days from the date on which the copies of the Gazette of India containing the Order are made available to the public;
Any person desirous of making any suggestion or objection in respect of the said Draft Order may forward the same for consideration of the Central Government within the period so specified to the Joint Secretary (Plant Protection) , Ministry ofAgriculture , Department of Agriculture and Cooperation , Krishi Bhavan, New Delhi , 110001 .
Now, therefore, in exercise of the powers conferred by sub - section (2) of Section 27 read with Section 28 of the Insecticides Act , 1968 (46 of 1968 ) , the Central Government hereby proposes to make the following Order , namely :-
DRAFT ORDER
1. Short title . This Order may be called the Restriction on Use of Dazomet Order , 2007 .
2. ( 1 ) No person shall use Dazomet in tea .
(2) All the holders of certificate of registration shall return the certificates of registration to the Registration Committee for incorporation of the warning in bold letters "BANNED FOR USE IN TEA " on labels and leaflets .
(3 ) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2) , within a period of six months , the certificate of registration granted to them shall not be renewed or action shall be taken under Section 14 of the said Act .
3. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this Order in the State .

अतः अब केन्द्रीय सरकार , कीटनाशी अधिनियम, 1968 ( 1968 का 46 ) की धारा 28 के साथ पठित धारा 27 की उप - धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करने का प्रस्ताव करती है , अर्थात्:--
प्रारूप आदेश
1. संक्षिप्त नाम. इस आदेश का संक्षिप्त नाम क्लोरोफेनविनफोस का प्रतिबंध आदेश , 2007 है ।
2. ( 1 ) कोई व्यक्ति क्लोरोफेनविनफोस का विनिर्माण , आयात और उपयोग नहीं करेगा ।
(2) रजिस्ट्रीकरण समिति, सभी रजिस्ट्रीकृत व्यक्तियों से , जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं, क्लोरोफेनविनफोस के लिए अनुदत्त रजिस्ट्रीकरण प्रमाणपत्रों को वापस ले लेगी ।
(3 ) यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है , खंड ( 2 ) में निर्दिष्ट रजिस्ट्रीकरण समिति को 6 मास की अवधि के भीतर प्रमाणपत्र वापस करने में असफल रहता है तो उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।
3. प्रत्येक राज्य सरकार , उक्त अधिनियम और उसके अधीन बनाए गए नियमों के उपबंधों के अधीन सभी ऐसे उपाय करेगी , जो राज्य में इस आदेश के निष्पादन के लिए वह आवश्यक समझे ।

2. ( 1 ) No person shall manufacture , import and use Chlorofenvinphos .
(2) The Registration Committee shall call back the certificates of registration granted for Chlorofenvinphos from all registrants including new registrants.
(3) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2) , within a period of six months , action shall be taken under Section 14 of the saidAct .
3. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State.
