का.आ. 1821 (अ).-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक और अनुच्छेद 148 के खण्ड ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय लेखा परीक्षा विभाग में सेवारत व्यक्तियों के संबंध में , भारत के नियंत्रक महालेखा परीक्षक से परामर्श के पश्चात् तथा अधिसूचना संख्यांक का.आ. 1487 ( अ) , तारीख 14 अक्तूबर , 2005 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , केन्द्रीय सिविल सेवा ( पेंशन ) नियम , 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय सिविल सेवा ( पेंशन ) ( संशोधन ) नियम , 2007 है ।
(2 ) ये 30 सितम्बर , 2000 से अर्थात् उस तारीख से प्रवृत्त हुए समझे जाएंगे जिसको यथानुपात पेंशन का उपबंध वापस लिया गया था ।
2. केन्द्रीय सिविल सेवा ( पेंशन ) नियम , 1972 के नियम 37क के उप- नियम ( 8 ) के स्थान पर निम्नलिखित उप - नियम रखा जाएगा , अर्थात्:-
" (8 ) ऐसा स्थायी सेवक , जो पब्लिक सेक्टर उपक्रम या स्वायत्त निकाय के कर्मचारी के रूप में आमेलित किया गया है , उसके यथास्थिति, पब्लिक सेक्टर उपक्रम या स्वायत्त निकाय से सेवानिवृत्त होने के समय यथाप्रवृत्त इन नियमों के अधीन पेंशन/कुटुम्ब पेंशन की संगणना करने के सूत्र के अनुसार उसके द्वारा सरकार में और पब्लिक सेक्टर उपक्रम या स्वायत्त निकाय में की गई संयुक्त सेवा के आधार पर पेंशन संबंधी फायदों या अपने विकल्प पर केन्द्रीय सरकार द्वारा जारी किए आदेशों के अनुसार केन्द्रीय सरकार के अधीन की गई सेवा के लिए यथानुपात सेवानिवृत्ति प्रसुविधाएं प्राप्त करने के लिए पात्र होगा।
स्पष्टीकरण: - पब्लिक सेक्टर उपक्रम /स्वायत्त निकाय से सेवानिवृत्ति पर आमेलित कर्मचारी की पेंशन/ कुटुम्ब पेंशन की राशि की संगणना , उसी दिन सेवानिवृत्त होने वाले केन्द्रीय सरकार के किसी कर्मचारी की दशा के समान ही की जाएगी । "

स्पष्टीकारक ज्ञापन
ऐसे सरकारी कर्मचारियों को , जो पेंशन और पेंशनभोगी कल्याण विभाग के कार्यालय ज्ञापन सं . 4/ 18 / 87- पी एंड पीडब्ल्यू ( डी) , तारीख 5-7-1989 के अधीन सरकारी विभाग में संपरिवर्तन के परिणामस्वरूप गठित पब्लिक सैक्टर उपक्रम या स्वायत्त निकायों में स्थानांतरित और आमेलित किए गए थे , उपलब्ध यथानुपात मासिक पेंशन लेने के विकल्प को अधिसूचना सं. का. आ. 904 ( अ ) , तारीख 30-9-2000 द्वारा 30-9-2000 से वापस ले लिया गया था । उसी उपबंध को अधिसूचना सं. का. आ. 1487( अ ) , तारीख 14-10-2005 द्वारा 14-10-2005 से प्रत्यावर्तित किया गया था । वही उपबंध इस अधिसूचना द्वारा 30-9-2000 से प्रत्यावर्तित हो चुके हैं। यह सत्यापित किया जाता है कि इस अधिसूचना को भूतलक्षी प्रभाव देने से किसी व्यक्ति पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

NOTIFICATION
New Delhi , the 25th October , 2007
S.O. 1821 (E) . In exercise of the powers conferred by the proviso to article 309 and clause (5) of Article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the IndianAudit and Accounts Department and in supersession of the notification number S.O. 1487 (E) dated 14th October, 2005 except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules further to amend the Central Civil Services (Pension ) Rules , 1972 , namely: -
1. ( 1) These rules may be called the Central Civil Services (Pension ) ( Amendment ) Rules , 2007.
(2) They shall be deemed to have come into force from the 30th day of September , 2000 i.e. date from which provision of pro - rata pension was withdrawn .
2. In the Central Civil Services ( Pension) Rules , 1972, in rule 37A, for sub -rule ( 8 ) , the following sub - rule shallbe substituted , namely :-
"(8) Apermanent Government servant who has been absorbed as an employee of a public sector undertaking or autonomous body shall be eligible for pensionary benefits on the basis of combined service rendered by him in the Government and in the public sector undertaking or autonomous body in accordance with the formula for calculation of pension/family pension under these rules as may be in force at the time of his retirement fromthe public sector undertaking or autonomous body , as the case may be or at his option , to 3

receive pro - rata retirement benefits for the service rendered under the Central Government in accordance with the orders issued by the Central Government.
EXPLANATION -The amount of pension/family pension of the absorbed employee on superannuation from Public Sector Undertaking/Autonomous Body shall be calculated in the same way as would be the case with a Central Government servant, retiring on superannuation, on the same day . "

EXPLANATORY MEMORANDUM
Optionto draw pro - rata monthly pension available to the Government servants who were transferred and absorbed in Public Sector Undertakings or Autonomous Bodies set up consequent upon conversion of a Government Department under Department of Pension and Pensioner's Welfare's O.M. No. 4/ 18/87 - P & PW (D) dated 5-7-1989 was withdrawn w.e.f. 30-9-2000 vide Notification No.S.O. 904(E) dated 30-9-2000 . The same provision was restored through Notification No.S.O. 1487 (E ) dated 14.10.2005 w..e.f. 14-10-2005 . The same provision has been restored through this notification w..e.f. 30-9-2000 . This is certified that no one shall be adversely affected by giving retrospective effect to this notification.
