का.आ. 1846(अ ) चूंकि, केन्द्र सरकार को मैसर्स ऑयल इंडिया लिमिटेड, ( श्लमबर्गर एशिया सर्विसेज लि. के लिए ) पी. ओ. दुलियाजन जिला डिब्रूगढ़ , ( असम) -786602 से, तेल खोज प्रयोजन के लिए संयुक्त राज्य अमेरिका से इवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है ;
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज 'प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप -नियम (2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , क्योंकि उक्त नियम के उपबंधों के अनुसार यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
और, चूंकि, नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत शक्तियों का प्रयोग करते हुए , अपने परमिट सं 143-डीजी/2007 , दिनांक 9 जुलाई , 2007 द्वारा जो कि 31 दिसम्बर , 2007 तक वैध है , इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मैसर्स ऑयल इंडिया लिमिटेड, डिब्रूगढ़ , ( असम ) को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।
अतः , अब , विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , 4374 GI/2007
केन्द्रसरकार, एतद्वारा मैसर्स ऑयल इंडिया लिमिटेड, डिब्रूगढ़ ( असम) को मैसर्स श्लमबर्गर रिजरवॉयर कम्प्लीशन्स, 14910 , एयरलाईन रोड, रोशरॉन , टैक्सास , 77583 , संयुक्त राज्य अमेरिका से कोलकाता हवाई अड्डे पर निम्नलिखित विस्फोटक सामग्री , जिनकी मदें व मात्राएं नीचे तालिका में दी गई हैं, के आयात के लिए उक्त नियमावली के नियम 31 के उप - नियम ( 2 ) के उपबंधों के अनुपालन से छूट देती है, नामतः :-

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः:-
Schlumberger Asia Services Limited) , P.O. Duliajan , District Dibrugarh (Assam) -786 602 to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from United States of America for oil exploration purposes ;
( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों , का पालन किया जाएगा;
And, whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and , therefore , necessary exemption may be granted from the purview of sub -rule (2) of rule 31 of the Explosives Rules, 1983 (hereinafter referred to as the said rules ) which prohibits import or export of explosives specified herein by air;
(2 ) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के ( 37वें संस्करण ) की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा ;
(3) [ नियम 31 के उप - नियम ( 2 ) के अलावा ] उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जाएगा;
And, whereas , the Director General of Civil Aviation has , in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937 , granted necessary permission with certain conditions to the M/ s . Oil India Limited Dibrugarh (Assam) to carry such explosives by air vide their permit number 143 - DG/2007 dated the the 09 July , 2007 which is valid upto 31st December , 2007;
(4 ) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को , वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
Now, therefore , in exercise of the powers conferred by Sub - section (2) of Section 14 of the Explosives Act , 1884 (4 of 1884), the Central Government hereby exempts M/ s . Oil India Limited , Dibrugarh (Assam ) , from the provisions of sub - rule (2) of rule 31 of the said rules , for import of the following explosives , the items and quantities ofwhich are specified in the Table below, by air from M/ s . Schlumberger Reservoir Completions , 14910, Airline Road , Roshraron, Texas , 77583 , United States of America , at Calcutta airport , namely :-

(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्दवाहन उक्त स्थान से रवाना नहीं हो जाता;

(7) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

2. The explosives mentioned in the Table shall be imported subjectto the following conditions , namely :

(1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be compliedwith;
(ii) explosives conforming only to Division 1.4 of the Division relatingto Class - I Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , (37th Edition) which became effective on 1st January , 1996 shall be imported;
(iii) the relevant provisions relating to the possession , transport , use and import of explosives, [ except sub - rule (2) of rule 31 ] of the said rules shall be strictly complied with;
(iv) requisite number of explosives vans , licensed under the said rules, shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of CivilAviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site ;
(vi) smoking or use of naked light shall not be permitted within the cordoned area ; and
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and localtraffic rules and municipal regulations, if any, shall be complied with during the transportation of the explosives .
