का.आ. 1845( अ ).- चूंकि, केन्द्र सरकार को मैसर्स ऑयल इंडिया लिमिटेड , ( श्लमबर्गर एशिया सर्विस लि. के लिए ) पी. ओ. दुलियाजन , जिला डिब्रूगढ़ , ( असम ) -786 602 से तेल खोज प्रयोजन के लिए फ्रांस से इवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;
और, चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकोंके प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्तनियमावली कहा गया है) के नियम 31 के उप- नियम (2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है, क्योंकि उक्त नियम के उपबंधों के अनुसार यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है ;
और , चूंकि, नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 142-डीजी/2007 , दिनांक 9 जुलाई , 2007 और 8/4/2007 - आई. आर. दिनांक 30 जुलाई , 2007 द्वारा जो कि 31 दिसम्बर , 2007 तक वैध है , इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मैसर्स ऑयल इंडिया लिमिटेड, डिब्रूगढ़ , (असम) को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।
अतः , अब, विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार, एतद्वारा मैसर्स ऑयल इंडिया लिमिटेड, डिब्रूगढ़, ( असम) को मै . इट्यूड्स इट प्रोडक्शन्स श्लमबर्गर , 1 ट्यू हेनरी बेक्यूरल ,

बी. पी. 202 , 92142 , क्लेमार्ट सीडेक्स , फ्रांस से कोलकाता हवाई अड्डे पर निम्नलिखित विस्फोटक सामग्री , जिनकी मदें व मात्राएं नीचे तालिका में दी गई हैं , के आयात के लिए उक्त नियमावली के नियम 31 के उप-नियम ( 2 ) के उपबंधों के अनुपालन से छूट देती है , नामतः:-

2. उक्तसारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः:
(1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जाएगा;
(2) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के ( 37वें संस्करण ) की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकोंसे संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;
(3) [नियम 31 के उप - नियम ( 2 ) के अलावा ] उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित. सुसंगत उपबंधों का शक्ति से पालन किया जाएगा;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी

जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
M/s . Oil India Limited, Dibrugarh (Assam) from the provisions ofSub - rule (2) of rule 31 of the said rules , for import ofthe following explosives , the items and quantities of which are specified in the Table below, by air from M/s . Etudes et Productions Schlumberger, 1 Rue Henri Becequerel , B.P. 202, 92142 Clamart Cedex, France to Kolkata Airport , namely:-

(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम सें कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(6 ) बिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा
2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely :-
(1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;
( 7 ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

(2) explosives conforming only to Division 1.4 of the Division relating to Class - I Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , ( 37th Edition) which became effective on 1st January, 1996 shall be imported;

(3) the relevant provisions relating to the possession, transport, use and import of explosives , [ except sub - rule (2) of rule 31 of the said rules are strictly compliedwith:
S.O. 1845 (E) .-Whereas , the Central Government has
(4) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing :
received a proposal madeby M/ s . Oil India Limited ( for Schlumberger Asia Services Limited) P.O. Duliajan , Dist . Dibrugarh (Assam)-786 602, to the Petroleum and Exposives Safety Organisation for permission to import certain explosives by air from France for oil exploration purposes :
And, whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shallbe used for oil exploration purposes and , therefore , exemption from the provisions of Sub - rule (2) ofrule 31 ofthe Explosives Rules , 1983 ( hereinafter referred to as the said rules ) is necessary as the provisions of that Sub- rule prohibit import or export of explosives specified herein by air;
(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(6) smoking or use of naked light shall not be permitted within the cordoned area ; and And, whereas , the Director General of Civil Aviation has, in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937 , granted necessary permission with certain conditions to M/ s . Oil India Limited. Dibrugarh (Assam) to carry such explosives by air vide their permit number 142- DG / 2007 dated the 9th July , 2007 and 8-4-2007 - IR dated 30th July, 2007 which is valid upto 31st December , 2007;
(7) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules andmunicipal regulations, if any, shall be complied with during the transportation of the explosives .
[No. 2(46)/2007 -Expl. ] Now, therefore, in exercise of the powers conferred by Sub - section (2) of Section 14 of the Explosives Act, 1884 (4 of 1884) , the Central Government hereby exempts
