सा.का.नि. 686( अ ). केन्द्रीय सरकार , नोटरी अधिनियम , 1952 ( 1952 का 53 ) की धारा 15 द्वारा प्रदत शक्तियों का प्रयोग करते हुए , नोटेरी नियम , 1956 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम नोटेरी ( चौथा संशोधन ) नियम , 2007 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. नोटेरी नियम , 1956 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) में , नियम 8 क के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा , अर्थात्: -
" 8ख. व्यवसाय के प्रमाणपत्र का नवीकरण-नियम 8 के उप - नियम ( 4 ) के अधीन जारी किए गए व्यवसाय के प्रमाण-पत्र का, विहित फीस के संदाय पर पांच वर्ष की और अवधि के लिए नवीकरण किया जा सकेगा । व्यवसाय के प्रमाण- पत्र के नवीकरण के लिए कोई आवेदन समुचित सरकार को उसकी विधिमान्यता की अवधि के अवसान की तारीख से तीन मास पूर्व प्रस्तुत किया जाएगा :
परंतु समुचित सरकार , आवेदन में कथित कारणों पर विचार करने के पश्चात् उपर्युक्त विनिर्दिष्ट अवधि से पूर्व व्यवसाय के प्रमाण- पत्र के नवीकरण के लिए आवेदन को प्रस्तुत करने की शर्त को शिथिल कर सकेगी । " ।
3. उक्त नियम की अनुसूची में , स्तम्भ ( 1 ) में, -
( i ) " चंडीगढ़" से संबंधित क्रम संख्यांक 35 के सामने स्तम्भ ( 2 ) में, " 38 " अंक के स्थान पर " 57 " अंक रखा जाएगा ।
( ii ) " केरल और कर्नाटक " से संबंधित क्रम संख्यांक 5 और 9 के सामने स्तम्भ ( 3 ) में, " 563 और 675 " अंकों और शब्द के स्थान पर क्रमशः " 845 और 1013 " अंक और शब्द रखे जाएंगे ।

NOTIFICATION
New Delhi , the 31st October , 2007
GS.R. 686(E) . In exercise of the powers conferred by Section 15 of the Notaries Act, 1952 (53 of 1952), the Central Government hereby makes the following rules further to amend the Notaries Rules , 1956, namely:-
1. (1) These Rules may be called the Notaries (Fourth Amendment) Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Notaries Rules , 1956 (hereinafter referred to as the said rules) , after rule 8A, the following rules shall be inserted, namely :-
"8B. Renewal of Certificate of Practice. The certificate of practice issued under sub - rule (4) of rule 8 may be renewed for a further period of five years on payment of prescribed fee . An application for renewal of Certificate ofPractice shall be submitted to the appropriate Government before three months from the date of expiry of its period ofvalidity: Provided that the appropriate Government may , after considering the reasons stated in the application, relax the condition of submission of application for renewal of certificate of practice before the above specified period ." .
3. In the Schedule to the said rules , in column (1),-
(1) against serial number 35 relating to ' Chandigarh' , in column (2) , for the figure "38 " , the figure " 57 " shall be substituted .
(1) against serial number 5 and 9 relating to 'Kerala and Karnataka' , in column (3), for the figures " 563 and 675 " , the figures "845 and 1013 " shall respectively be substituted.
