NOTIFICATION
New Delhi , the 31st October , 2007 No. 45 (RE- 2007) 2004-2009
S.O. 1857 (E) . In exercise of the powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act , 1992 (No. 22 of 1992) read with Para 1.3 and Para 2.1 of the Foreign Trade Policy , 2004-2009, the Central Government hereby makes the following further addition with immediate effect at the end of Paragraph 2 of NotificationNo. 38 (RE-2007)/2004-2009, dated 15th October , 2007 (pertaining to prohibition on export of non -basmati rice) as amended :
नई दिल्ली, 31 अक्तूबर , 2007 सं. 45( आरई 2007 ) /2004-2009 का.आ. 1857( अ ).-विदेश व्यापार नीति , 2004-2009 के पैरा 1.3 एवं 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 ( 1992 की संख्या 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , यथा-संशोधित अधिसूचना संख्या 38 ( आर ई -2007 )/2004-2009 दिनांक 15 अक्तूबर , 2007 (गैर -बासमती चावल के निर्यात पर निषेध से संबंधित ) के पैराग्राफ 2 के अन्त में तत्काल प्रभाव से एतद्द्वारा , निम्नलिखित परिवर्धन करती है:-
" 2.3 इसके अलावा , यदि न्यूनतम निर्यात मूल्य ( एम ई पी ) 425 अमेरिकी डालर प्रति टन पोत पर्यन्त निःशुल्क मूल्य से अधिक है तो इस अधिसूचना द्वारा लगाया गया निषेध गैर - बासमती चावल के निर्यात पर लागू नहीं होगा ।
2.3.1 उपरोक्त एम ई पी निम्नलिखित पर भी लागू नहीं होगा:-
(क ) गैर- बासमती चावल का निर्यात जिसके लिए साखपत्र 9-10-2007 तक खुला रखा गया है; और
(ख ) पत्तन प्राधिकरणों द्वारा यथा- प्रमाणित, 10-10-2007 तक निर्यात के लिए पत्तन गोदामों में लाया गया चावल । "
2. इसे लोकहित में जारी किया जाता है ।

"2.3 Further , the prohibition imposed by this Notification shall not be applicable to the export of non-basmati rice if the Minimum Export Price (MEP) is more than US $ 425 per ton FOB .
2.3.1 The above MEP shall also not be applicable to:-
!
(a) Exports ofnon- basmati rice for which letter of credit has been opened till 09-10-2007; and
(b) Rice brought into the port godowns for export till 10-10-2007, as certified by port authorities ."
2. This issues in public interest.
