बीमा विनियामक और विकास प्राधिकरण ( बीमा दलाल ) ( संशोधन ) विनियम , 2007
फा. सं. बी. वि. वि. प्रा./विनियम/ 4/ 41 /2007.-- प्राधिकरण , बीमा अधिनियम, 1938 ( 1938 का 4 ) की धारा42 और 114 ए द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बीमा सलाहकार समिति के परामर्श से बीमा विनियामक और विकास प्राधिकरण (बीमा दलाल ) विनियम 2002 का संशोधन करने के लिए निम्न लिखित विनियम बनाता है , अर्थात्: -
1 . (1 ) इन विनियमों का संक्षिप्त नाम बीमा विनियामक और विकास प्राधिकरण ( बीमा दलाल ) (विनियम , 2007 है ।
(2)ये प्रकाशन की दिनांक से प्रवृत्त होंगें ।

बीमा विनियामक और विकास प्राधिकरण प्राधिकरण ( बीमा दलाल) विनियम, 2002 में
1. विनियमन 18 के उपविनियमन ( 1 ) का स्थानापन्न से होगा।
( 1 ) सभी आवेदनकत्र्ता अनुज्ञप्ति पत्र का आवेदन करते समय अनुसूची II में विनिर्दिष्ट अनुसार शुल्क अदा करेगें ।
2. विनियमन 18 में उपविनियमन ( 1 ) के बाद निम्नलिखित का अंतर्वेश किया गया है ।
विनिर्दिष्ट किया
( 1अ) सभी बीमा दलाल वार्षिक शुल्क अदा इस प्रकार तथा इस अवधि के लिए अदा करेगें जैसा कि अनुसूची II मे गया है । वार्षिक शुल्क के अतिरिक्त, सभी बीमा दलाल अनुज्ञप्ति पत्र के नवीकरण के लिए आवेदन करते सम्मय ऐसा नवीकरण शुल्क तथ इस प्रकार देगें जैसा कि अनुसूची II में दिया गया है ।
3.. विनियमन 18 के उपविनियमन ( 2 ) शब्द " सह विनियमन ( 1 ) " को " सह विनियमन ( 1)अ) " से प्रतिस्थापित किया जायेगा।

4 नई अनुसूची II के लिए प्रतिस्थापन :
पूर्ववर्ती अनुसूची II के लिए अलिखित अनुसूर्य 11 का प्रतिस्थापन होगा .

शुल्क
1(अ) सभी बीमा दलाल अनुज्ञप्ति पत्र के लिए आवेदन करते समय गैर थन वापसी शुल्क, निन्नानुसार अदा करगें

2. सभी बीमा दलाल वार्षिक शुल्क निम्नानुसार अदा करेगे।

पछले वित्तिय वर्ष में उपार्जित किये गये मेहनताने के 0.50 प्रतिशत की गणना कि जायेगी जो न्यूनत्तम रूपये 25,000/- तथा अधिकत्तम रूप्ये 1,00,000/- हेन।
पछले अत्तिय वर्ष में उपार्जित किये गये मेहनताने के 0.50 प्रतिशत
को गणना कि जायेगी जो न्यूनतम रूपये 75,000/- तथा
अधिकत्तम रूपये 3,00,000/ - होगा।
संयुक्त दलाल
पछले वित्तिय वर्ष में उपार्जित किये गये मेहनताने के 0.50 प्रतिशत
को गणना कि जायेगी जो न्यूनत्तम रूपये 125,000/- तथा
अधिकारम रुपये 5,00,000/- होगा ।
पिछले वित्तिय वर्ष में उपजित किये गये महान के 10.50 प्रतिशत की जायेगी जे न्यूनलन रूपये 25,000/ तथा अधिकतम अभय 1,00,000 / - होग
१. अनुशति शुल्क का भुगतान बीमा दलाल के अभिलेखापरीक्षका अंतिम रूप देने की समाप्ति के 15 दिनों के भीतर अथवा 30 सितंबर तक जो भी पहले हो को करना होग
4. सभी बीमा दलाल नवीकरण शुल्क रुपये 1000 मात्र एक हजार रूपये का भुगतान नवीकरण आवेदन पत्र के साथ करेगें । 5. शुल्क का भुगतान खाते में देय ड्राफ्ट द्वारा नियामक और विकास प्राधिकरण" के पक्ष में हैदराबाद में देय होगा ।

Insurance Regulatory and Development Authority ( Insurance Brokers) ( Amendment) Regulations, 2007
F. No. IRDA/ Reg/4/41 /2007.-In exercise of the powers conferred by section 42 and section 114A of the Insurance Act, 1938 ( 4 of 1938) , the Authority , in consultation with the Insurance Advisory Committee , hereby makes the following regulations to amend the Insurance Regulatory and Development Authority ( Insurance Brokers ) Regulations , 2002 , namely: -
1. (1) These regulations may be called the Insurance Regulatory and Development Authority (Insurance Brokers ) ( Amendment ) Regulations , 2007 ..
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Insurance Regulatory and Development Authority (Insurance Brokers ) Regulations , 2002-
1. Sub - regulation ( 1 ) of Regulation 18 shall be substituted by -
(1) Every applicant shall at the time of making an application for grant of licence pay such fees and in such manner as specified in Schedule II .
2. In Regulation 18 after Sub Regulation ( 1 ) the following shall be inserted:
(1A) Every insurance broker shall pay the annual fees in such manner and within such a period as specified in Schedule II . In addition to the annual fees , every broker shall at the time of making an application for renewal of license pay such renewal fees and in such manner as specified in Schedule II .
3. In sub - regulation ( 2 ) of Regulation 18 the words " sub - regulation ( 1 ) " shall be substituted by thewords " sub- regulation ( 1A) " .
4. Substitution of new schedule for schedule II :
Forexisting Schedule II , the following schedule II shall be substituted namely: -

FEES
1 (a) Every insurance broker shall at the time of application for license , pay a non- refundable application fees as set out below:

2. Every insurance broker shall pay annual licence fees as set out below:

Asum calculated at the rate of 0.50 per cent of remuneration earned in the preceding financial year subject to minimum of Rs.25,000 and maximum of Rs . 1,00,000 .
Reinsurance broker
A sum calculated at the rate of 0.50 per cent of remuneration earned in the preceding financial year subject to minimum of Rs.75,000 and maximum of Rs.3,00,000 .
A sum calculated at the rate of 0.50 per cent of remuneration earned in the preceding financial year subject to minimum of Rs.1,25,000 and maximum of Rs.5,00,000 .

3. The licencefee shall be paid before the expiry of 15 days from the finalization of annual audited accounts of the broker or till the 30th of September whichever is earlier .
4. Every Broker shall pay a renewal fee of Rs . 1000/- ( Rupees one thousand only) along with application for renewal of the licence .
5. The fees shall be payable by an Account Payee draft in favour of " The Insurance Regulatory and Development Authority " payable at Hyderabad . "
