फा. सं. 01/94/180/पीएन/एचबीपी/एएम -08 / पीसी-1. विदेश व्यापार नीति, 2004-2009 के पैराग्राफ 2.4 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , महानिदेशक , विदेश व्यापार , प्रक्रिया पुस्तक ( खण्ड-1 ) में, एतद्वारा , निम्नलिखित संशोधन करते हैं :--
1. " पोत-लदान बिलों और/ अथवा बैंक वसूली प्रमाण- पत्र की खो गयी ईपी प्रति के मद्दे मामलों पर विचार " से सम्बंधित एक नया पैराग्राफ 4.30क को पैराग्राफ 4.30 के बाद निम्नानुसार जोड़ा जायेगाः
4.30क जिन मामलों में पोत- लदान बिल की मूल ईपी प्रति/मूल बीआरसी खो गयी है , ईओडीसी हेतु आवेदन , अग्रिम प्राधिकार पत्र/बीएफआईए स्कीम के तहत किसी बैंक गारंटी/विधिक बचनबद्धता शर्त पर विचार नहीं किया जाएगा बशर्ते कि उन मूल दस्तावेजों के बदले निम्नलिखित दस्तावेज प्रस्तुत किए जाए :
क. सीमाशुल्क प्राधिकारी/बैंक द्वारा जारी संबंधित दस्तावेज के मूल के बदले डुप्लीकेट/प्रमाणित प्रति।
ख. बचायी गई शुल्क की राशि के 1 प्रतिशत के बराबर आवेदन शुल्क । तथापि , सरकारी एजेंसियों द्वारा ऐसे दस्तावेज के खो जाने और इस बारे में दस्तावेजी प्रमाण प्रस्तुत करने पर कोई शुल्क नहीं लगाया जाएगा ।
ग. दस्तावेज के खो जाने और बाद में मिलने पर

उसे संबंधित क्षेत्रीय प्राधिकारी को तुरंत सौंपने की बचनबद्धता का शपथ- पत्र ।
घ. खो गए पोत- लदान बिलों/बीआरसी के लिए प्राप्त/अनुमत शुल्क मुक्त आयात हकदारी के मद्दे सरकार को किसी वित्तीय हानि , यदि हुई है तो, क्षतिपूर्ति करने के लिए निर्यातक इस आशय काएक क्षतिपूर्ति बंधपत्र प्रस्तुत करेगा । सीमा शुल्क प्राधिकारी , बैंक गारंटी/विधिक वचनबद्धता के पृष्ठांकन के बिना अथवा हस्तांतरणीयता के पृष्ठांकन के बाद बैंक गारंटी/विधिक वचनबद्धता कीविमुक्तिया निकासी की अनुमति से पहले यह सुनिश्चित करेगा कि ऐसे पोत - लदान बिल के मद्दे कोई दोहरा लाभ प्राप्त नहीं किया गया है ।
तथापि, मूल पोत लदान बिल के बदले पुनःनिर्मित पोत- लदान बिल प्रस्तुत करने के मामले में, उपरोक्त ख. , ग . और घ. की शर्ते लागू नहीं होंगी ।
2. सार्वजनिक सूचना संख्या-79 दिनांक2-1-2006 में क्रम संख्या 1 ( v ) में आने वाले शब्द ' मॉडवैट ' को संशोधित करके मॉडवैट/सेनवेट पढा जाएगा ।
3. पैराग्राफ 5.18.6 के बाद एक नया पैराग्राफ 5.18.7 निम्नानुसार पढा जाएगा :-
5.18.7 ईपीसीजी प्राधिकार पत्रों हेतु पूर्वोक्त प्रावधान 1-4-2007 को अथवा उसके बाद जारी प्राधिकार पत्रों के लिए लागू होंगे । तथापि, 1-4-2007 से पहले जारी ईपीसीजी प्राधिकार पत्र प्रक्रिया पुस्तक , खण्ड-1 ( आरई -2006 ) के अध्याय -5 में निहित प्रावधानों द्वारा शासित होंगे ।

F. No. 01/ 94 / 180 / PN /HBP/ AM - 08/PC- 1. -In exercise ofpowers conferred under Paragraph 2.4 of the Foreign Trade Policy , 2004-2009, the Director General of Foreign Trade hereby makes the following amendment in Handbook of Procedures (Vol-1) :
1. A new paragraph 4.30A related to " consideration of cases against lost EP copy of the Shipping Bills and /or Bank Realisation Certificate " shall be added after the paragraph 4.30 as follows :-
4.30A. In case where Original EP copy of Shipping Bill/ original BRC has been lost , request for EODC , No BG / LUT condition under Advance Authorisation/DFIA scheme or endorsement of transferability under DFIA scheme can be considered subject to submission of following documents in lieu of those original documents :
(a) A duplicate / certified copy of concerned document issued by Customs Authority /Bank in lieu of original;
(b) An application fce equivalent to 1% of duty saved amount . However, no fee shall be charged when such document is lost by Government agencies and a documentary proof to this effect is submitted;

(c) An affidavit by exporter orter about loss ofdocument and an undertaking to surrender it immediately to concerned RA, if found subsequently;
(d) An indemnity bond by exporter to the effect that he would indemnify Government for financial loss , ifany, on account of duty free import entitlement availed/ allowed against lostShipping Bills/BRC . Customs Authority , before allowing redemption of BG/ LUT or clearance after endorsement of No BG /LUT condition or endorsement of transferability, shall ensure that no double benefit against such shipping bill has been availed . However , in case of submission of reconstructed copy of shipping bill in lieu of original shipping bill, conditions at (b), (c) and (d) above shall not be applicable .
2. The word MODVAT appearing at Sl . No. 1 (v) in PN No. 79 dated 2.1.06 shall be amendedto read as MODVAT/ CENVAT.
3. A new paragraph 5.18.7 shall be added after paragraph 5.18.6 to read as follows :
5.18.7 -The aforesaid provisions for Clubbing of EPCG Authorisations shall be applicable for authorisations issued on or after 1-4-2007. However , EPCG authorisations issued prior to 1-4-2007 , shall be governed by provisions contained in Chapter 5 ofHBP, Vol - 1 (RE - 2006). This issues in Public interest .
