केन्द्र सरकार , एतद्वारा मै. हैलीबर्टन ऑफशोर सर्विसेज़ इंक, मुम्बई (महाराष्ट्र) को मै. मिडवेस्ट फ्राइट एण्ड ट्रांपोर्टेशन पीटीई लि. , 8 चांन्गी स्ट्रीट 1 , नंबर 02-01 , सिंगापुर-498829 से मुम्बई हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप- नियम ( 2) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है , नामतः :-

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः:-
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप-नियम (2) के दायरे से आवश्यक छूट प्रदान की जा सकती है , क्योंकि उक्त नियम के उपबंधों के अनुसार यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
(1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जाएगा;
और, चूंकि, नागर विमानन महानिदेशक ने वायुयान नियमावली , 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 162-डीजी/2007 , दिनांक 3 अगस्त, 2007 द्वारा जो कि 31 जनवरी , 2008 तक वैध है , इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मै. हैलीबर्टन ऑफशोर सर्विसेज इंक , मुम्बई ( महाराष्ट्र) को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।
(2) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के (37वें संस्करण ) की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकोंसे संबंधित प्रभाग के प्रभाग 1.4 के अतः , अब, विस्फोटक अधिनियम, 1884 ( 1884 का 4) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ,

ही अनुरूप विस्फोटकों का आयात किया जाएगा;
prohibits import or export of explosives specified herein by air;
(3 ) [ नियम 31 के उप- नियम ( 2 ) के अलावा ] उक्त नियमों में यथा निहित विस्फोटकों के कब्जे , परिवहन , * प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जाएगा;
And, whereas , the Director General of Civil Aviation has in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937, granted necessary permission with certain conditions to M/s . Halliburton Offshore Services Inc , Mumbai ( Maharashtra ) to carry such explosives by air vide their permit number 162 -DG/2007 dated the the 3rd August, 2007 which is valid upto 31st January, 2008;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को , वायुयान के उतरते ही शीघ्रता से हटाया जा सके;
Now, therefore , in exercise of the powers conferred by Sub - section (2) of Section 14 of the Explosives Act. 1884 ( 4 of 1884) , the Central Government hereby exempts M/s. Halliburton Offshore Services Inc. Mumbai (Maharashtra) from the provisions of sub - rule (2) of rule 31 of the said rules , for import of the following explosives , the items and quantities of which are specified in the Table below, by air from M/ s . Midwest Freight and Transporta- tion Pte Ltd. , 8 Changi Street 1 , #02-01 , Singapore - 498829 atMumbai airport, namely :----

(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely :-
(7.) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त 'नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be compliedwith:

(ii) explosives conforming only to Division 1.4 of the Division relating to Class - 1 Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations . (37th Edition ) which became effective on 1st January, 1996 shall be imported;
(iii) the relevant provisions relating to the possession, transport , use and import of explosives , [ except sub - rule (2 ) of rule 31 of the said rules shall be strictly complied with:
S.O. 1897 (E) . Whereas , the Central Government has received a proposal made by M/s . Halliburton Offshore Services Inc , Sanghi Oxygen Compound, Mahakali Caves Road, Andheri (East ) , Mumbai -400093 ( Maharashtra ) to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from Siingapore for oil exploration purposes ;
(iv) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
aircraft shall be parked at a remote place at the airport and an area of at least five hundred (V)
And , whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and, therefore, necessary exemption may be granted from the purview of sub - rule (2) of rule 31 of the Explosives Rules , 1983 ( hereinafter referred to as the said rules ) which 3

square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of CivilAviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi) smoking or use of naked light shall not be permitted within the cordoned area ; and (vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and localtraffic rules and municipal regulations , if any, shall be complied with during the transportation of the explosives .
