आदेश
नई दिल्ली , 12 नवम्बर , 2007
का.आ. 1908(अ). केन्द्रीय सरकार, भारतीय मानक ब्यूरो अधिनियम , 1986 ( 1986 का 63 ) की धारा 14 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय मानक ब्यूरो से परामर्श करने के पश्चात् निम्नलिखित आदेश करती है; अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इस आदेश का संक्षिप्त नाम इस्पात और इस्पात उत्पाद ( गुणता नियंत्रण ) आदेश , 2007 है ।
(2) ये राजपत्र में प्रकाशन की तारीख से छह महीने की अवधि के पश्चात् लागू होगा ।
2. परिभाषाएं इस आदेश में , जब तक अन्यथा अपेक्षित न हो :
( क ) " अधिनियम " से भारतीय मानक ब्यूरो अधिनियम , 1986 ( 1986 का 63 ) अभिप्रेत है;
( ख ) " उपयुक्त प्राधिकारी " से कोई ऐसा अधिकारी अभिप्रेत है जिसका स्तर भारत सरकार के अवर सचिव के स्तर से कम न हो या भारतीय मानक ब्यूरो में वैज्ञानिक ग ( उप निदेशक ) के स्तर से कम न हो या इस आदेश के उपबंधों को कार्यान्वित करने के लिए राजपत्र में प्रकाशित अधिसूचना द्वारा केन्द्रीय सरकार द्वारा नियुक्त किए गए राज्य सरकार के जिला उद्योग केन्द्र के महानिदेशक के स्तर से कम न हो;
( ग ) "ब्यूरो " से भारतीय मानक ब्यूरो अभिप्रेत है;
( घ ) " व्यवहारी " से इस्पात और इस्पात उत्पादों के संबंध में कोई व्यक्ति, या कोई फर्म या हिन्दू अविभक्त कुटुम्ब अभिप्रेत है जो प्रत्यक्ष रूप से अथवा अन्यथा ऐसे ढांचागत इस्पात खंडों , जस्तेदार इस्पात चद्दों , उच्च शक्ति विरुपित इस्पात सरिया और तार , प्री स्टैस्ट कंक्रीट के लिए इस्पात की तारों और गुंफ , इलेक्ट्रिकल स्टील चादर और पट्टी दाब वेसल्स के लिए स्टील चादर, इलेक्ट्रोलिटिक टिन की प्लेट नकद में अथवा आस्थगित भुगतान के लिए या कमीशन , पारिश्रमिक अथवा अन्य मूल्यवान प्रतिफल के क्रय , विक्रय , प्रदाय या वितरण का कारबार करता हो ।
( ङ ) "विनिर्माता " से इस्पात और इस्पात उत्पादों के संबंध में कोई व्यक्ति, या कोई फर्म या हिन्दू अविभक्त कुटुम्ब अभिप्रेत है जो ऐसे ढांचागत इस्पात खंडों , जस्तेदार इस्पात चद्दरों , उच्च शक्ति विरुपित इस्पात सरिया और तार, प्री स्टैस्ट कंक्रीट के लिए इस्पात की तारों और गुंफ , इलेक्ट्रिकल स्टील चादर और पट्टी दाब वेसल्स के लिए स्टील चादर का उत्पादन , निर्माण , एकत्रण अथवा विनिर्माण करता है तथा जिसके अंतर्गत ऐसा व्यक्ति या फर्म या हिन्दू अविभक्त कुटुम्ब भी है जो ऐसे व्यक्ति अथवा फर्म अथवा हिन्दू अविभक्त कुटुम्ब , जैसा भी मामला हो , द्वारा ऐसे ढांचागत इस्पात खंडों , जस्तेदार इस्पात चद्दरों , 4586 GI/ 2007

उच्च शक्ति विरूपित इस्पात सरियों और तारों , प्री स्टैस्ट कंक्रीट के लिए इस्पात की तारों और लड़ों, इलेक्ट्रिकल स्टील चद्दरों और स्ट्रिप्स, दाब वेसल्स के लिए स्टील प्लेट्स, इलेक्ट्रोलिटिक टिन प्लेट के उत्पादन, निर्माण, समंजन अथवा विनिर्माण किए जाने का दावा करता हो ।
(च) "अनुसूची " से इस आदेश में संलग्न अनुसूची अभिप्रेत है;
(छ) "विनिर्दिष्ट मानक " से इस्पात और इस्पात उत्पादों के संबंध में अनुसूची के स्तंभ ( 1 ) में स्थानी प्रविष्टि में यथाविनिर्दिग्न मानक अभिप्रेत है;

(ज) "राज्य सरकार " से संघ राज्य क्षेत्र के संबंध में उसका प्रशासक अभिप्रेत है;
(झ) "इस्पात और इस्पात उत्पादन " से अनुसूची के कालम ( 2 ) विनिर्दिष्ट मदें अभिप्रेत है;
(ञ) जिन शब्दों और पदों के, जो इसमें प्रयुक्त हैं , और परिभाषित नहीं है किन्तु अधिनियम में परिभाषित हैं उनके अर्थ वही होंगे जो अधिनियम में हैं ।
3. विनिर्माण, भण्डारण , बिक्री और वितरण आदि के बारे में निषेध: ( 1 ) कोई व्यक्ति स्वयं अथवा अपनी ओर से किसी व्यक्ति के जरिए अनुसूची में दिए गए किसी ऐसे इस्पात और इस्पात उत्पाद का विनिर्माण अथवा विक्रय के लिए भण्डारण , बिक्री अथवा वितरण नहीं करेगा जो विनिर्दिष्ट मानकों के अनुरूप न हो और जिस पर प्रमाणन चिह्न अनुज्ञप्ति प्राप्त करने के बाद ब्यूरो का मानक चिह्न न लगा हो ।
परन्तु निर्यात के लिए अपेक्षित ऐसे इस्पात अथवा इस्पात उत्पादों के निर्यात के संबंध में इस आदेश की कोई भी बात लागू नहीं होगी जो विदेशी खरीदारों द्वारा अपेक्षित किसी विनिर्देशन के अनुरूप हो और ऐसे विनिर्देशन किसी भी हालत में विनिर्दिष्ट मानक से कम नहीं होंगे ।
( 2 ) अवमानक अथवा दोषपूर्ण इस्पात और इस्पात उत्पादों, जो विनिर्दिष्ट मानक के अनुरूप न हो . को विनिर्माता द्वारा 1.5 मीटर से कम लम्बाई के टुकड़ों में काटकर विरूपित किया जाएगा और तीन महीने के भीतर स्क्रैप के रूप में निपटाया जाएगा ।
4. प्रमाणन के लिए बाध्यता ( 1 ) इस्पात और इस्पात उत्पादों के सभी विनिर्माता इस आदेश के जारी होने की तारीख से पैंतालीस दिन के भीतर मानक चिह्न के प्रयोग के लिए अनुज्ञप्ति प्राप्त करने के लिए, यदि पहले प्राप्त न कर लिया हो, भारतीय मानक ब्यूरो को आवेदन प्रस्तुत करेंगे ।
(2 ) भारतीय मानक ब्यूरो द्वारा मानक चिह्न के प्रयोग के लिए अनुज्ञप्ति की मंजूरी अधिनियम और उसके अधीन बनाए गए नियमों और विनियमों के उपबंधों के अनुसार दी जाएगी ।
( 3 ) जब कोई व्यक्ति स्वयं अथवा अपनी ओर से किसी व्यक्ति के द्वारा अनुसूची के स्तंभ ( 2 ) में विनिर्दिष्ट इस्पात और इस्पात उत्पादों के विनिर्माण का प्रस्ताव करता है तो वह मानक चिह्न के प्रयोग के लिए ब्यूरो से विधिमान्य अनुज्ञप्ति प्राप्त करने के बाद ही नियमित उत्पादन प्रारंभ करेगा।
(4 ) किसी लाइसेंस की अवधि समाप्त होने अथवा ब्यूरो द्वारा अनुसूची के स्तंभ ( 2 ) में अभिवादित एक अथवा अधिक इस्पात और इस्पात उत्पादों के लिए उसको रद्द कर दिए जाने पर ब्यूरो उसकी सूचना उपयुक्त प्राधिकारी को देगा ।
5. सूचना आदि मंगाने की शक्तिः उपयुक्त प्राधिकारी इस आदेश का अनुपालन सुनिश्चित करने की दृष्टि से - 3

(क ) किसी इस्पात और इस्पात उत्पादों के विनिर्माण , बिक्री के लिए भण्डारण , बिक्री अथवा वितरण में लगे किसी व्यक्ति को ऐसी सूचना देने के लिए बुला सकता है जिसको वह इस आदेश के कार्यान्वयन के लिए किसी इस्पात और इस्पात उत्पाद के विनिर्माण , बिक्री के लिए भण्डारण, बिक्री अथवा वितरण के संबंध में आवश्यक समझे या किसी ऐसे इस्पात और इस्पात उत्पाद के नमूने प्रस्तुत करने के लिए किसी व्यक्ति की अपेक्षा कर सकता है ।
(ख ) किसी इस्पात और इस्पात उत्पाद के विनिर्माण , बिक्री के लिए भण्डारण , बिक्री अथवा वितरण में लगे किसी व्यक्ति द्वारा रखे गए अथवा उससे संबंधित या उसके कब्जे में अथवा नियंत्रण में बहियों अथवा अन्य दस्तावेजों और अन्य इस्पात और इस्पात उत्पादों का निरीक्षण कर सकता है अथवा करवा सकता है ।
6. नमूनों का परीक्षण : मानक चिह्न लगे और उपयुक्त प्राधिकारी द्वारा विनिर्दिष्ट मानक की अनुरूपता सुनिश्चित करने हेतु लिए गए किसी इस्पात और इस्पात उत्त्पाद के नमूने का ब्यूरो द्वारा अनुमोदित जो प्रयोगशाला में ऐसी रीति से परीक्षण किया जाएगा, ब्यूरो द्वारा अवधारित किया जाए ।
7. विनिर्माताओं और व्यवहारियों अथवा विक्रेताओं को निदेश जारी करने की शक्ति उपयुक्त प्राधिकारी विनिर्माताओं और व्यवहारियों अथवा विक्रेताओं को ऐसे निदेश जारी कर सकेगा जो अधिनियम अथवा इस आदेश के अनुरूप हों और इस आदेश के प्रयोजन के लिए आवश्यक हों ।
8. निर्देशों का अनुपालन अनुसूची में दिए गए किसी इस्पात अथवा इस्पात उत्पाद के विनिर्माण , बिक्री के लिए भण्डारण, बिक्री अथवा वितरण में लगे प्रत्येक व्यक्ति, जिसको इस आदेश के तहत कोई निर्देश जारी किया गया हो , ऐसे निर्देश का अनुपालन करेगा ।
9. सूचना देने की अनिवार्यता कोई भी विनिर्माता अथवा व्यवहारी इस आदेश के उपबंधों की अवहेलना करने के आशय से खण्ड 5 के अधीन उससे विधिपूर्वक मांगी गई किसी सूचना को देने से इंकार नहीं करेगा अथवा अपने अधिष्ठान अथवा नियंत्रण में रखे किसी बही अथवा दस्तावेज या किसी इस्पात और इस्पात उत्पाद को नहीं छुपाएगा , नष्ट नहीं करेगा , उसमें विकृत अथवा उसके स्वरूप को विरूपित नहीं करेगा ।

ORDER
New Delhi , the 12th November , 2007
S.O. 1908(E) . In exercise of the powers conferred by section 14 of the Bureau of Indian Standards Act, 1986 (63 of 1986 ) , the Central Government after consulting the Bureau of Indian Standards hereby makes the following Order, namely:-
1. Short title and commencement .- (1 ) ThisOrder may be called the Steel and Steel Products ( Quality Control ) Order , 2007.
(2) This Order shall come into force after a period of six months from the date of its publication in the Official Gazette.
2. Definitions.- In this Order , unless the context otherwise requires ,
(a) "Act" means the Bureau of Indian Standards Act , 1986 ( 63 of 1986) ;
(b) "Appropriate Authority " means any officer not below the rank of an Under Secretary to the Government of India or an officer not below the rank of Scientist C ( Deputy Director) in the Bureau of Indian Standards or an officer not below the rank of a General Manager , District Industries Centre of a State Government as may be appointed by the Central Government by a notification published in the Official Gazette to implement the provisions of this Order;
(c) "Bureau " means the Bureau of Indian Standards;

(d ) " dealer " , in relation to Steel and Steel Products , means a person who , or a firm or a Hindu undivided family which , carries on , directly or otherwise , the business of buying , selling , supplying or distributing any such Structural Steel Sections , Galvanized steel sheets , High Strength deformed steel bars and wires , Steel wires and strands for pre- stressed [PART II-Str. 3 ( ))

concrete, Electrical steel sheets and strips , Steel plates for pressure vessels , Electrolytic tinplate whether in cash or for deferred payment or for commission , remuneration or other valuable consideration ;
(e) "manufacturer " , in relation to Steel and Steel Products , means a person who or a firm or a Hindu undivided family which produces , makes , assembles or manufactures any such structural steel sections, galvanized steel sheets , high strength deformed steel bars and wires , steel wires and strands for pre- stressed concrete , electrical steel sheets and strips , steel plates for pressure vessels , electrolytic tinplate and includes a person who , or a firm or Hindu undivided family which claims such structural steel sections , galvanized steel sheets , high strength deformed steel bars and wires , steel wires and strands for pre - stressed concrete, electrical steel sheets and strips , steel plates for pressure vessels , electrolytic tinplate to be produced , made , assembled or manufactured by such person or firm or Hindu undivided family, as the casemay be;
(f) " Schedule " means the Schedule annexed to this Order;
(g) " Specified Standard " in relation to steel and steel products means the standard as specified in the corresponding entry in column ( 1 ) of the Schedule .
(h) "State Government " in relation to a Union territory , means the Administrator thereof;
(i) "steel and steel products " mean the items specified in column (2) of the Schedule;
(j ) Words and expressions used herein and not defined but defined in the Actshall have the meanings respectively assigned to them in the Act,
3. Prohibition regarding manufacture , storage , sale and distribution etc..-(1) No person shall by himself or through any person on his behalf manufacture or store for sale , sell or distribute any steel and steel products given in the Schedule , which do not conform to the specified standards and do not bear standard mark of the Bureau on obtaining certification marks licence:
Provided that nothing in this Order shall apply in relation to export of steel and steel products required for export , which conform to any specification required by the foreign buyer and such specification shall not in any case be less than the specified standard .
(2) Thesub -standard or defective steel and steel products , which do not conform to the specified standard shall be deformed by the manufacturer by cutting into lengths less than 1.5 meters and disposed ofas scrap within three months .

4. Obligation for certification.- ( 1 ) All manufacturers of steel and steel products shall make an application to the Bureau for obtaining licence for use of the standard mark , within forty - five days of the issue of this Order, ifnot already obtained .
(2) The grant of licence by the Bureau for use of the standard mark shall be as per the provisions of the Act and rules and regulations made there under.
(3) Whenany person by himself or through any person on his behalf proposes to manufacture steel and steel products specified in column (2) ofthe Schedule shall commence regular production only after obtaining a valid licence from Bureau for the use of standard mark .
(4) Consequent to the expiry of any licence or cancellation thereof by the Bureau for one or more of the steel and steel products mentioned in column (2) of the Schedule , the Bureau shall inform the same to the Appropriate Authority .
5. Power to call for information , etc.- The Appropriate Authority may, with a view to securing compliance with this Order-
(a) require any person engaged in the manufacture , storage for sale, sale or distribution of any steel and steel products to give such information as he deems necessary relating to the manufacture , storage for sale , sale or distribution of any steel and steel products for the implementation of this Order or require any such person to furnish to him samples of any such steel and steel products.
(b) inspect or cause to be inspected any books or other documents and other steel and steel products kept by or belonging to or in the possession or under the control of any person engaged in the manufacture, storage for sale , sale or distribution of any steel and steel products .
6. Testing of samples . Samples of any steel and steel products bearing the standard mark and drawn by the Appropriate Authority , for ascertaining whether they are of the specified standard , shall be tested in the laboratory approved by the Bureau and in the manner as may be determined by the Bureau.
7. Power to issue direction to manufactures and dealers or sellers.- TheAppropriate Authority may issue such directions to manufacturers and dealers or sellers , consistent with the provisions of the Act or this Order , as may be necessary for carrying out the purposes of this Order .
8. Compliance of directions.- Every person engaged in the manufacture, storage for sale , sale or distribution of any steel and steel products given in the Schedule to whom any direction is issued under this Order, shall comply with such direction .

9. Obligation to furnish information . No manufacturer or dealer shall with intent to evade the provisions of this Order , refuse to give any information lawfully demanded from him under clause 5 or conceal , destroy , mutilate or deface any books or documents or any steel and steel products kept by, or in the possession or control of, such person.
