सा.का.नि. 704( अ ) -केन्द्रीय सरकार ने पर्यावरण ( संरक्षण ) नियम , 1986 में और संशोधन करके , संलग्नक पृष्ठ से 1.0 मीटर तक 75 डेसीबल ( ए ) पर अधिकतम अनुज्ञेय ध्वनि दबाव स्तर सुनिश्चित करने के लिए विनिर्माण प्रक्रम पर ध्वनिक संलग्नक उपलब्ध कराने के लिए 1 जनवरी , 2005 को या उसके पश्चात् विनिर्मित डीजल से चलने वाले जेनरेटर सेटों के लिए शोर सीमाएं निर्धारित की हैं;
और इस मंत्रालय को विभिन्न विनिर्मिताओं और उनके संगम से लघु सेक्टर में डीजल जेनरेटर सेटों के संयोजनकर्ताओं द्वारा सामना की जा रही विभिन्न परेशानियों , अर्थात् विनिर्मिताओं और डी जी सेटों की परिवहन की परिभाषा को ध्यान में रखते हुए कतिपय संशोधनों के लिए निवेदन करते हुए , अभ्यावेदन प्राप्त हुए हैं;
और निम्नलिखित प्रारूप नियमों को जिसे केन्द्रीय सरकार पर्यावरण संरक्षण अधिनियम , 1986 ( 1986 का 29 ) की धारा 25 और धारा 3 की उप - धारा ( 2 ) के खंड ( iii ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पर्यावरण ( संरक्षण ) नियम , 1986 में संशोधन जारी करने का प्रस्ताव करती है , उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है जिनके उससे प्रभावित होने की संभावना है । यह सूचना दी जाती है कि केन्द्रीय सरकार द्वारा उक्त नियम प्रारूप पर उस तारीख से जिसको इस अधिसूचना वाले राजपत्र की प्रतियां जन- साधारण को उपलब्ध कराई जाती हैं, साठ दिन की अवधि की समाप्ति पर या उसके पश्चात् विचार किया जाएगा ।
कोई भी व्यक्ति जो प्रस्तावित प्रारूप अधिसूचना पर आक्षेप करने अथवा सुझाव देने का इच्छुक हो , वह उक्त साठ दिन की अवधि के भीतर सचिव , पर्यावरण और वन मंत्रालय , पर्यावरण भवन सी.जी.ओ. कॉम्पलेक्स , लोधी रोड , नई दिल्ली -110003 को लिखित रूप में सम्बोधित कर सकता है ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम पर्यावरण ( संरक्षण ) संशोधन नियम , 2007 है ।
(2 ) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पर्यावरण ( संरक्षण ) नियम, 1986 की अनुसूची-1' में,--
(क) ' डीजल से चलने वाले जेनरेटर सेटों के लिए शोर सीमा ' से संबंधित क्रम सं. 94 के पैरा 3.2 में , " प्रत्येक विनिर्माता या आयातक" शब्दों के स्थान पर " प्रत्येक विनिर्माता या संयोजनकर्ता या आयातक या प्रदायकर्ता " शब्द रखे जाएंगे ।
(ख ) पैरा 4.0 के पश्चात् निम्नलिखित पैरा अन्तःस्थापित किया जाएगा , अर्थात्:-

" 5.0 डीजल जेनरेटर सेटों ( 250 के वी ए से अधिक ) का परिवहन
( i ) डीजल जेनरेटर सेट का परिवहन पैरा 3.2 में विनिर्दिष्ट डीजल जेनरेटर सेट को ध्वनिक संलग्नक अथवा पृथक किए गए पुर्जों सहित , फिर ध्वनिक संलग्नक पर विनिर्दिष्ट सुसंगत जेन सेट संख्या और इसके प्रचालन स्थल पर कल पुर्जों को फिर से जोड़ने के लिए साइलेंसर सहित पूर्ण इकाई के रूप में प्रमाणीकरण की अपेक्षा को पूरा करने के पश्चात् ही किया जाए ।
( ii ) शोर संबंधी मानदंडों के अनुपालन की निगरानी निम्नलिखित चरणों में की जाएगी-
(क ) प्रारंभ में विनिर्माण के प्रक्रम पर केन्द्रीय प्रदूषण नियंत्रण बोर्ड द्वारा , और
( ख ) तत्पश्चात् यथास्थिति संबंधित राज्य प्रदूषण नियंत्रण बोर्ड या संघ राज्य क्षेत्र की प्रदूषण नियंत्रण समिति द्वारा प्रतिष्ठापन के अवस्थान पर डी जी सेट का संयोजन करने के पश्चात्" ।

NOTIFICATION
New Delhi , the 12th November , 2007
G.S.R. 704(E ) .-Whereas the Central Government has fixed noise limits for generator sets run with diesel manufactured on or after the 1st January . 2005 to provide acoustic enclosure at manufacturing stage to ensure maximum permissible sound pressure level at 75 dB (A) at 1.0 metre from the enclosure surface , by making further amendments in the Environment (Protection ) Rules , 1986 ;
And Whereas this Ministry has received representations from various Manufacturers and their Association requesting for certain amendments in view of the various difficulties faced by the assemblers of DG sets in small scale sector i.e. definition of manufacturer and the transportation of DG sets ;
And Whereas the following draft rules , which the Central Government proposes to issue in exercise of the powers conferred by clause ( iii ) of sub- section ( 2 ) of Section 3 and Section 25 of the Environment (Protection ) Act , 1986 (29 of 1986) further to amend the Environment (Protection ) Rules , 1986, is hereby published for the information of all persons likely to be affected thereby: and notice is hereby given that the said draft rules will be taken into consideration by the Central Government on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;
Any person desirous of fillng objection or suggestion on the proposed draft notification may do so in writing addressed to the Secretary, Ministry of Environment and Forests , Paryavaran Bhawan , CGO Complex , Lodi Road , New Delhi - 110003 within the said period of sixtydays .

DRAFT RULES
1. ( 1 ) These rules may be called the Environment (Protection) Amendment Rules , 2007 .
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Environment ( Protection) Rules , 1986 , in Schedule 1 ,-
(a) In serial number 94 relating to ' NOISE LIMIT FOR GENERATOR SETS RUN WITH DIESEL' , in paragraph 3.2, for the words "Every manufacturer or importer" , the words "Every manufacturer or assembler or importer or supplier " shall be substituted;
(b) after paragraph 4.0, the following paragraph shall be inserted , namely :-
"5.0 Transportaion of Diesel Generator Sets (Above 250 KVA)
(i ) Diesel Generator set shall be transported after fulfilling the requirement of certification specified in paragraph 3.2 as a complete unit with acoustic enclosure , or dismantled , with relevant genset number specified on acoustic enclosure and silencer for reassembling at the site of its operation .
(ii) Compliance with the noise norms shall be monitored-
(a) initially at the manufacturing stage by the Central Pollution Control Board ; and
(b) subsequently after assembling the DG set at the location of the installation by the concerned State Pollution Control Board or , as the case may be , the Union territory Pollution Control Committee ." .
