नई दिल्ली , 12 नवम्बर, 2007 का.आ. 1935(अ).-केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय ( सड़क पक्ष ) की अधिसूचना सं. का. आ. 660 (अ ) , तारीख 27 सितम्बर, 1996 के द्वारा राष्ट्रीय राजमार्ग सं. 8 के 36.63 कि.मी. से 162.50 कि.मी. भूखंड ( हरियाणा और राजस्थान राज्यों में गुड़गांव - कोटपुतली खंड ) को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था;
अतः , केंद्रीय सरकार अब, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन और स्थायी पुल- लोक वित्तपोषित परियोजनाओं के उपयोग के लिए फीस) नियम , 1997 के नियम 3 , 5 और 11 और राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के नियम 3 के उप नियम ( 2 ) के साथ पठित , राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की तारीख 31 मार्च, 2003 की अधिसूचना सं . का.आ. 361 ( अ) का उन बातों के सिवाय अधिक्रमण करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है , या करने का लोप किया गया है , यह अधिसूचित करती है कि हरियाणा और राजस्थान राज्यों में राष्ट्रीय राजमार्ग संख्या 8 के 42.00 किमी. से 162.500 किमी. (गुड़गांव- कोटपुतली खंड) तक के चार लेन वाले भूखंड के उपयोग के लिए यांत्रिक यानों पर फीस भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभागीय रूप से अथवा प्रतिस्पर्धात्मक निविदा के आधार पर नियुक्त किए जाने वाले प्राइवेट ठेकेदारों के माध्यम से इससे संलग्न अनुसूची में विनिर्दिष्ट दरों पर शाश्वत आधार पर उदगृहीत और संगृहीत की जाएगी ।

: 1. फीस संग्रहण का कार्य इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीस दिन के भीतर प्रारंभ किया जाएगा ।
:
2. जब एक ही यांत्रिक यान को राष्ट्रीय राजमार्ग के उक्त भूखंड को एक दिन में एक से अधिक बार पार करना हो , तो प्रयोक्ता को पहले ही चक्कर में गेट को पार करते समय अनुसूची में विनिर्दिष्ट दरों पर , अनेक चक्करों के लिए एक ही बार रकम का संदाय करने का विकल्प होगा या यदि उसी यांत्रिक यान को उक्त चार लेन वाले भूखंड का संपूर्ण मास में निरंतर और बार - बार प्रयोग करना हो तो यान का स्वामी उपर्युक्त अनुसूची में यथाविनिर्दिष्ट उस पर लागू 30 एकल दर के समतुल्य प्रभारों का संदाय करके मासिक पास ले सकता है ।
स्पष्टीकरण इस अधिसूचना के प्रयोजन के लिए ' दिन ' को चौबीस घंटों की निरंतर अवधि माना जाएगा !
3. अनुसूची में विनिर्दिष्ट फीस से निम्न प्रकार के यान छूट प्राप्त हैं, अर्थात्: -
यान;-
(
अ ) जो यान ' अति विशिष्ट व्यक्ति' प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित से संबंधित हैं : -
(क) भारत के राष्ट्रपति;
(ख) भारत के उपराष्ट्रपति;
(ग) राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल ;
(घ) भारत के शासकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;

(ड.) ' सी डी' / ' सी सी' नंबर प्लेटों वाली कारों का प्रयोग कर रहे भारत में रह रहे विदेशी राजनयिक
(च) राज्य सभा के सभापति अथवा लोक सभा के अध्यक्ष अथवा राज्य विधान परिषद के सभापति अथवा राज्य विधान सभा के अध्यक्ष अथवा संघ अथवा राज्य के मंत्री अथवा लोक सभा अथवा राज्य सभा अथवा राज्य विधान मंडल में विपक्ष के नेता जिनकी प्रास्थिति कैबिनेट मंत्री की हो, जब वे यान में हों; अथवा
(छ) संपूर्ण देश में संसद सदस्य अथवा संबंधित राज्य में राज्य की विधान सभा अथवा विधान परिषद के सदस्य, यदि वे यथा स्थिति , संसद अथवा संबंधित राज्य के विधान मंडल द्वारा जारी किए गए पहचान पत्र प्रस्तुत करते हैं ।
(ब) शौर्य पुरस्कारों जैसे परमवीर चक्र , अशोक चक्र, महावीर चक्र , कीर्ति चक्र, वीर चक्र और शौर्य चक्र जैसे वीरता पुरस्कार पाने वाले व्यक्तियों के यान यदि ऐसे पुरस्कार धारक ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है ।
( ii ) रक्षा यान जिसमें भारतीय पथकर (सेना और वायु सेना) अधिनियम , 1901 ( 1901 का 2 ) के उपबंधों और इसके अधीन बने नियमों ( नौसेना के लिए भी) के अनुसार छूट के लिए पात्र वे सभी यान शामिल हैं ।
( iii) पुलिस यान , अग्नि शमन यान , एंबुलेंस , अंत्येष्टि यान , डाक व तार विभाग के यान और ड्यूटी पर केंद्रीय सरकार और राज्य सरकार के यान ।
4. फीस की दरें , फीस के भुगतान से छूट प्राप्त यानों के प्रवर्ग और प्राधिकारी जिसे शिकायत , यदि कोई हो, की जानी है का नाम , पता और टेलीफोन नंबर आदि टोल बूथ से 500 मीटर पहले, टोल बूथ से 100 मीटर पहले और टोल बूथों पर भी सहज दृश्य रूप से और प्रमुख रूप से संप्रदर्शन बोर्ड पर संप्रदर्शित किए जाएंगे , संप्रदर्शन बोर्ड की ऊँचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों को संप्रदर्शन बोर्ड पढ़ने में आसानी हो और उन्हें अंग्रेजी, हिंदी और उस क्षेत्र जिसमें खंड स्थित है की क्षेत्रीय भाषा में पढ़ने योग्य लिखा जाएगा या मुद्रित होगा ।
5. यांत्रिक यान जो पूर्वोक्त अनुसूची में शामिल नहीं है, से कोई फीस उदगृहीत और संगृहीत नहीं कीजाएगी ।

NOTIFICATION
New Delhi , the 12th November , 2007
S.O. 1935 (E ) .- Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing ) , number S.O. 660 (E ) , dated the 27th September, 1996 . issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) . the Central Government entrusted the stretch from km . 36.63 to km . 162.50 ( Gurgaon Kotputli Sections in the States of Haryana and Rajasthan) on National Highway No. 8 to the National Highways Authority of India;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956 ) , read with rules 3 , 5 and 11 of the National Highways ( Fees for the Use of National Highways Section and Permanent Bridge Public Funded Projects ) Rules , 1997 and sub - rule (2 ) of rule 3 of the National Highways ( Rate of Fee ) Rules , 1997 , and in supersession of the notification of the Government of India in the then Ministry of Road' Transport and Highways , number S.O. 361 (E) , dated the 31 March , 2003 , except as respects things done or omitted to be done before such supersession , the Central Government hereby notifies that there shall be levied and collected, in perpetuity , by the National Highways Authority of India, departmentally or for the period of contract through private contractor who may be appointed on the basis of competitive bidding , a fee on mechanical vehicles for the use of the four- laned stretch from km . 42.00 to Km . 162.500 ( Gurgoan Kotputli Section) on National Highway No. 8 in the States of Haryana and Rajasthan at the rates specified in the Schedule annexed hereto

Notes . - 1 . The collection of fee shall commence within thirty days from the date of publication of this notification in the Official Gazette .
2. When the same mechanical vehicle has to cross the said stretch of the National Highway more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates specified in the Schedule while crossing the gate in the first trip itself or if the same mechanical vehicle has to use the said four - laned stretch frequently for the entire month , the vehicle owner may obtain a monthly pass on the payment of charges equivalent to 30 single rates applicable to it , as specified in the Schedule aforesaid.
Explanation.- For the purpose of this notification , " day" shall be counted as a continuous period of twenty - four hours .
1. The following types of vehicles shall be exempted from the fee specified in the Schedule , namely: -
(i) vehicles , -
(A) having "VIP " symbols ; or officially belonging to;
(a) the President of India;
(b) the Vice President of India;
(c) the Governor of a State or the Lt. Governor of a Union territory ;
(d) a Foreign Dignitary on State visit to India ;
(e) a Foreign Diplomat stationed in India using cars with " CD " / " CC" number plates;
(f) the Chairman of Rajya Sabha or the Speaker of Lok Sabha or the Chairman of a State Legislative Council or the Speaker of a State Legislative Assembly or a Minister for the Union or State , or Leader of Opposition in Lok Sabha or Rajya Sabha or a State Legislature having the status of Cabinet Minister , if he is sitting in the vehicle ; or
(g) a Member of Parliament, in the entire country , or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State, in the respective State , if he produces his identity card issued by the Parliament or the concerned Legislature of the State , as the case may be;
(B) belonging to the winner of a Gallantry award such as Param Vir Chakra , Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award;
(ii ) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Tolls (Army and Air Force ) Act , 1901 ( 2 of 1901 ) and the rules made thereunder (as extended to Navy) ;

(iii) Police vehicles , Fire - fighting vehicles , Ambulances , Funeral vans , Posts and Telegraph Department vehicles and Central Government and State Government vehicles on duty.
4. The rates of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of the authority to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths, 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and the regional language of the area in which the stretch is situated .
5. No fee shall be levied and collected from a mechanical vehicle , which is not covered by the Schedule aforesaid .
