सा.का.नि. 718(अ) , भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63 ) के खण्ड 38 में प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय मानक ब्यूरो की कार्यकारिणी समिति केन्द्र सरकार के पूर्व अनुमोदन से एतद्वारा भारतीय मानक ब्यूरो (वैज्ञानिक संवर्ग में भर्ती ) अधिनियम, 2002 में और संशोधन करके निम्नलिखित विनियम बनाती है : --
1. (1 ) इन विनियमों को भारतीय मानक ब्यूरो ( वैज्ञानिक संवर्ग में भर्ती) संशोधन, विनियम 2007 कहा जाएगा
( 2 ) ये आधिकारिक राजपत्र में प्रकाशन की तिथि से लागू होंगे ।
2. भारतीय मानक ब्यूरो ( वैज्ञानिक संवर्ग में भर्ती) विनियम 2002 (इसमें इसके पश्चात मुख्य विनियम कहा जाएगा ) , परिभाषाओं से संबद्ध विनियम 2 में , खंड (बी) के बाद निम्नलिखित को समाविष्ट किया जाएगा , यथा: -
" (बीए ) विभागीय पीयर रिव्यू समिति' से अर्थ है विनियम 9 के उपविनियम (6 ) की मद ( ii ) के अधीन केन्द्र सरकार द्वारा बनाई गई समिति "
3. मुख्य विनियम में, विनियम 9 के लिए, निम्नलिखित को प्रतिस्थापित किया जाएगा अर्थात : -
" 9 ( 1 ) अगले निम्न ग्रेड में सेवारत वैज्ञानिक संवर्ग के अधिकारियों का पदोन्नति के लिए चयन यहाँ दिए तरीके से किया जाएगा: -
(i )

( i) महानिदेशक द्वारा वैज्ञानिक सी, डी, और ई के पदों पर पदोन्नति के लिए गठित मूल्यांकन समिति द्वारा ;
(ii) केन्द्र सरकार द्वारा वैज्ञानिक एफ और जी के पदों पर पदोन्नति के लिए गठित विभागीय पीयर रिव्यू समिति द्वारा ;
(2) पदोन्नति के लिए अधिकारियों का चयन केन्द्र सरकार के अधीन वैज्ञानिक संगठनों में वैज्ञानिकों की पदोन्नति के लिए केन्द्र सरकार द्वारा बनाई गई /अथवा समय- समय पर संशोधित लचीली आवधिक प्रोन्नति योजना मे निर्दिष्ट विधि के अनुसार किया जाएगा ;
(3 ) उक्त योजना के अधीन ब्यूरो के वैज्ञानिक संवर्ग के अधिकारियों की वैज्ञानिक बी से वैज्ञानिक सी, वैज्ञानिक सी से वैज्ञानिक डी और वैज्ञानिक डी से वैज्ञानिक ई के पद पर पदोन्नति के लिए मूल्यांकन समिति की सिफारिशें अनुमोदन के लिए महानिदेशक के पास भेजी जाएंगी ;
(4 ) उक्त योजना के अधीन ब्यूरो के वैज्ञानिक संवर्ग के अधिकारियों की वैज्ञानिक ई से वैज्ञानिक एफ और वैज्ञानिक एफ से वैज्ञानिक जी के पद पर पदोन्नति के लिए विभागीय पीयर रिव्यू समिति की सिफारिशें अनुमोदन के लिए केन्द सरकार के पास भेजी जाएंगी ;
( 5 ) उक्त योजना के अधीन अधिकारियों की पदोन्नतियां ऐसे अनुमोदन की तिथि से प्रभावी होंगी जो कि अधिकारी की पदोन्नति की पात्रता की तिथि से पूर्व की नहीं होगी ;
(6 ) (i ) मूल्यांकन समिति में निम्नलिखित सदस्य होंगे, यथा: -
(क) महानिदेशक द्वारा मनोनीत अध्यक्ष;
(ख) भारतीय मानक ब्यूरो के कम से कम वैज्ञानिक संवर्ग- एफ के दो अधिकारी; और
(ग) बाहर के दो विशेषज्ञ जिनमें से एक अनुसूचित जाति अथवा अनुसूचित जनजाति वर्ग का हो ।

(ii) विभागीय पीयर रिव्यू समिति में निम्नलिखित व्यक्ति होंगे : -

(ख) सचिव, विज्ञान एवं प्रौद्योगिकी विभाग;
सदस्य
(ग) सचिव , जैवप्रौद्योगिकी विभाग;
सदस्य
(घ ) निदेशक, केंन्द्रीय खाद्य प्रौद्योगिकी अनुसंधान संस्थान;
सदस्य
(ड) निदेशक , राष्ट्रीय भौतिक प्रयोगशाला;
(च) एक अपर सचिव, जिसे कार्मिक एवं प्रशिक्षण विभाग के सचिव द्वारा मनोनीत किया जाएगा ।

G.S.R. 718 (E) . In exercise of the powers conferred by section 38 of the Bureau of Indian Standards Act, 1986 (63 of 1986) , the Executive Committee of the Bureau of Indian Standards , with the previous approval of the Central Government , hereby makes the following regulations further to amend the Bureau of Indian Standards (Recruitment to Scientific Cadre ) Regulations , 2002 , namely: -

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Bureau of Indian Standards ( Recruitment to Scientific Cadre ) Regulations , 2002, ( hereinafter referred to as the principal regulations ) , in regulation 2 relatingto definitions , after clause ( b) , the following shall be inserted , namely: -
"(ba ) ' Departmental Peer Review Committee ' means the Committee constituted by the Central Government under item (ii ) of sub- regulation (6) of regulation 9 "
3. Ir the Principal regulations , for regulation 9 , the following shall be substituted, namely: -
"9(1 ) The selections for promotions shall be made from amongst the Scientific Cadre officers serving in the next lower grade in the manner provided here under: - 4

[PART II-SEC. 3(i) ] (i ) by the Assessrnent Committee appointed by the Director General in respect of promotions to the posts ofScientists C , D and E ;
(ii ) by the Departmental Peer Review Committee constituted by the Central Government in respect of promotions tothe posts of Scientists F and G.
(2) Selection of officers for promotions shall be made in the manner as laid down in the Scheme of Flexible Complementing formulated and/ or amended from time to time by the Central Government for promotions of scientists in Scientific Organizations under the Central Government;
(3) The recommendations of the Assessment Committee in respect of officers of Scientific Cadre of the Bureau for promotion of Scientist B to Scientist C , Scientist C to Scientist D and Scientist D to Scientist E under the said scheme shall be referred to the Director General for approval ;
(4) The recommendations of the Departmental Peer Review Committee in respect of officers of Scientific Cadre of the Bureau for promotion of Scientist E to Scientist F and Scientist F to Scientist G under the said Scheme shall be referred to the Central Government for approval ;
(5) Promotions of the officers considered under the said scheme shall be effective from the date of such approval which shall not be the date prior to the date of eligibility of the officer for promotion .
(6) ( i ) The Assessment Committee shall consist of the following members , namely: -
( a) A Chairman to be nominated by the Director General ;
(b) two officers from the Bureau of Indian Standards not below the rank of Scientist- F; and
(c) two experts from outside of whom one shall belong to the Scheduled Caste or Scheduled Tribe category .
( ii )The Departmental Peer Review Committee shall consist of the following:-
Chairman (a) Secretary, Department of Consumer Affairs ;
Member (b) Secretary , Department of Science and Technology;
Member (c) Secretary, Department of Biotechnology;
Member (d) Director, Central Food Technological Research Institute;
Member (e) Director, National Physical Laboratory;
(f)
Member ." AnAdditional Secretary to be nominatedby Secretary , Department of Personnel and Training .
