आ.अ. 127( अ ).-यतः मध्य प्रदेश राज्य में 24 - खरगोन संसदीय निर्वाचन क्षेत्र से लोक सभा के लिए निर्वाचित श्री कृष्ण मुरारी मोघे का स्थान , भारत के राष्ट्रपति के द्वारा संविधान के अनुच्छेद 103 के खण्ड ( 1 ) के अधीन उनके दिनांक 10 जुलाई , 2007 के आदेश के द्वारा उन्हें संविधान के अनुच्छेद 102 के खण्ड ( 1 ) के उप- खण्ड ( क ) के अधीन संसद की सदस्यता से निरर्हित घोषित किए जाने के परिणामस्वरूप 10 जुलाई, 2007 से रिक्त हो गया है ; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है ;
अतः , अब , लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 149 की उप- धारा ( 1 ) तथा धाराओं 30 और 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा-
(अ) मध्य प्रदेश राज्य में उक्त 24 - खरगोन लोक सभा निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 18 दिसम्बर, 2007 (मंगलवार) से पूर्व तथा उक्त अधिनियम के और तद्दीन बनाये गये नियमों और किए गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित करें;
(आ ) उक्त निर्वाचन के सम्बन्ध में-
:
(क) नामनिर्देशन करने की अन्तिम तारीख
23 नवम्बर , 2007 ( शुक्रवार ) ;
:
(ख) नाम निर्देशनों की संवीक्षा की तारीख
26 नवम्बर , 2007 ( सोमवार );
:
28 नवम्बर , 2007 ( बुधवार ) ;
( ग ) अभ्यर्थिताएं वापिस लेने की अन्तिम तारीख
:
12 दिसम्बर , 2007 ( बुधवार);
( घ ) वह तारीख जिसको , यदि आवश्यक हुआ तो मतदान होगा
:
18 दिसम्बर , 2007 ( मंगलवार) (ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा
नियत करता है ; और
( ई ) 7.00 बजे पूर्वाह्न से 5.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान , यदि आवश्यक हुआ तो, निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को मतदान होगा ।

NOTIFICATION
New Delhi , the 16th November , 2007
Ο.Ν. 127( E ) . Whereas , the seat of Shri Krishna Murari Moghe in the House of the People , elected from 24- Khargone Parliamentary Constituency in the State of Madhya Pradesh has become vacant on 10th July , 2007 , by reason of the order dated 10th July , 2007 of the President under clause ( 1 ) of Article 103 of the Constitution declaring him as disqualified for being a member of Parliament under sub - clause ( a) of clause ( 1 ) of Article 102 of the Constitution ;
Whereas , a bye- election is to be held for the purpose of filling the vacancy so caused ;
Now, therefore, in pursuance of Sub- section ( 1 ) of Section 149 and Sections 30 and 56 of the Representation of the People Act, 1951 (43 of 1951 ) , the Election Commission of India hereby----
(A) calls upon the said 24- Khargone Parliamentary Constituency , in the State of Madhya Pradesh to elect , before the 18th December , 2007 (Tuesday ) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the House of People;
(B) appoints , with respect to the said election-
(a) the 23rd November , 2007 (Friday ) , as the last date for making nominations ;
(b) the 26th November, 2007 ( Monday) as the date for the scrutiny of nominations ;
(c) the 28th November , 2007 (Wednesday) , as the last date for the withdrawal of candidatures;
(d) the 12th December , 2007 (Wednesday) as the date on which a poll shall , if necessary , be taken; and (e) the 18th December , 2007 (Tuesday) , as the date before which the election shall be completed; and (C) fixes the hours from 7.00 A.M. to 5.00 P.M. as the hours during which the poll shall , if necessary , be taken on the date specified above for the election.
