का.आ. 1960(अ) . केंद्रीय सरकार पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 कां 29 ) की धारा 3 की उप- धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार की अधिसूचना संख्यांक का.आ. 1533 ( अ ) तारीख 14 सितम्बर, 2006 के अनुसरण में राज्य स्तरीय पर्यावरण प्रभाव निर्धारण प्राधिकरण , पंजाब ( जिसे इसमें इसके पश्चात् प्राधिकरण , पंजाब कहा गया है ) का गठन करती है जिसमें पंजाब सरकार द्वारा नाम निर्देशित तीन सदस्य अर्थात् अध्यक्ष , सट्स्य और सदस्य सचिव समाविष्ट होंगे , जो निम्नलिखित हैं :-

2. अध्यक्ष और सदस्यों की पदावधि इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी ।
3. प्राधिकरण , पंजाब ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रक्रियाओं का अनुसरण करेगा जो अधिसूचना संख्याक का.आ. 1533 ( अ ) , तारीख 14 सितम्बर , 2006 में दी गई है ।
4. प्राधिकरण , पंजाब इस आदेश में पंजाब सरकार के लिए गठित पंजाब सरकार के लिए गठित राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति ( एस ई एसी ) की सिफारिशों के आधार पर अपने निर्णय देगी ।
5. पंजाब राज्य सरकार प्राधिकरण के सचिवालय के रूप में कार्य करने के लिए अधिकरण को अधिसूचित करेगा और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत स्थान सुविधा , परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवाएगी । प्राधिकरण के अध्यक्ष और सदस्य को बैठक फीस , यात्रा भत्ता/ मंहगाई भत्ता पंजाब सरकार द्वारा नियमानुसार संदत्त होगा ।
6. उक्त प्राधिकरण की सहायता के लिए केन्द्रीय सरकार पंजाब राज्य सरकार से परामर्श करके राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति, पंजाब का गठन करती है ( जिसे इसमें इसके पश्चात् एस ई ए सी कहा गया है ) जिसमें निम्नलिखित सदस्य समाविष्ट होंगे : -

9. एस ई ए सी पंजाब सामूहिक दायित्व के सिद्धांत पर काम करेगी । अध्यक्ष , प्रत्येक मामले में एकमत होने का प्रयास करेगा और यदि एकमत नहीं हो सकता तो बहुमत का विचार अभिभावी होगा ।

S.O. 1960 (E ) .-In exercise of the powers conferred by sub - section (3 ) of Section 3 of Environment (Protec- tion) Act, 1986 ( 29 of 1986 ) and in pursuance of the Government of India notification number S.O. 1533 (F ) dated the 14th September , 2006 , the Central Government hereby constitutes the State Level Environment Impact AssessmentAuthority (SEIAA) , Punjab (hereinafter referred to as the Authority, Punjab ) comprising of three members namely, Chairman, Member and Member Secretary nominated by the State Government of Punjab as under:--

7. अध्यक्ष और सदस्यों की पदावधि, इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी और एस ई ए सी, पंजाब का प्रत्येक तीन वर्ष के पश्चात् पुनर्गठन किया जाएगा ।
3. The Authority , Punjab shall exercise such powers and follow such procedures as enumerated in the notifica- tion number S.O. 1533 (E ) dated the 14th September , 2006 .
8. एस ई ए सी , पंजाब ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रक्रियाओं का अनुसरण करेगी जो अधिसूचना संख्यांक का.आ. 1533 ( अ ) तारीख14 सितम्बर , 2006 में दी है ।
4. The Authroity, Punjab shall base its decision on the recommendations of the State Level Expert Appraisal Commit- tee (SEAC) constituted for the State of Punjab in this order .

The State Governtment of Punjab shall notify the agency to act as secretariat for the Authority and shall provide all financial and logistic support including accom- modation , transportation and such other facilities in respect of all its statutory functions . Sitting fee, Travelling Allowance/Dearness Allowance to the Chairman and Member of the Authority shall be paid by the State Government of Punjab as per State rules .

8. The SEAC, Punjab shall exercise such powers and follow such procedures as enumerated in the notifica- tionnumber S.O. 1533 (E) dated the 14th September, 2006.

9. The SEAC, Punjab shall function on the principle of collective responsibility . The Chairperson shall endeavour to reach a consensus in each case , and it consensus cannot be reached , the view of the majority shallprevail.
