नई दिल्ली , 27 नवम्बर , 2007
का.आ. 1991 ( अ ).- केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत शक्तियों का प्रयोग करते हुए, निम्नलिखित आदेश करती है , अर्थात्:-
1. संक्षिप्त नाम , विस्तार , प्रारम्भ और लागू होना.-
(1 ) इस आदेश का संक्षिप्त नाम चावल ( कम्पनियों या फर्मों अथवा व्यष्टियों द्वारा स्टॉक घोषणा ) आदेश , 2007 है ।
(2) इसका विस्तार सम्पूर्ण भारत पर होगा ।
(3.) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
(4) यह भारतीय खाद्य निगम द्वारा या उसकी ओर से क्रय किए गए किसी धान या चावल को लागू नहीं होगा ।
2. परिभाषाएं, इस आदेश में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,-
(क) " भारतीय खाद्य निगम " से भारतीय खाद्य निगम अधिनियम , 1964 ( 1964 का 3.7) की धारा 3 के अधीन स्थापित भारतीय खाद्य निगम अभिप्रेत है ;
(ख) " प्ररूप " से इस आदेश से उपाबद्ध प्ररूप अभिप्रेत है ;

(ग ) " चावल " से कच्चे या उसना रूप में धान से अभिप्राप्त परिपक्व दाने या दानों के टुकड़े अथवा ओरिजामटीवा लिनन अभिप्रेत है;
(घ) " कम्पनी " से कम्पनी अधिनियम , 1956 ( 1956 का 10 ) के अधीन अधिसूचित कोई कम्पनी अभिप्रेत है ।
3. किसी कम्पनी या फर्म अथवा व्यष्टि द्वारा चावल के क्रय से संबंधित विवरणी-
( 1 ) कोई कम्पनी या फर्म अथवा व्यष्टि, जो खरीफ विपणन मौसम 2007-08 ( अक्तूबर- सितम्बर ) के दौरान 10,000 मीट्रिक टन ( देश भर में किया गया कुल क्रय) से अधिक धान ( चावल के रूप में ) या चावल का क्रय करता है , ऐसे अंतरालों पर ऐसे प्ररूप में, जो केंद्रीय सरकार द्वारा विनिर्दिष्ट किया जाए, एक विवरणी उस राज्य के, जहां से अधिकतम मात्रा में क्रय किया गया है , सचिव , खाद्य विभाग को फाइल करेगा ।
(2) 25,000 मीट्रिक टन ( देश भर में किया गया कुल क्रय ) से अधिक धान (चावल के रूप में ) या चावल क्रय करने की दशा में , ऐसे अंतरालों पर ऐसे प्ररूप में, जो उसमें विनिर्दिष्ट किया जाए, विवरणी , अवर सचिव (नीति-3 ) , खाद्य और सार्वजनिक वितरण विभाग , कमरा नं. 292 , कृषि भवन , नई दिल्ली-110001 ( फैक्स सं 011-23782213 , ई मेल: uspy34, [email protected])को प्रस्तुत करेगा
(3 ) ऐसी संबंधित राज्य सरकारें, जिनको किसी कम्पनी या फर्म अथवा व्यष्टि द्वारा 10,000 मीट्रिक टन से अधिक [PART II-SEC . 3 ( ii) ] 2

(2) It extends to the whole of India.
(3) It shall come into force on the date of its pub- lication in the Official Gazette .
धान ( चावल के रूप में ) या चावल के क्रय की घोषणा करने वाले प्ररूप में विवरणियां फाइल की गई हैं, अवर सचिव ( पीवाई-3) , खाद्य और सार्वजनिक वितरण विभाग को प्रत्येक मास की 10 तारीख तक एक समेकित मासिक रिपोर्ट प्रस्तुत करेंगी ।
(4) It shall not apply to any paddy or rice pur- chased by or on behalf of the Food Corpora- tion of India .

2. Definitions .--In this Order , unless the context otherwise requires , ---

(खण्ड 3 देखिए )
(a) " Food Corporation of India " means the Food Corporation of India established under Sec- tion 3 of the Food Corporation of India Act , 1964( 37 of 1964) ;
चावल के क्रय के संबंध में कंपनी या फर्म अथवा व्यष्टि द्वारा साप्ताहिक या मासिक विवरणी फाइल करने का रूप विधान
(b) " Form " means a form annexed to this Order ;

(c) " Rice " means mature kernels or pieces of ker- nels or Oryza sativa Linn , obtained from paddy as raw or parboiled;
5 सितम्बर, 2007 से 31 दिसम्बर, 2007 की अवधि के दौरान प्रत्येक सप्ताह शुक्रवार को अपराहन 4 बजे तक और 30 सितम्बर, 2008 तक उसके प्रत्येक पश्चात्वर्ती मास के अंतिम शुक्रवार को प्रस्तुत किया जाए ।
(d) " Company " means a company notified under the Companies Act , 1956 ( 10 of 1956) .

(1) Any Company or Firm or Individual who pur- chases paddy (in terms of rice ) or rice in ex- cess of 10,000 Metric Tonnes (total purchases made throughout the country ) during the Kharif Marketing Season 2007-08 ( October- September) , shall furnish to the Secretary , Department of Food of then State from where maximum quantity has been purchased , a return in the Form at such intervals as may be specified by the Central Government .

S.Q. 1991 (E) . In exercise of the powers conferred by Section 3 ofthe Essential Commodities Act , 1955 ( 10 of 1955) , the Central Government hereby makes the following Order, namely :-
(3) The concerned State Governments with which the returns are filed by any Company or Firm or Individual in Form declaring purchase of paddy (in terms of rice) or rice in excess of 10,000 Metric Tonnes shall submit a consoli- dated monthly report to the Under Secretary (Py - III ) , Department ofFood and Public Distri- bution by the 10th of every month .
