सा.का.नि. 751 (अ) .- खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारुप जिसे केन्द्रीय सरकार केन्द्रीय खाद्य मानक समिति से परामर्श के पश्चात् खाद्य अपमिश्रण निवारण अधिनियम, 1954 ( 1954 का 37) की धारा 23 की उपधारा ( 1 ) (क) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाना चाहती है, जिन्हें उक्त अधिनियम की धारा 23 की उपधारा ( 1 ) की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती हैं, तीस दिन की समाप्ति के पश्चात् विचार किया जाएगा ।
ऐसे आक्षेपों और सुझावों पर, जो उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि के अवसान के पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव , यदि कोई हों, सचिव, भारत सरकार, स्वास्थ्य और परिवार कल्याण मंत्रालय , निर्माण भवन, नईदिल्ली 110011 को भेजे जा सकेंगे ;

प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( संशोधन) नियम, 2007 है ।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
खाद्य अपमिश्रण निवारण नियम, 1955 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 42के उपनियम (ययय) के खंड ( 1 ), में लेबल की मद (1) और उससे संबंधित प्रविष्टियों के स्थान पर निम्मलिखित रखा जाएगा, अर्थात्:-
" (i) इसमें (............ कृत्रिम मिठास कारक पदार्थ का नाम) है " ।
3. उक्त नियमों के नियम 47 की सारणी में :-
(क) ऐसेसल्फेम पोटेशियम से संबंधित क्रम संख्यांक 3 के सामने स्तंभ 3 और स्तंभ 4 में की प्रविष्टिके पश्चात् क्रमशः निम्नलिखित प्रविष्टियां अंतःस्थापित की जाएंगी,
अर्थात्:-

"फल नेक्टर
300पीपीएम
फल नेक्टर के लिए सांद्र
300 पीपीएम (उपभोग के लिए तैयार पेय
पदार्थ में) " ।
(ख) सुक्रेलोज से संबंधित क्रम संख्यांक 4 के सामने स्तंभ 3 और स्तंभ 4 में की प्रविष्टि | के पश्चात् क्रमशः निम्नलिखित प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्:-

" लोर्जेज
1500 पीपीएम ।"
4. उक्त नियमोंके नियम 49 में उपनियम ( 19) के स्थान पर निम्नलिखित उपनियम रखा जाएगा , अर्थात्:-
" ( 19 ) कोई भी व्यक्ति सिवाय भारतीय मानक ब्यूरो प्रमाणन चिन्हके अधीन ऐसे किसी शिशु दुग्ध आहार , शिशु फार्मूला और दुग्ध अनाज आधारित अपस्तर आहार, प्रसंस्कृत 3

अनाज आधारित अपस्तर आहार और अनुसरित फार्मूला का विनिर्माण , विक्रय, भंडारण याविक्रय के लिए प्रदर्शन नहीं करेगा । " ।
5. उक्त नियमों के नियम 61 च के पश्चात्निम्नलिखित अंतःस्थापित किया जाएगा,
अर्थात्: -
"61छ. जेनथन गोंद का उपयोग- जेनथन गोंद का निम्नलिखित उत्पादों में उपयोग किया जा सकेगा, अर्थात्: -
गैर डेयरी विहप टोपिंग्स
अधिकतम 0.5 प्रतिशत भार के अनुसार बेकरी मिक्स
अधिकतम 0.5 प्रतिशत भार के अनुसार "
6. उक्त नियमों के परिशिष्ट ख में-
(क
) मद क .07.13 के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:- "क.07.14 सुक्रेलोज :
रासायनिक नाम -1 , 6-डिक्लोरा -1 , 6 डाइडिओक्सी बीटा -डी-फ्रक्टोफुरोनोसिल-4 क्लोरो-1-4-डिओसी-डी-गेलेक्टोपिरेनोसाइड ;
पर्यायवाची-4 , 1 '6' -ट्राइक्लोगेलेक्टोसुक्रोज ; आईएनएस 955
रासायनिक फार्मूला- सी12 एच 19 सीएल 3 ओ 8
मोलेक्यूलर भार-397.64
यह श्वेत से श्वेताभ, गंधरहित , क्रिस्टलाइन चूर्ण होगा जिसका मधुर स्वाद होगा । यह मेथेनॉल और एल्कोहल के जल में मुक्त रूप से घुलनशील होगा और यह इथायल एसीटेट में मामूली तौर पर विलेय होगा । इसमें एनहाइड्रोस अधार पर संगणित सी12 एच 19सीएलओ 8 98 प्रतिशत से अन्यून और 102.0 प्रतिशत से अनधिक होगा । इसमें आरसैनिक (एएस रूप में) 3 पी.पी.एम. से अनधिक और भारी धातु (पीबी के रूप में) 10 पी.पी.एम. से अनधिक होगा । इसमें मेथेनल 0.1 प्रतिशत से अधिक नहीं होगा । प्रज्वलन पर अवशेष 0.7 प्रतिशत से अनधिक और 0.2 प्रतिशत से अधिक जल नहीं होगा ।

[PART II-SEC . 3 (i ) ] मद क . 25.02 लोजेंज में अंत में निम्नलिखित उपबंध अंतःस्थापित किया जाएगा,
(ख)
अर्थात्:-
"परन्तु यह कि यदि कृत्रिम मधुरक नियम 47 में यथा उपबंधित रूप में उत्पाद में जोड़ा गया है, तो यह घोषणा नियम 42 के उपनियम (ययय)( 1 )(क) और (ययय)( 1 )(ख) में यथा उपबंधित रूप में लेबल पर की जाएगी :
"परन्तु यह और कि यदि केवल अनुज्ञेय कृत्रिम मधुरक, मधुरक के रूप में उत्पादों में प्रयोग किए जाते हैं, तो उन मानकों में विहित सुक्रोज की अपेक्षा, ऐसे उत्पादों को लागू नहीं होगी । "
7. उक्त नियमों के परिशिष्ट ग की सारणी 2 में,
(क) स्तंभ 5 में विद्यमान शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा ,
अर्थात्:-
" इडली मिक्स , डोसा मिक्स, उपमा मिक्स, पोंगल मिक्स, पुलीवोगेर मिक्स, गुलाब जामुन मिक्स, जलेबी मिक्स , बड़ा मिक्स इत्यादि के रूप में ऐसे इन्सटेंट मिक्स ।" ;
(ख) क्र.सं.ङ के सामने सुक्रोलोज से संबंधित मद 4 के सामने स्तंभ 12 में की प्रविष्टिके स्थान पर " 1500 पीपीएम अधिकतम " प्रविष्टि रखी जाएगी ;
(ग) क्र.सं.ज के पश्चात् और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित क्र.सं. और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्:-

NOTIFICATION
New Delhi, the 5th December, 2007
G.S.R. 751 (E)-The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government , after consultation with the Central Committee for Food Standards , proposes to make in exercise of the powers conferred by sub - section ( 1 ) read with sub- section ( 1A) of section 23 of the Prevention of FoodAdulteration Act, 1954 (37 of 1954) , is hereby published as required by sub - section( 1 ) of section 23 of the said Act, for the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Gazette of india in which this notification is published , are made available to the public;
Objections and suggestions which may be received from any person with respect to the said draft rules within the period specified above, will be considered by the Central Government;
The objections or suggestions , if any, may be addressed to the Secretary , Ministry of Health and Family Welfare ,Government of India , Nirman Bhawan , New Delhi - 110001 .
DRAFT RULES
1. ( 1 ) These rules may be called the Prevention of Food Adulteration (.............. Amendment ) Rules , 2007 .

(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Prevention of Food Adulteration Rules , 1955 ( hereinafter referred to as said rules) , in rule 42, in sub - rule ( ZZZ) , in clause ( 1 ) , in the label, for the item ( i ) , and the entries relating thereto, the following shall be substituted , namely :
"( i) This contains ( Name of the artificial sweeteners ) " .
3. In rule 47 of the said rules , in the Table , -
(a) against serial no. 3 relating to Acesulfame Potassium , after the entries in column 3 and column 4 , the following entries shall respectively be inserted , namely: -

Concentrate for fruit nectars
300ppm
(infinal beverage for consumption) ";
(b) against serial no . 4 relating to Sucralose , after the entries in column 3 and column 4, the following entries shall respectively be inserted , namely: -

"Lozenges
1500ppm" .
4. In rule 49 of the said rules , for sub -rule ( 19) , the following sub - rule shall be substituted, namely: -
"(19) No person shall manufacture, sell , store or exhibit for sale an infant milk food, infant formula and milk cereal based weaning food, processed cereal based weaning food and follow up formula except under Bureau of Indian Standards Certification Mark.".
$ . After rule 61 - F of the said rules , the following shall be inserted , namely: -
" 61 -G - Use of Xanthan gum - Xanthan gum may be used in the following products , namely:-
Non dairy whip toppings maximum 0.5 % by weight
maximum 0.5% by weight" .

6. In Appendix B to the said rules ,
(a) after item A.07.13 , the following shall be inserted , namely: -
"A.07.14 - Sucralose:
Chemical name -1 , 6- Dichloro- 1 , 6 - Dideoxy -B-- ID - Fructofuranosyl -4-Chloro-4- Deoxy-a-D-galactopyranoside:

Chemical formula -C12H19C1308
Molecular weight - 397.64
It shall be white to off- white , odourless , crystalline powder , having a sweet taste . It shall be freely soluble in water, in methanol and in alcohol and slightly soluble in ethyl acetate . It shall contain not less than 98.0% and not more than 102.0% of C12H19CI3O8 calculated on anhydrous basis . It shall not contain more than 3PPM of Arsenic ( as AS) and 10PPM or heavy metals (as Pb ) . It shall not contain more than 0.1% of methanol . Residue on ignition shall not be more than 0.7% and water not more than 0.2% ." .
(b) in item A.25.02 LOZENGES , the following provisos shall be inserted at the end , namely:
"Provided that if artificial sweetener has been added in the product as provided in rule 47, it shall be declared on the label as provided in sub - rule ( ZZZ)( 1 )(A) and (ZZ.Z) ( 1 ) (B ) of rule 42:
"Provided further that if only permitted artificial sweetener is used in the products as sweetener , the requirement for sucrose prescribed in these standards shall not be applicable to such products ." .
7. In Appendix C to the said rules , in Table 2,
(a) in column 5 , for the existing heading , the following heading shall be substituted , namely:-
" Instant mixes such as idli mix, dosa mix, upma mix, pongal mix, puliyogare mix, gulab jamun mix , jalebi mix, vada mix, etc. " ;
(b) in serial no . E, against item 4 relating to Sucralose, for the entry in column 12, the entry " 1500ppm maximum " shall be substituted;
(c) after serial no . H , and the entries relating thereto , the following serial no . and entries shall be inserted , namely: -
