विदेशी मुद्रा प्रबन्ध ( विदेशी मुद्रा व्युत्पन्न संविदा ) ( संशोधन ) विनियमावली, 2007

सा.का.नि. 760( अ ).-विदेशी मुद्रा प्रबंध अधिनियम , 1999 (1999का अधिनियम 42 ) की धारा 47 की उप- धारा ( 2 ) के खंड ( ज ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय रिज़र्व बैंक , विदेशी मुद्रा प्रबंध ( विदेशी मुद्रा व्युत्पन्न संविदा) विनियमावली , 2000 (दिनांक 3 मई , 2000 की अधिसूचना सं. फेमा 25/2000- आरबी ) में निम्नलिखित संशोधन करता है , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ (ⅰ ) ये विनियम विदेशी मुद्रा प्रबंध (विदेशी मुद्रा व्युत्पन्न संविदा ) ( संशोधन ) विनियमावली, 2007 कहलाएंगे ।

होंगे । ( ii ) ये विनियम , इन विनियमों में निर्दिष्ट तारीखों @ से लागू

2. विनियम 6 का संशोधन : विदेशी मुद्रा प्रबंध ( विदेशी मुद्रा व्युत्पन्न संविदा) की विनियमावली , 2000 (दिनांक 3 मई , 2000 की अधिसूचना फेमा 25/आरबी-2000 ) ( इसके आगे " मूल विनियमावली " के रूप में उल्लिखित ) में विनियम 6 में, उप-विनियम ( ii ) में " इसके द्वारा आयतित/निर्यातित " शब्दों को हटा दिया जाएगा तथा भई 2007 के 31वें दिन से हटा दिया गया समझा जाएगा ।

3. नया विनियम 8 जोड़ना मूल विनियमावली में, विनियम 7 के बाद निम्नलिखित नया विनियम जोड़ा जाएगा तथा

जुलाई 2005 के 23वें दिन से जोड़ा गया समझा जाएगा , अर्थात् :-

"8. पण्य व्युत्पन्न संविदा संबंधी प्रेषण- भारत में प्राधि-- कृत व्यापारी निम्नलिखित मामलों में, इन विनियमों के अनुसार किए गए लेनदेनों के संबंध में विदेशी मुद्रा भारत से बाहर प्रेषित कर सकता है , अर्थात्: -

(क) भारत में निवासी व्यक्ति द्वारा भारत से बाहर के निवासी व्यक्तिको देय ऑप्शन ;

(ख) विनिमय 6 के अनुसार किए गए पण्य व्युत्पन्न संविदा को प्रासंगिक राशि का भारत में निवासी व्यक्ति द्वारा प्रेषण ;

(ग ) रिज़र्व बैंक द्वारा अनुमोदित पण्य व्युत्पन्न संविदा संबंधी कोई अन्य संविदा" ।

4. अनुसूचियों के संशोधन: मूल विनियमावली में,

( i) अनुसूची I में पैराग्राफ " अ " के बाद नया पैराग्राफ जोड़ा जाएगा तथा दिसम्बर, 2006 के 13वें दिन से जोड़ा गया समझा जाएगा , अर्थात्:-

"अअ. आर्थिक निवेश के संबंध में वायदा संविदा- भारत में निवासी व्यक्ति, समय -समय पर रिजर्व बैंक द्वारा यथानुबद्ध शर्तों के अधीन रिज़र्व बैंक द्वारा समय-समय पर यथानिर्धारित ऐसे लेनदेनों में विनियम जोखिम के आर्थिक जोखिम की रक्षा के लिए भारत में किसी प्राधिकृत व्यापारी के साथ वायदा संविदा कर सकता है । "

( ii) अनुसूची II में, पैराग्राफ 1 में, खंड (ख ) के लिए निम्नलिखित को प्रस्थापित किया जाएगा तथा

फरवरी , 2007 के 8वें दिन से प्रतिस्थापित किया गया समझा जाएगा , अर्थात्:--

1. Short Title and Commencement .-( i ) These Regulations may be called the Foreign Exchange Management (Foreign Exchange Derivative Contracts ) (Amendment ) Regulations , 2007 .

(ii ) These regulations shall come into force on the datesspecified hereurider@.

" ( ख ) रिज़र्व बैंक द्वारा समय - समय पर यथानिर्धारित शतों के अधीन वायदा संविदा को रद्द और पुनः बुक किया जाए अथवा परिपक्वता अवधि को अथवा उसके पहले पुनर्निर्धारित किया जाए । "

2. Amendment of Regulation6.-In the Foreign Exchnge Management (Foreign Exchange Derivative Contracts) Regulations , 2000 (Notification No. FEMA 25/ RB-2000 dated May 3 , 2000 ) (hereinafter referred to as ' the principal regulations ' ) , in Regulation 6, in sub - regulation (ii), the words " imported/exportedby it " shall be omitted and shall be deemed to have been omitted with effect from 31stday ofMay, 2007.

1. @ प्रमाणित किया जाता है कि इस अधिसूचना के पूर्व प्रभावी होने से किसी भी व्यक्ति पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

3. Insertion of new Regulation 8.-In the principal regulations , after Regulation 7 , the following new regulation shall be inserted and shall be deemed to have been inserted with effect from the 23rd day of July, 2005, namely:-- 2. मूल विनियमावली मई 8 , 2000 के सा.का.नि. 411 (अ) द्वारा भारत के राजपत्र , भाग II , खंड 3 , उप-खंड ( i ) में प्रकाशित की गई तथा बाद में निम्नलिखित द्वारा संशोधित किए गए-

"8. Remittance related to a Commodity Derivative Contract. An authorised dealer in India may remit outside India foreign exchange in respect of a transaction , undertaken in accordance with these Regulations , in the following cases , namely:---

(a) optionpremium payable by a person resident in India to a person resident outside India;

(b) remittance by a person resident in India of amount incidental to a commodity derivative contract entered into in accordance with Regulation 6;

(1) in Schedule I , after paragraph ' A' , the following new paragraph shall be inserted and shall be deemed to have been inserted with effect from the 13th day ofDecember, 2006, namely:-- (CentralOffice)

" AA . Forward Contract in respect of Economic Exposure . A person resident in India may, subject to such terms and conditions as may be stipulated by the Reserve Bank from time to time , enter into a forward contract with an authorised dealer in India to hedge an economic exposure to exchange risk in respect of such transactions as may be prescribed by the Reserve Bank from time to time."

(ii) in Schedule II , in paragraph 1 , for clause (b) , the following shall be substituted and shall be G.S.R. 760(E) . In exercise of the powers conferred by clause (h) ofsub- section (2 ) ofSection 47 of the Foreign ExchangeManagement Act, 1999 (42 of 1999), the Reserve Bank hereby makes the following amendments in the Foreign Exchange Management (Foreign Exchange Derivative Contracts) Regulations , 2000, (Notification No FEMA 25/RB - 2000 dated May 3 , 2000) , namely :-

deemed to have been substituted with effect from the 8th day of February, 2007, namely:---

"(b) forward contracts may be cancelled and rebooked subject to such terms and conditions asmay be stipulated by the Reserve Bank from timeto time, or may be rolled over on or before maturity."
