'8.30 प्रतिशत उर्वरक कंपनियों के भारत सरकार विशेष बांड , 2023' का निर्गम ।
फा. सं. 4( 8 )-डब्ल्यू एंड एम/2007.-भारत सरकार एतद्द्वारा 7 दिसम्बर , 2007 को कुल 3,890 करोड़ रुपये ( नामिनल) की राशि के लिए ' 8.30 प्रतिशत उर्वरक कंपनियों के भारत सरकार विशेष बांड , 2023 ' ( जिन्हें इसके बाद संक्षिप्त रूप में ' विशेष बांड ' के रूप में निर्दिष्ट किया गया है ) का निर्गम अधिसूचित करती है।
1. विशेष बांडों में अभिदान की पात्रता और अभिदान कीसीमा. यहां अनुबंध में यथाउल्लिखित कंपनियां ही विशेष बांडों में अभिदान की पात्र होंगी और विशेष बांडों में उनका अभिदान उक्त अनुबंध -1 में उनके नाम के सामने दर्शाई गई राशि की सीमा तक सीमित होगा । उक्त अनुबंध में यथाउल्लिखित कंपनियों को छोड़कर कोई बैंक, कंपनी, निगम अथवा अन्य कोई निकाय सहित कोई अन्य व्यक्ति विशेष बांडों में अभिदान के लिए पात्र नहीं होगा ।
2. मूल्य. विशेष बांड पात्र कंपनियों द्वारा किए गए आवेदन के अनुसार राशि के लिए सममूल्य पर किए गए आवेदन पर जारी किए जाएंगे । विशेष बांड न्यूनतम 10,000 रुपये ( नामिनल ) की राशि और उसके बाद 10,000 रुपये के गुणजों में जारी किए जाएंगे ।

3. आवेदन पत्र. विशेष बांड पात्र कंपनियों से अनुबंध- II मेंदिए गए प्रपत्र के अनुसार आवेदन पर जारी किए जाएंगे ।
4. प्रतिभूति का स्वरूप, विशेष बांड स्टाक के रूप में अर्थात् ' स्टाक प्रमाण पत्रों' सहायक सामान्य खाता बही धारक के साथ धारित ग्राहक सहायक सामान्य खाता लेखा में क्रेडिट द्वारा जारी किए जाएंगे ।
5. कार्यकाल का प्रारम्भ और वापसी अदायगी की तारीख. विशेष बांडों का कार्यकाल 7 दिसम्बर , 2007 से शुरू होगा । विशेष बांडों पर ब्याज उनकी अवधि प्रारम्भ होने की तारीख से उपचित होगा । विशेष बांडों की वापसी अदायगी सममूल्य पर 7 दिसम्बर , 2023 को भारतीय रिजर्व बैंक , मुम्बई के लोक ऋण कार्यालय में की जाएगी ।
6. ब्याज. विशेष बांडों पर 8.30 प्रतिशत वार्षिक की दर पर ब्याज प्राप्त होगा । ब्याज का हिसाब विशेष बांडों की अवधि प्रारम्भ होने की तारीख से लगाया जाएगा और यह भुगतान विशेष बांडों की परिपक्वता तक अर्द्धवार्षिक आधार पर 7 जून और 7 दिसम्बर को देय होगा ।
विशेष बांडों पर ब्याज का भुगतान भारतीय रिजर्व बैंक के फोर्ट, मुम्बई के लोक ऋण कार्यालय में किया जाएगा । ब्याज का भुगतान ब्याज की राशि को निकटतम रुपए तक पूर्णांकित करने के बाद किया जाएगा ।
7. हस्तांतरणीयता.-(1 ) इस अधिसूचना के पैरा 4 के प्रावधानों के अधीन भारतीय प्रतिभूति अधिनियम , 2006 तथा उसके अंतर्गत बनाए गए सरकारी प्रतिभूति विनियम , 2007 के उपबंधों के

अंतर्गत विशेष बांड का नवीकरण , उप-विभाजन , समेकन , रूपान्तरण अथवा अंतरण किया जा सकता है ।
( ii ) इस अधिसूचना में ऊपर पैरा । में दिए गए कथन के बावजूद , अभिदानकर्ताओं द्वारा विशेष बांडों को बैंकों , निगम अथवा किसी अन्य निकाय सहित किसी अन्य व्यक्ति के पक्ष में अंतरण करने पर कोई प्रतिबंध नहीं होगा और ऐसी प्रतिभूति का अन्तरिती भी उन्हें उसी तरीके से धारण तथा अंतरण करने का पात्र होगा ।
8. सांविधिक प्रावधान. ऐसे किसी भी मामले के संबंध में
जिसकी व्यवस्था इस अधिसूचना के तहत नहीं की गई है , विशेष बांड भारतीय प्रतिभूति अधिनियम , 2006 तथा उसके अंतर्गत बनाए गए सरकारी प्रतिभूति विनियम, 2007 के उपबंधों के अंतर्गत नियंत्रित किए जाएंगे ।
9. कर कानून की प्रयोज्यता. विशेष बांडों में निवेश का मूल्य और उस पर देय ब्याज समय- समय पर लागू कर कानूनों के उपबंधों द्वारा शासित किए जाएंगे ।
10. बांडों की पात्रता. बैंकों द्वारा विशेष बांडों में निवेश को बैंकों और बीमा कंपनियों द्वारा उनकी सांविधिक अपेक्षाओं के अनुसार सरकारी प्रतिभूतियों में पात्र निवेश नहीं माना जाएगा । लेकिन, बीमा कंपनियों द्वारा ऐसे निवेश को बीमा विनियामक एवं विकास प्राधिकरण ( निवेश ) विनियम , 2000 के तहत यथा परिभाषित " अन्य अनुमोदित प्रतिभूतियां" की श्रेणी के तहत निवेश माना जाएगा । इसके अलावा, भविष्य निधियों, उपादान निधियों , अधिवर्षिता निधियों आदि द्वारा विशेष बांडों में निवेश को वित्त मंत्रालय के प्रशासनिक आदेश के अधीन पात्र निवेश के रूप में माना जाएगा ।
11. रिपो के लिए पात्रता. विशेष बांड हस्तान्तरणीय होंगे और बाजार के तत्काल वायदा लेन - देन ( रिपो ) के लिए पात्र होंगे । लेकिन , इन बांडों को भारतीय रिजर्व बैंक के साथ तत्काल वायदा लेन- देन ( रिपो/रिवर्स रिपो ) के लिए पात्र आधारित प्रतिभूति नहीं माना जाएगा ।

Issue of ' 8.30 per cent Fertilizer Companies ' Govern- ment of India Special Bonds , 2023 '
F. No. 4 (8)-W & M/2007.-Government of India hereby notifies the issue of ' 8.30 per cent Fertilizer Compa- niesGovernment of India Special Bonds , 2023' , ( hereinaf- ter briefly described as " Special Bonds " ) for an aggregate amount of Rs.3,890 crore ( nominal) on December 7 , 2007 .
1. Eligibility for making subscription to the Special Bonds and limits of subscription .-The companies as re- ferred to in the Annex I hereto shall be eligible to sub- scribe to the Special Bonds and their subscription to the Special Bonds shall be limited to the extent of the amount , as shown against their respective names in the said Annex 1. No other person including any bank, company , corporation or any other body, except the coinpanies as referred to in the aforesaid Annex, shall be eligible to sub- scribe to the Special Bonds .
2. Price.--The Special Bonds shall be issued on application at par for the amounts as per the application made by the eligible companies . The Special Bonds will be issued for a minimum amount of Rs . 10,000 (Nominal) and in multiples of Rs . 10,000 thereafter .
3. Application . The Special Bonds shall be issued on application as per proforma in Annex II , from the eli- giblecompanies.
4. Form of Security. The Special Bonds will be issued in the form of stock , i.e. ' Stock Certificates ' or by creditto Constituent Subsidiary General Ledger Account maintained with Subsidiary General Ledger Account holder .
5. Commencement of tenure and date of repay- ment . The tenure of Special Bonds will commence from December 7 , 2007. Interest on the Special Bonds will accrue from the date of commencement of tenure . The SpecialBonds will be repaid at par on December 7 , 2023 at Public Debt Office , Reserve Bank of India, Mumbai .
6. Interest .- The Special Bonds will bear interestat the rate of 8.30 per cent per annum . Interest will be reck- oned from the date of commencement of tenure of the Special Bonds and will be payable half yearly on June 7 and December 7 till maturity of the Special Bonds .
Interest on the Special Bonds will be payable at Public Debt Office , Reserve Bank of India , Fort, Mumbai . Interest will be paid after rounding off the amount of interest to the nearest rupee .
7. Transferability.( i ) Subject to the provisions of paragraph 4 of the notification , the Special Bonds can be renewed, sub -divided , consolidated, converted and trans- ferred by the holder in accordance with the provisions of the Government Securities Act, 2006 and Government Securities Regulations , 2007 framed thereunder .
( ii) Notwithstanding what is stated in paragraph 1 hereinabove , there will be no restriction on the transfer of the Special Bonds by the subscribers in favour of any other person including banks, corporation or any other body and the transferee of such security would also be entitled to hold and transfer the same in such manner .
8. Statutory Provisions . With respect to any such matter which has not been provided under this Notifica- tion , the Special Bonds shall be governed by the Govern- ment Securities Act, 2006 and Government Securities Regu- lations , 2007framed thereunder.
9. Applicability of Tax Law . The value of the in- vestment in the Special Bonds and the interest payable thereon will be governed by the provisions of tax laws as applicable from time to time .
10. Eligibility of Bonds . Investment in the Special Bonds by the banks will not be reckoned as an eligible Investment in Government securities by banks and insur- ance companies for their statutory requirements .However, such investment by the insurance companies will be eli- gible tobe reckoned as investment under " other Approved Securities" category as defined under Insurance Regula- tory and Development Authority ( Investment) Regulations, 2000. Further , the investment by the Provident Funds , Gra- tuity Funds , Superannuation Funds , etc. in the Special Bonds will be treated as an eligible investment under the administrative order of the Ministry of Finance .
11. Eligibility for Repo -- The Special Bonds will be transferable and eligible for market ready forward transac- tions (Repo) . The bonds , however, will not be an eligible underlying security for ready forward transactions (Repo/ reverse Repo) with the Reserve Bank of India .
