का.आ. 2171 ( अ ). राजमार्ग प्रशासन नियम, 2003 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप जिसे केन्द्रीय सरकार राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात ) अधिनियम , 2002 ( 2003 का 13 ) की धारा 50 की उप- धारा ( 2 ) के खंड ( घ ) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है , भारत सरकार के पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय सड़क परिवहन और राजमार्ग विभाग की अधिसूचना सं. का.आ. 662 ( अ) , तारीख 26 अप्रैल, 2007 द्वारा भारत के राजपत्र , असाधारण, भाग II , खंड 3 , उप-खंड ( ii ) , तारीख 26 अप्रैल , 2007 में प्रकाशित किया गया था जिसमें ऐसे सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना है, उस तारीख से जिसको भारत के राजपत्र में यथा प्रकाशित उक्त अधिसूचना की प्रतियां जनता को उपलब्ध करा दी गई थी , तीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और ऐसे प्रारूप नियमों के संबंध में उक्त अधिसूचना में विनिर्दिष्ट समयावधि के भीतर किसी व्यक्ति से कोई आक्षेप या सुझाव प्राप्त नहीं हुआ है;
अतः अब केन्द्रीय सरकार उक्त राष्ट्रीय राजमार्ग नियंत्रण ( भूमि और यातायात ) अधिनियम की धारा 50 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों प्रयोग करते हुए निम्नलिखित नियम बनाती है , अर्थात्:--
1. ( 1 ) इन नियमों का संक्षिप्त नाम राजमार्ग प्रशासन (संशोधन ) नियम , 2007 है ।
( 2 ) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे,।
2. राजमार्ग प्रशासन नियम , 2003 के नियम 21 के उप- नियम (2 ) के स्थान पर निम्नलिखित उप- नियम रखा जाएगा , अर्थात्:-
"(2) उप - नियम ( 1 ) के अधीन आवेदन करने वाला व्यक्ति,-
( क ) यान की मुक्ति के लिए रजिस्ट्रीकरण प्रमाणपत्र , कर रसीद या ऐसा कोई अन्य दस्तावेजी साक्ष्य पेश करेगा जो ऐसे यान का उसका स्वामित्व साबित करता हो;
(ख ) पशु की मुक्ति के लिए उसकी विशिष्टियों के ब्यौरे देगा या ऐसे पशु का अपना स्वामित्व साबित करने के लिए राजमार्ग प्रशासन के समाधानप्रद रूप में कोई अन्य मौखिक या दस्तावेजी साक्ष्य पेश करेगा । " ।

NOTIFICATION
NewDelhi , the 24th December, 2007
S.O. 2171 (E ) . Whereas thedraft of certain rules further to amend the Highways Administration Rules , 2003 which the Central Government proposes to make , in exercise of the powers conferred by sub -section ( 1) read with clause (s) ofsub - section (2) of Section 50 of the Control of National Highways (Land and Traffic) Act , 2002 ( 13 of 2003) , was published vide notification of the Government of India in the Ministry of Shipping , Road Transport and Highways , Department of Road Transport and Highways number S.O. 662(E) , dated the 26th April , 2007, in the Gazette of India , Extraordinary, Part - II , Section- 3 , Sub- section ( ii) , dated the 26th April, 2007 ; inviting objections and suggestion from all person likely to be affected thereby, before the expiry of a period of thirty days from the date on which copics of said notification, as published in the Gazette of India , were made available to the public;
And whereas no objection or suggestion has been received from any person with respect to such draft rules withinthe time period specified in the said notification;
Now, therefore, in exercise of the powers conferred by sub- section (1) ofSection 50 of the said Control of National Highways (Land and Traffic ) Act, the Central Government hereby makes the following rules , namely :----
1. (1) These rules maybe called the Highway Administration (Amendment ) Rules , 2007 .
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Highways Administration Rules, 2003 , in rule 21 , for sub- rule (2) , the following sub - rule shall be substituted, namely:--
"(2) The person making an application under sub -rule ( 1 ) shall--
(a) for release ofthe vehicle , produce certificate of registration, tax receipt or any other documentary evidence which proves his ownership of such vehicle;
(b) for release of the animal , give its detailed description or produce any other oral or documentary evidence for proving his ownership of such animal , to the satisfaction of the Highway Administration.
