सा.का.नि. 6(अ). दिल्ली विकास ( विविध ) नियम , 1959 के नियम 4 के उप - नियम 3 के साथ पठित दिल्ली विकास अधिनियम , 1957 ( 1957 का 61 ) की धारा 57 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, दिल्ली विकास प्राधिकरण, केन्द्र सरकार के पूर्व अनुमोदन से एतद्वारा दिल्ली विकास प्राधिकरण में निदेशक ( लिपिकवर्गीय ) के पद की भर्ती पद्धति को नियमित करने वाले निम्नलिखित विनियम बनाता है अर्थात्:--
1. संक्षिप्त नाम और प्रारम्भन.-( i ) इन विनियमों को , नीचे दी गई अनुसूची के अनुसार, निदेशक ( लिपिकवर्गीय ) , दिल्ली विकास प्राधिकरण के " भर्ती विनियम 2007 " कहा जाएगा ।
( ii ) ये विनियम दिल्ली विकास प्राधिकरण द्वारा उनके अनुमोदन की तिथि से प्रभावी होंगे ।
2. अनर्हता. कोई भी व्यक्ति-
( क ) जिसने किसी ऐसे व्यक्ति से विवाह किया है अथवा विवाह करने का अनुबंध किया है , जिसकी पत्नी/पति जीवित है, अथवा
( ख ) जिसने अपने पति/पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है अथवा विवाह करने का अनुबंध किया है , वह उक्त किसी पद पर नियुक्ति हेतु पात्र नहीं होगा :
बशर्ते कि केन्द्रीय सरकार , यदि इस बात से संतुष्ट हो कि ऐसा विवाह ऐसे व्यक्ति और विवाह किए जाने वाले अन्य व्यक्ति के लिए लागू व्यक्तिगत कानून के अन्तर्गत अनुमेय है तथा ऐसा करने के लिए अन्य आधार भी हैं, तो वह इन नियमों के प्रवर्तन से उस व्यक्ति को छूट दे सकती है ।
3. शिथिल करने की शक्ति. यदि अध्यक्ष, दिल्ली विकास प्राधिकरण की यह राय हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वे लिखित में दर्ज किए जाने वाले कारणों से, किसी श्रेणी अथवा वर्ग अथवा व्यक्ति अथवा पदों के संबंध में इन नियमों के किसी उपबंध को आदेश द्वारा शिथिल कर सकते हैं ।
4. बचाव. इन नियमों में ऐसा कुछ नहीं है , जिससे इस संबंध में केन्द्रीय सरकार/ दिल्ली विकास प्राधिकरण द्वारा समय - समय पर जारी आदेशों के अनुसार अनुसूचित जाति , अनुसूचित जन जाति, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष वर्गों के व्यक्तियों को दिए जाने वाले आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रतिकूल प्रभाव पड़े ।

9. परित्रीक्षा की अवधि
:
(1 ) 50 % पदोन्नति द्वारा जिसके न होने पर प्रतिनियुक्ति द्वारा । (ii) 50 % प्रतिनियुक्ति पर स्थानान्तरण द्वारा ।
10. भर्ती की पद्धति--सीधी भर्ती अथवा पदोन्नति अथवा प्रतिनियुक्ति पर अथवा स्थानान्तरण द्वारा और विभिन्न पद्धतियां द्वारा भनी जाने वाली रिक्तियों की प्रतिशतता ।

11. यदि भर्ती पदान्नति स्थानान्तरण/ प्रतिनियुक्ति से होती है, तो ग्रंड जिससे पदोन्नति की जानी है
( i ) पदोन्नति हेतु : 10000-15200 रु. के वेतनमान में उपनिदेशक/संयुक्त निदेशक/ समकक्ष पद के उप सचिव जो उस कैडर ग्रेड में न्यूनतम पांच वर्ष की नियमित सेवा तथा मान्यता प्राप्त विश्वविद्यालय की डिग्री रखते हों या समकक्ष ।
(ii ) प्रतिनियुक्ति पर स्थानान्तरण केन्द्र रूय सरकार के अधि- कारी , जां सदृश पद पर कार्यरत हां अथवा ऐसे अधिकारी , जिनकी 10000-15200 रुपये के वेतनमान में पांच वर्ष की सेवा हो ।

New Delhi , the 2nd January, 2008
G.S.R. 6( E) . In exercise of the powers conferred by Section 57 of the Delhi Development Act. 1957 ( 61 of 1957 ) read with sub - rule 3 of Rule 4 of the Delhi Development (Miscellaneous ) Rules, 1959, the Delhi Development Authority, hereby makes , with the previous approval ofthe Central Government, the following Regulations regulating to the method of recruitment to the post of Director (Ministerial) in the Delhi Development Authority namely :-
1. Short title and commencement .-( i ) These regulations as given in the schedule placed below may he called the "Recruitment Regulations " of Director (Ministerial ) Delhi Development Authority , 2007.
(ii) These regulations shall come into force with effect from the date of their approval by the Delhi Development Authority.
2. Disqualification. No person , (a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who having a spouse living , has entered into or contracted a marriage with any person shall be eligible for appointment to any of the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing . exempt any person from the operation of this Rule .
3. Power to relax . Where the Chairman, Delhi Development Authority . is of the opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons or posts .
4. Saving . Nothing in these rules shall affect reservation, relaxation of age limit and other concession required to be provided for the Scheduled Castes , the Scheduled Tribes , the other backward classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

NOTIFICATION प्रतिनियुक्ति: कंन्द्र राज्य सरकार के अधिकारी , जो सदृश पद पर कार्यरत हा अथवा ऐसे अधिकारी जिन्दकी 8000-13,500 रुपये के वेतनमान में पांच वर्ष की सेवा हो अथवा ऐसे अधिकारी जिनकी 6500-10.500 रुपये के वेतनमान में आठ वर्ष की संत्रा हो !
