का.आ. 45( अ ).-केन्द्रीय सरकार ने , कीटनाशी अधिनियम , 1968 (1968 का 46 ) की धारा 27 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) की अधिसूचना सं. का.आ. 1687 (अ ) , तारीख 1 अक्तूबर , 2007 द्वारा घरेलू उपयोग के सिवाय कृषि में डियाजिनोन के उपयोग की पाबंदी के लिए प्रारूप आदेश प्रकाशित किया गया था , जिसमें उन सभी व्यक्तियों से , जिनके उससे प्रभावित होने की संभावना है , उस तारीख से, जिसको उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे :
और, उक्त राजपत्र की प्रतियां, 1 अक्तूबर, 2007 को जनता को उपलब्ध करा दी गई थीं;
और , उक्त प्रारूप आदेश के संबंध में जनता से कोई आक्षेप और सुझाव प्राप्त नहीं हुए हैं ।
अतः , अब , केन्द्रीय सरकार, कीटनाशी अधिनियम, 1968 (1968 का 46) की धारा 28 के साथ पठित धारा 27 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करती है , अर्थात्: -
आदेश
1. ( 1 ) इस आदेश का संक्षिप्त नाम डियाजिनोन के प्रयोग पर निबंधन आदेश , 2007 है ।
(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
2. ( 1 ) कोई व्यक्ति डियाजिनोन का घरेलू उपयोग सिवाय कृषि में उपयोग नहीं करेगा ।
` (2) रजिस्ट्रीकरण प्रमाणपत्र के सभी धारक , लेबलों और पत्रकों पर स्पष्ट अक्षरों में " कृषि उपयोग पर पाबंदी " कीचेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण प्रमाणपत्र रजिस्ट्रीकरण समिति को वापस करेंगे ।
(3 ) यदि कोई व्यक्ति , जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, खंड ( 2 ) में निर्दिष्ट रजिस्ट्रीकरण समिति को, छह मास की अवधि के भीतर प्रमाणपत्र लौटाने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण प्रमाणपत्र का नवीकरण नहीं किया जाएगा या उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।
3. प्रत्येक राज्य सरकार , उक्त अधिनियम के उपबंधों और उसके अधीन बनाए गए नियमों के अधीन ऐसे उपाय करेगी , जो इस आदेश के निष्पादन के लिए वह आवश्यक समझे ।

जिनके उससे प्रभावित होने की संभावना है , उस तारीख से, जिसको उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं , पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे :
और, उक्त राजपत्र की प्रतियां, 1 अक्तूबर , 2007 को जनता को उपलब्ध करा दी गई थीं;
the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation ) number S.O. 1687 (E) dated the 1st October , 2007 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
और, उक्त प्रारूप आदेश के संबंध में जनता से कोई आक्षेप और सुझाव प्राप्त नहीं हुए हैं ।
And whereas , copies of the said Gazette were made available to the public on the 1st day of October , 2007;
And whereas , no objections and suggestions were received from the public in respect of the said draft Order ;
अतः , अब , केन्द्रीय सरकार , कीटनाशी अधिनियम , 1968 (1968 का 46 ) की धारा 28 के साथ पठित धारा 27 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करती है , अर्थात्: -

Now, therefore , in exercise of the powers conferred by sub - section ( 2 ) of Section 27 read with Section 28 of the Insecticides Act , 1968 (46 of 1968 ), the Central Government hereby makes the following Order, namely : --
ORDER
1. ( 1 ) इस आदेश का संक्षिप्त नाम फेन्थीओन के उपयोग पर निर्बंधन आदेश, 2007 है ।
1. ( 1) This Order may be called the Restriction on Use of Diazinon Order , 2007 .
(2 ) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
(2) It shall come into force on the date of its publication in the Official Gazette .
2. ( 1 ) No person shall use Diazinon in agriculture except for household use .
2. ( 1 ) कोई व्यक्ति फेन्थीओन का टिड्डी नियंत्रण , घरेलू और लोक स्वास्थ्य में उपयोग के सिवाय कृषि में उपयोग नहीं करेगा ।
(2) All the holders of certificate of registration shall return the certificate of registration to the Registration Committee for incorporation of the warning in bold letters "Banned for use on Agriculture " on labels and leaflets .
( 2 ) रजिस्ट्रीकरण प्रमाणपत्र के सभी धारक, लेबलों और पत्रकों पर स्पष्ट अक्षरों में " कृषि उपयोग पर पाबंदी " कीचेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण प्रमाणपत्र रजिस्ट्रीकरण समिति को वापस करेंगे ।
(3) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee , referred to in clause(2), within a period of six months , the certificate of registration granted to them shall not be renewed or action shall be taken under Section 14 of the said Act.
( 3 ) यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है , खंड ( 2 ) में निर्दिष्ट रजिस्ट्रीकरण समिति को, छह मास की अवधि के भीतर प्रमाणपत्र लौटाने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण प्रमाणपत्र का नवीकरण नहीं किया जाएगा या उक्त अधिनियम की धारा 14 के अधीन कार्रवाई की जाएगी ।
3. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State .
3. प्रत्येक राज्य सरकार , उक्त अधिनियम के उपबंधों और उसके अधीन बनाए गए नियमों के अधीन ऐसे उपाय करेगी , जो इस आदेश के निष्पादन के लिए वह आवश्यक समझे ।

Whereas , the Central Government, in exercise of the powers conferred by sub - section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968 ) , published a draft Order to withdraw the use of Fenthion in Agriculture except for locust control , household and public health vide notification of the Government of India in the Ministry of Agriculture ( Department of Agriculture का.आ. 46( अ ).-केन्द्रीय सरकार ने , कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 27 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) की अधिसूचना सं. का.आ. 1688 ( अ ) , तारीख 1 अक्तूबर , 2007 द्वारा टिड्डी नियंत्रण , घरेलू और लोक स्वास्थ्य के सिवाय कृषि में फेन्थीओन के उपयोग की पाबंदी का प्रारूप आदेश प्रकाशित किया गया था , जिसमें उन सभी व्यक्तियों से , 3

Andwhereas , copies of the said Gazette were made available to the public on the 1st day of October, 2007;
और, उक्त प्रारूप आदेश के संबंध में जनता से कोई आक्षेप और सुझाव प्राप्त नहीं हुए हैं ।
अतः , अब , केन्द्रीय सरकार, कीटनाशी अधिनियम , 1968 (1968 का 46 ) की धारा 28 के साथ पठित धारा 27 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करती है , अर्थात्: -
And whereas , no objections and suggestions were received from the public in respect ofthe said draft Order; Now, therefore, in exercise of the powers conferred by sub -section (2) of Section 27 read with Section 28 ofthe Insecticides Act, 1968 (46 of 1968) , the Central Government hereby makes the following Order, namely:-

ORDER
1. (1 ) This Order may be called the Restriction on Use of Fenthion Order, 2007 .
1. ( 1 ) इस आदेश का संक्षिप्त नाम मैटाजिरोन की वापसी आदेश, 2007 है ।
(2 ) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।
(2) It shall come into force on the date of its publication in the Official Gazette.
2. ( 1) No person shall use Fenthion in agriculture except for locust control , household and public health.
(3) रजिस्ट्रीकरण समिति, सभी रजिस्ट्रीकृत व्यक्तियों से , जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं , मैटाजिरोन के लिए अनुदत्त रजिस्ट्रीकरण प्रमाणपत्रों को वापस ले लेगी ।
(2) All the holders of certificate of registration shall return the certificate of registration to the Registration Committee for incorporation of the warning in bold letters " Banned for use on Agriculture" on labels and leaflets .

Andwhereas , copies of the said Gazette were made available to the public on the 1st day of October , 2007;
And whereas , no objections and suggestions were
received from the public in respect of the said draft Order ;
Now, therefore , in exercise of the powers conferred by sub- section (2) of Section 27 read with Section 28 ofthe Insecticides Act , 1968 (46 of 1968 ) , the Central Government hereby makes the following Order , namely:--
ORDER
1. (1) This Order may be called the Withdrawal of Metoxuron Order, 2007 .
(2) It shall come into force on the date of its publication in the Official Gazette .
(3) The Registration Committee shall call back the certificates of registration granted for

Metoxuron from all registrants including new registrants .
(4) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee , referred to in clause (3 ) , within a period of six months action shall be taken under Section 14 of the said Act.
2. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State .
