का.आ. 48( अ ). केन्द्रीय सरकार पर्यावरण ( संरक्षण) अधिनियम, 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार की अधिसूचना संख्यांक का.आ. 1533 ( अ ) तारीख 14 सितम्बर, 2006 के अनुसरण में राज्य स्तरीय पर्यावरण प्रभाव निर्धारण प्राधिकरण, जम्मूएवं कश्मीर (जिसे इसमें इसके पश्चात् प्राधिकरण , जम्मू एवं कश्मीर कहा गया है ) का गठन करती है जिसमें जम्मू एवं कश्मीर सरकार द्वारा नाम निर्देशित तीन सदस्य अर्थात् अध्यक्ष , सदस्य और सदस्य- सचिव समाविष्ट होंगे, जो निम्नलिखित हैं :-

2. अध्यक्ष और सदस्यों की पदावधि इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी ।
3. प्राधिकरण , जम्मू और कश्मीर ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रक्रियाओं का अनुसरण करेगा जो अधिसूचना संख्यांक का.आ. 1533 ( अ ) , तारीख 14 सितम्बर, 2006 में दी गई है ।
4. प्राधिकरण , जम्मूऔर कश्मीर इस आदेश में जम्मूऔर कश्मीर सरकार के लिए गठित राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति (एस ई एसी ) की सिफारिशों के आधार पर अपने निर्णय देगी ।
5. जम्मूऔर कश्मीर राज्य सरकार प्राधिकरण के सचिवालय के रूप में कार्य करने के लिए अधिकरण को अधिसूचित करेगा और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत स्थान सुविधा , परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवाएगी । प्राधिकरण के अध्यक्ष और सदस्य को बैठक फीस , यात्रा भत्ता/मंहगाई भत्ता जम्मूऔर कश्मीर सरकार द्वारा नियमानुसार संदत्त होगा ।
6. उक्त प्राधिकरण की सहायता के लिए केन्द्रीय सरकार जम्मू और कश्मीर राज्य सरकार से परामर्श करके राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति, जम्मूऔर कश्मीर का गठन करती है ( जिसे इसमें इसके पश्चात् एस ई ए सी कहा गया है ) जिसमें निम्नलिखित सदस्य समाविष्ट होंगे:-

S. O. 48(E) . In exercise of the powers conferred by sub- section ( 3 ) of Section 3 of the Environment ( Protection) Act, 1986 (29 of 1986) and in pursuance of the Government of India notification number S.O : 1533 ( E) dated the 14th September , 2006 , the Central Government hereby constitutes the State Level Environment Impact Assessment Authority ( SEIAA ) , Jammu and Kashmir (hereinafter referred to as the Authority , Jammu & Kashmir) comprising ofthree members namely , Chairman , Member and Member- Secretary nominated by the State Government ofJammu & Kashmir as under :-

7. अध्यक्ष और सदस्यों की पदावधि, इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी और एस ई ए सी, जम्मूऔर कश्मीर का प्रत्येक तीन वर्ष के पश्चात् पुर्नगठन किया जाएगा ।
2. The Chairman and Members shall have the term of three years from the date of publication of this notification in the Official Gazette .
४. एस ई ए सी, जम्मू और कश्मीर ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रक्रियाओं का अनुसरण करेगी जो अधिसूचना संख्यांक का.आ. 1533 (अ ) तारीख 14 सितम्बर , 2006 में दी है ।
3. The Authority, Jammu & Kashmir shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 (E) dated the 14thSeptember, 2006 .
4. The Authority , Jammu & Kashmir shall base its decision on the recommendations of the State Level Expert Appraisal Committee ( SEAC) constituted for the State of Jammu & Kashmir in this order .
9. एस ई ए सी, जम्मू और कश्मीर सामूहिक दायित्व के सिद्धांत पर काम करेगी । अध्यक्ष , प्रत्येक मामले में एकमत होने का प्रयास करेगा और यदि एकमत नहीं हो सकता तो बहुमत का विचार अभिभावी होगा ।
5. The State Government of Jammu & Kashmir shall notify the agency to act as secretariat for the Authority and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect of all its statutory functions . Sitting fee , Travelling Allowance/ Dearness Allowance to the Chairman and Member of the Authority shall be paid by the State Government of Jammu & Kashmir as per State rules .
10. जम्मू और कश्मीर राज्य सरकार , एस ई ए सी जम्मू और कश्मीर के सचिवालय के रूप में कार्य करने वाले अभिकरण को अधि सूचित करेगी और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत स्थान सुविधा, परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवायेगी । एस ई ए सी के अध्यक्ष और सदस्योंको बैठक फीस, यात्रा भत्ता/महंगाई जम्मूऔर कश्मीर राज्य सरकार द्वारा राज्य के नियमों के अनुसार संदत्त किया जाएगा ।

6. To assist the said Authority , the Central Government , in consultation with the State Government ofJammu & Kashmir , hereby constitutes the State Level

7. The Chairman and Members shall have the term of three years from the date of publication of this notification in the Official Gazette and SEAC, Jammu and Kashmir shall be reconstituted after every three years .
8. The SEAC, Jammu and Kashmir shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 (E) dated the 14th September, 2006.
9. The SEAC, Jammu and Kashmir shall function on the principle ofcollective responsibility. The Chairperson shall endeavour to reach a consensus in each case , and if consensus cannot be reached, the view of the majority shall prevail.
10. The State Government of Jammu and Kashmir shall notify the agency to act as secretariat for the SEAC, Jammu and Kashmir and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect to all its statutory functions . Sitting fee , Travelling Allowance/Dearness Allowance, to the Chairman and Members of the SEAC shall be paidby the State Government of Jammu & Kashmir asper State rules .
