का.आ. 49( अ ) केन्द्रीय सरकार , पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) की धारा 3 की उप- धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार की अधिसूचना संख्यांक का. आ. 1533 ( अ ) तारीख 14 सितम्बर , 2006 के अनुसरण में राज्य स्तरीय पर्यावरण प्रभाव निर्धारण प्राधिकरण ( एस ई आई ए ए ) , मध्य प्रदेश ( जिसे इसमें इसके. पश्चात् प्राधिकरण , मध्य प्रदेश कहा गया है ) का गठन करती है जिसमें मध्य प्रदेश राज्य सरकार द्वारा नाम निर्देशित तीन सदस्य अर्थात् अध्यक्ष , सदस्य और सदस्य सचिव समाविष्ट होंगे , जो निम्नलिखित हैं :-

-सदस्य, 2. श्री मुहम्मद हाशिम , भा.व.से.
वानिकी और (सेवानिवृत ) गांव सिंगरचौली , गुलमोहर मैरिज हाल के पीछे , एयरपोर्ट रोड, वन्यजीव भोपाल ( मध्य प्रदेश )
3. कार्यकारी निदेशक, पर्यावरणीय योजना -सदस्य- सचिव समन्वय संगठन भोपाल , पूर्व- पदेन सचिव, आवास और पर्यावरण विभाग मध्य प्रदेश सरकार
2. अध्यक्ष और सदस्योंकी पदावधि इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीन वर्ष होगी ।
3. प्राधिकरण , मध्य प्रदेश ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रक्रियाओं का अनुसरण करेगा जो अधिसूचना संख्याक का.आ. 1533 (अ ) , तारीख 14 सितम्बर, 2006 में दी गई है ।
4. प्राधिकरण मध्य प्रदेश इस आदेश में मध्य प्रदेश सरकार के लिए गठित राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति ( एस ई एसी) की सिफारिशों के आधार पर अपने निर्णय देगी ।
5. मध्य प्रदेश राज्य सरकार अभिकरण को प्राधिकरण के सचिवालय के रूप में कार्य करने के लिए अधिसूचित करेगी और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत आवास सुविधा , परिवहन , और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवाएगी । प्राधिकरण के अध्यक्ष और सदस्य को बैठक फीस, यात्रा भत्ता/मंहगाई भत्ता मध्य प्रदेश सरकार द्वारा नियमानुसार संदत्त होगा ।

9. एस ई ए सी, मध्य प्रदेश सामूहिक दायित्व के सिद्धांत पर काम करेगी । अध्यक्ष , प्रत्येक मामले में एकमत होने का प्रयास करेगा और यदि एकमत नहीं हो सकता तो बहुमत का विचार अभिभावी होगा ।
6. उक्त प्राधिकरण की सहायता के लिए केन्द्रीय सरकार मध्य प्रदेश राज्य सरकार से परामर्श करके राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति, मध्य प्रदेश का गठन करती है ( जिसे इसमें इसके पश्चात् एस ई ए सी कहा गया है ) जिसमें निम्नलिखित सदस्य समाविष्ट होंगे :

10. मध्य प्रदेश राज्य सरकार , अभिकरण को एस ई एसी, मध्य प्रदेश के सचिवालय के रूप में कार्य करने के लिए अधिसूचित करेगा और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत स्थान सुविधा , परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवायेगी । एस ई एसी के अध्यक्ष और सदस्यों को बैठक फीस , यात्रा भत्ता/महंगाई भत्ता मध्य प्रदेश सरकार द्वारा राज्य के निःगों के अनुसार संदत्त किया जाएगा ।

S.O. 49(E) . In exercise ofthe powers conferred by sub - section (3 ) of Section 3 of the Environment ( Pro- tection) Act , 1986 (29 of 1986 ) and in pursuance of the Government of India notification number S.O. 1533 (E) dated the 14th September , 2006 , the Central Government hereby constitutes the State Level Environment Impact Assess- ment Authority ( SEIAA) , Madhya Pradesh (hereinafter referred to as the Authority, Madhya Pradesh) comprising ofthree members namely , Chairman , Member and Member Secretary nominated by the State Government of Madhya Pradesh as under:--

8. एस ई एसी , मध्य प्रदेश ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रक्रियाओं का अनुसरण करेगी जो अधिसूचना संख्यांक का.आ. 1533 ( अ ) तारीख 14 सितम्बर , 2006 में दी है ।
2. The Chairman and Members shall have the term ofthree years from the date of publication of this notifica- tion in the Official Gazette .

3. The Authority, Madhya Pradesh shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 (E) dated the 14th September , 2006 .
4. The Authority, Madhya Pradesh shall base its decision on the recommendations ofthe State Level Expert Appraisal Committee ( SEAC) constituted for the State of Madhya Pradesh in this order.
5. The State Government of Madhya Pradesh shall notify the agency to act as secretariat for the Authority and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions . Sitting Fee, Travelling Allowance/Dearness Allowance to the Chairman and Member of the Authority shall be paid by the State Government of Madhya Pradesh as per State rules .
6. To assist the said Authority, the Central Govern- ment, in consultation with the State Government ofMadhya Pradesh, hereby constitutes the State Level Expert Appraisal Committee , Madhya Pradesh (hereinafter referred to as SEAC) , which shall comprise the following Members :

7. The Chairman and Members shall have the term of three years from the date ofpublication of this notification inthe Official Gazette and SEAC, Madhya Pradesh shall be reconstituted after every three years .
8. The SEAC , Madhya Pradesh shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533 (E ) dated the 14th September , 2006.
9. The SEAC, Madhya Pradesh shall function on the principle of collective responsibility . The Chairperson shall endeavour to reach a consensus in each case , and if con- sensus cannot be reached, the view of the majority shall prevail.
10. The State Government of Madhya Pradesh shall notifythe agency to act as secretariat for the SEAC, Madhya Pradesh and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect to all its statutory functions . Sitting Fee, Travelling Allowance/Dearness Allowance , to the Chairman and Members of the SEAC shall be paid by the State Government of Madhya Pradesh as per State rules .
