सा.का.नि. 19( अ )-केन्द्र सरकार, वायुयान अधिनियम, 1934 ( 1934 का 22 ) , की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियम , 1937 , का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , नामशः :-
1. ( 1) इन नियमों को वायुयान ( द्वितीय संशोधन ) नियम, 2007 कहा जाएगा ।
(2) ये सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. वायुयान नियम, 1937 , में अनुसूची II में,-
(i ) अनुभाग ज, पैरा 1 में, खंड ( ड. ) के परन्तुक के लिए, निम्नलिखित परन्तुक प्रतिस्थापित किया जाएगा, नामशः :-
" बशर्ते कि आवेदक जो वाणिज्यिक पायलट लाइसेंस ( हेलीकाप्टर ) /एयरलाइन परिवहन पायलट लाइसेंस ( हेलीकाप्टर ) का धारक है और जिसने हेलीकाप्टर के कमान पायलट के रूप में 1000 घंटे से अन्यून का उड़ान काल संतोषप्रद रूप से पूरा किया है , के लिए एक विमान के पायलट के रूप में उक्त दो सौ घंटे का अपेक्षित अनुभव कम करके एक सौ घंटे किया जाएगा , जिसमें सम्मिलित होगा-
(i) कमान पायलट के रूप में 75 घंटे से अन्यून का उड़ान समय जिसमें कम से कम 25 घंटे का देश के आर- पार का उड़ान काल और दस घंटे का उपकरण काल सम्मिलित है जिसमें पांच घंटों का अन्यून काल अनुमोदित सिमुलेटर पर होसकता है;
(ii) पांच घंटों से अन्यून काल रात्रि में उड़ान काल जिसमें दस उड़ान भरना एवं अवतरण सम्मिलित होंगे; और
(iii) लाइसेंस जारी करने के लिए आवेदन की तारीख से ठीक पूर्व छः मास की अवधि के भीतर विमान पर दस घंटे से अन्यून का उड़ान समय " ।

टिप्पण:-( 1 ) मूल नियम राजपत्र में अधिसूचना संख्या वी-26 , तारीख 23 मार्च, 1937 द्वारा प्रकाशित किए गए थे और अंतिम संशोधन भारत के राजपत्र के भाग II , खंड ( 3 ) , उप - खंड ( i ) में प्रकाशित सा.का.नि. 232 ( अ ) , तारीख 24 मार्च , 2007 द्वारा किया गया ।
(2) केन्द्र सरकार ने वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 14 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए नागर विमानन मंत्रालय द्वारा जारी तारीख 7 दिसम्बर, 2007 के अपने आदेश सं. ए.वी. 11012/ 11 /2005 - ए द्वारा इस अधिसूचना के मामले में पूर्व प्रकाशन की शर्तों से जनहित में छूट दी है ।

NOTIFICATION
New Delhi , the 27th December , 2007
G.S.R. 19(E ) . In exercise of the powers conferred by Section 5 of the Aircraft Act , 1934 (22 of 1934) , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937, namely:--
1. (1) These rules may be called the Aircraft (Second Amendment) Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules , 1937, in Schedule II,-
(i) In Section J , in paragraph 1 , for the proviso to clause (e ), the following proviso shall be substituted , namely :-
"Provided that in case of an applicant who is in possession of a Commercial Pilot's Licence (Helicopters ) /Airline Transport Pilot's Licence (Helicopters) and who has satisfactorily completed not less than 1000 hours of flight time as Pilot- in-Command of a helicopter , the above experience requirement of two hundred hours as pilot of an aeroplane shall be reduced to one hundred hours , which shall include-
(i) Not less than seventy five hours of flight time as pilot- in -command including a

minimum of twentynty five hours of cross country flight time and ten hours of instrument time of which not less than five hours may be on approved simulator ;
(ii) Not less than five hours of flight time by night including ten take off and landing patterns; and
(iii) Not less than ten hours of flight time on aeroplane within a period of six months immediately preceding the date of application for issue of licence . "

Notes : ( 1 ) The principal rules were published in the Official Gazette vide notification number V-26, dated the 23rd March, 1937 and last amended by G. S. R. 232 (E) dated 24thMarch, 2007 published in Part II , Section 3 , Sub- section (i) of the Gazette of India .
(2) The Central Government in exercise of the powers conferred by proviso to Section 14 of the Aircraft Act , 1934 (22 of 1934 ) has in the public interest dispensed with the condition of previous publication in case of the notification vide its order No. A.V. 11 012/ 11 / 2005 -A dated 7th December, 2007 issued in theMinistry of Civil Aviation .
