का.. 80(अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क खंड़) की अधिसूचना संख्यांक का.आ. 78 (अ) , तारीख 4 फरवरी 1999, द्वारा राष्ट्रीय राजमार्ग सं. 24 के 27.60 कि.मी. से 59.000 कि.मी. तक के भूखंड ( गाजियाबाद हापुड खंड जिसके अंतर्गत हापुड बाईपास 'श्री है ) को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा था ।
अतः, अब, केन्द्रीय सरकार राष्ट्रीय राजमार्ग (राष्ट्रीय राजमार्ग सेक्शन और स्थायी पुल-लोक वित्तपोषित परियोजना के उपयोग के लिए फीस) नियम, 1997 के नियम 3, नियम 5 और नियम 11 और राष्ट्रीय राजमार्ग (फीस की दर) नियम, 1997 के नियम 3 के उपनियम (2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 4.3) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्यांक का.आ. 364(अ) को , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हे ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, यह अधिसूचित करती है कि उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 24 के 27.643 कि.मी. से 48.638 कि.मी. ( गाजियाबाद हापुड खंड) तक के और 11.250 कि.मी. लंबे हापुड़ बाईपास के चार लेन वाले भूखंड़ के उपयोग के लिए याँत्रिक सानों पर फीस, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वास विभागीय तौर पर या प्राइवेट ठेकेदार के माध्यम से , जो प्रतिस्पर्द्धात्मक निविदा के आधार पर नियुक्त किए जा सकेगे, इससे संलग्न अनुसूची में विनिर्दिष्ट दरों पर शाश्वत आधार पर उद्गृहीत और संगृहीत की जाएगी ।

उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 24 के 27.643 कि.मी. से 48.638 कि.मी. तक (गाजियाबाद - हापुड खंड) तक के और 11.250 कि.मी. लंबे हापुड बाईपास के चार लेन के खंड़ के उपयोक्ताओं से वसूल की जाने वाली फीस की दरें ।

1. जब एक ही यांत्रिक यान को राष्ट्रीय राजमार्ग के उक्त खण्ड को एक दिन में एक से अधिक बार पार करना हो , तो उपयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में गेट को पार करते समय अनुसूची में यथाविनिर्दिष्ट दरों पर अनेक चक्करों के लिए फीस का एक ही बार संदाय कर दे या यदि उसी यांत्रिक यान को उक्त चार लेन के खंड का पूरे मास में बार- बार प्रयोग करना हो तो यान का स्वामी उक्त अनुसूची में यथाविनिर्दिष्ट उसको लागू तीस एकल दरों के समतुल्य प्रभारों को संदाय करके मासिक पास प्राप्त कर सकता है ।
स्पष्टीकरण: - "दिन" की संगणना 24 घंटे की निरंतर अवधि के रूप में की जाएगी ।
2.निम्नलिखित प्रकार के यान अनुसूची में विनिर्दिष्ट फीस से छूट प्राप्त होगे अर्थात्ः-
(i) यान ,
(अ) जो "अति महत्वपूर्ण व्यक्ति" प्रतीक वाले या सरकारी तौर के है
(क) भारत के राष्ट्रपतिः .
(ख) भारत के उपराष्ट्रपतिः
(ग) राज्य के राज्यपाल अथवा संघ राज्य क्षेत्र के उपराज्यपाल;
(घ) भारत के शासकीय दौरे परं उच्चपदस्थ विदेशी व्यक्ति;
(ड)
" सी डी "/ " सी सी" नंबर प्लेटों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;

(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद् के सभापति अथवा राज्य विधान सभा के अध्यक्ष या संघ या राज्य के मंत्री अथवा लोक सभा या राज्य सभा अथवा राज्य विधान मंडलों में विरोधी दल के नेता, जिनका दर्जा कैबिनेट मंत्री का हो, जब वे स्वयं यान में हों, या
(छ) संसद सदस्य, संपूर्ण देश में या राज्य विधान सभा या विधान परिषद् के सदस्य, अपने-अपने राज्यों में, यदि, वह, यथास्थिति, संसद अथवा संबंधित, राज्य विधान- मंडल, द्वारा जारी पहचान पत्र प्रस्तुत करते हैं;
(आ
) शौर्य पुरस्कारों, जैसे परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र का विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक रूप से अधिप्रमाणित अपना फोटो पहचान पत्र प्रस्तुत करता है 1
(ii) रक्षा यान, जिसके अतंर्गत ऐसे यान भी हैं जो भारतीय पथकर (सेना ओर वायुसेना) अधिनियम 1901 ( 1901 का 2) और उसके अधीन बनाए गए नियमों (नौसेना के लिए भी ) के उपबन्धों के अनुसार छूट के लिए पात्र वे सभी यान शामिल है ।

iii) पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान और डयूटी पर केंद्रीय सरकार और राज्य सरकार के यान ।

फीस की दरें, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और उस प्राधिकारी का नाम, पता और टेलीफोन नंबर जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए, पथकर चौकी से 500 मीटर पहले पथकर चौकी से 100 मीटर पहले और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख स्रूप से संप्रदर्शित की जाएगी । संप्रदर्शन बोडों की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा जिससे चालक को संप्रदर्शन बोर्ड पढ़ने में आसानी हो , और उन्हें अंग्रेजी, हिंदी और उस क्षेत्र जिसमें उक्त भूखंड अवस्थित है, की प्रादेशिक भाषा में स्पष्ट रूप से लिखे या मुद्रित किए जाएंगें ।
किसी ऐसे यांत्रिक यान, से कोई फीस उदगृहीत और संगृहीत नहीं की जाएगी जो उक्त अनुसूची में सम्मिलित नहीं है ।

NOTIFICATION
New Delhi , the 9th January, 2008
S.O. 80(E) .- Whereas , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 78 (E) , dated the 4th February , 1999 , issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988) , the Central Government entrusted the stretch from km . 27.100 to km. 59.000 ( Ghaziabad Hapur Section including Hapur Bypas) of National Highway No. 24 in the State of Uttar Pradesh to the National Highways Authority of India ;
Now , therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956) , read with rules 3, 5 and 11 of the National Highways ( Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project) Rules , 1997 and sub -rule (2) of rule 3 of the National Highways (Rate of Fee) Rules , 1997 , and in supersession of the notification of the Government of India in the then Ministry of Road Transport and Highways , number S.O. 364 (E) dated the 31st March, 2003 except as respects things done or omitted to be done before such supersession , the Central Government hereby notifies that there shall be levied and collected by the National Highways Authority of India, departmentally or through private contractor who may be appointed on the basis of competitive bidding , a fee on mechanical vehicles for the use of the four - laned stretch from km . 27.643 to Km . 48.638 ( Ghaziabad Hapur Section) and Hapur bypass of 11.250 Km length of National Highway No. 24 in the State of Uttar Pradesh at the rates specified in the Schedule annexed hereto in perpetuity.

Notes: -
1. When the same mechanical vehicle has to cross the said stretch of the national highway more than once in a day , the user shall have the option to pay the fee for the multiple trips at the rates as specified in the Schedule while crossing the gate in the first trip itself or if the same mechanical vehicle has to use the said four- laned stretch frequently for the entire month , the vehicle owner may obtain a monthly pass on the payment of charges equivalent to 30 single rates applicable to it , as specified in the Schedule .
Explanation - " day" shall be counted as a continuous period of twenty- four hours
2. The following types of vehicles shall be exempted from the fee specified in the Schedule, namely: -
(i) vehicles,
(A) having "VIP" symbols , or officially belonging to
(a) the President of India;
(b) the Vice President of India;
(c) the Governor of a State or the Lt. Governor of a Union Territory;
(d) a Foreign Dignitary on State visit to India ;
(
e) a Foreign diplomat stationed in India using cars with "CD" / "CC" number plates ;
(f) the Chairman of the Rajya Sabha or the Speaker of the Lok Sabha or the Chairman of a State Legislative Council or the Speaker of a State Legislative Assembly or a Minister for the Union or a State , or Leader of Opposition in the Lok Sabha or Rajya Sabha or a State Legislature having the status of Cabinet Minister , if he is sitting in the vehicle; or
(g) a Member of Parliament , in the entire country , or a Member of the Legislative Assembly of a State or a Member of Legislative Council of a State, in the respective State, if he produces his identity card issued by the Parliament or concerned Legislature of the State , as the case may be;
(B) belonging to winner of a Gallantry award such as Param Vir Chakra, Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award ,

(ii) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act , 1901 (2 of 1901) and the rules made thereunder (as extended to Navy) ;

(iii) Police vehicles , Fire - fighting vehicles , Ambulances , Funeral vans , Posts and Telegraph Department vehicles , and Central and State Government Vehicles , on duty.
The rates of fee, the categories of vehicles exempted from payment of fee , the name , address and telephone number of the authority to whom complaints , if any, should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that it is easy for drivers to read the display boards and they shall be legibly written or printed in English , Hindi and regional language of the area in which the stretch is situated .
No fee shall be levied and collected from a mechanical vehicle , which is not covered by the said Schedule.
