का. आ. 129( अ ).-जबकि भारत सरकार के रसायन और उर्वरक मंत्रालय के संकल्प सं. 33/7/97-पी आई-1 तारीख 29 अगस्त, 1997 द्वारा राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण की स्थापना, अन्य बातों के साथ प्रपुज औषधियों तथा विनिर्मितियों का मूल्य निर्धारित करने और उनमें यदि कोई परिवर्तन है तो उन्हें अधि सूचित करने , अनियंत्रित औषधों और विनिर्मितियों के मूल्यों को मॉनिटर करने और औषध ( मूल्य नियंत्रण ) आदेश के प्रावधानों का कार्यान्वयन करने के लिए , की गई थी ।
4. तदुपरान्त राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी किए गए आदेश सं. का. आ. 637( अ) तारीख 4 सितम्बर , 1997 के साथ पठित औषध (कीमत नियंत्रण ) आदेश , 1995 के पैरा 10 और 11 के उप-पैरा ( ख ) के अधीन प्रत्यायोजित शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , नीचे दिए गए ब्यौरों के अनुसार मैसर्स केमवेल प्राइवेट लिमिटेड द्वारा उत्त्पादित एवं मैसर्स नोवार्टिस इंडिया लिमिटेड द्वारा बाजार में उतारे गये निम्नलिखित विनिर्मितियों के पैकों में से प्रत्येक के उत्त्पाद शुल्क और स्थानीय शुल्क , यदि कोई हो , को सम्मिलित कर अधिकतम खुदरा मूल्य अधिसूचित करती है, जैसा कि निम्न विवरण में दिया गया है:-

3. जबकि राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण नियमित रूप से ओ आर जी- आई एम एस में उपलब्ध मूल्य पर आँकड़ों के आधार पर अनियंत्रित ( गैर- अनुसूचित ) विनिर्मितियों के मूल्यों का अनुश्रवण करता है और जिसमें कि ओ आर जी आई एम एस से प्राप्त आँकड़ों से देखा गया है कि मैसर्स केमवेल प्राइवेट लिमिटेड द्वारा उत्पादित एवं मैसर्स नोवार्टिस इंडिया लिमिटेड द्वारा बाजार में उतारे गये वोवरन एम्यूलजॅल 30 ग्राम की ट्यूब के विनिर्मिति पैक के मूल्य में मई 2006 से मई 2007 की अवधि के दौरान 10 % से अधिक की वृद्धि हुई । सम्बन्धित कम्पनी को इसके सम्बन्ध में ऐसी मूल्य- वृद्धि के लिए कारण प्रस्तुत करने के निर्देश दिए गए थे । कम्पनी से प्राप्त उत्तर की परीक्षा की गई और पाया गया कि सम्बन्धित वर्ष के दौरान उक्त कथित विनिर्मिति पैक के लिए 10 % से ज्यादा की मूल्य- वृद्धि

5. उक्त उल्लिखित विनिर्मिति पैक के लिए निर्धारित अधिकतम खुदरा मूल्य, मैसर्स केमवेल प्राइवेट लिमिटेड द्वारा उत्पादित एवं मैसर्स नोवार्टिस इंडिया लिमिटेड द्वारा डीपीसीओ , 1995 के पैरा 15 के प्रावधानों के अनुसार प्रपत्र V में मूल्य सूची जारी करते हुए इस आदेश की प्राप्ति के 15 दिनों के अन्दर लागू करना होगा ।
manufactured by M/s . Kemwell Pvt. Ltd. and marketed by M/s.Novartis India Ltd. increased by more than 10% during the period from May, 2006 to May, 2007. The concerned company was therefore directed to furnish the reasons for such price increase in pursuance thereof. The reply from the company was examined and it was observed that the price increase by more than 10% during the relevant year , for the above said formulation pack, was unjustified and against public interest in as much as it puts an unreasonable burden on the consumers without sufficient justification .
6. एक या दोनों कम्पनियों का उक्त अनुबद्ध समय के भीतर उपर्युक्त अनुसार निर्धारित अधिकतम खुदरा मूल्य को लागू करने में असफल रहना आवश्यक वस्तुएँ अधिनियम , 1955 के साथ पठित डीपीसीओ, 1995 के प्रावधानों के अधीन किसी और अन्य सभी उपयुक्त कार्यवाहियों के साथ डीपीसीओ , 1995 के पैरा 13 के अधीन अधिप्रभारित राशि की वसूली के लिए कार्यवाही को आकर्षित करेगा ।
7. उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।.
4. Now, therefore , in exercise of the powers delegated under sub -para (b ) of Para 10 and 11 of the Drugs (PricesControl ) Order, 1995 vide No. S.O. 637 (E) dated 4th September 1997 issued by the Government of India in theMinistry of Chemicals and Fertilizers , and thereafter, the National Pharmaceutical Pricing Authority being satisfied that it is necessary in the public interest so to do, hereby notifies the maximum retail price including excise duty and local taxes , of the following formulation pack manufacturedby M/ s . Kemwell Pvt . Ltd. and marketed by M/s. Novartis India Ltd. as per the details herein under : ---
8. उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी संयुक्त एवं पृथक रूप से इस आदेश एवं इसमें उक्त उल्लिखित शर्तों के अनुपालन के लिए उत्तरदायी होगी ।

S. O. 129(E) . Whereas the National Pharmaceutical Pricing Authority was established vide the Resolution of theGovernment of India in the Ministry of Chemicals and Fertilizers No. 33/ 7/97- PI - I dated 29th August , 1997 inter alia, to fix prices and notify the changes therein, if any, of bulk drug and formulations , monitor the prices of decontrolled drugs and formulations and oversee the implementation of the provisions of the Drugs (Price Control) Order.
5. The maximum Retail Price fixed for the above mentioned formulation pack shall be implementedby M/s . Kemwell Pvt . Ltd. and marketed by M/s . Novartis India Ltd. within 15 days from receipt of this order by issuing a price list in Form V in accordance with the provisions of paragraph 15 of DPCO, 1995.
2.Whereas, the Ministry of Chemicals and Fertilizers vide No. S.O.637 (E) dated 4th September, 1997 in pursuance ofparagraph 26 of the Drugs (Price Control ) Order, 1995 (DPCO, 1995) and thereafter delegated the powers in respect ofspecified paragraphs of the DPCO , 1995 to be exercised by the National Pharmaceutical Pricing Authority on behalf ofthe Central Government .
6. Failure of the above said company to implement the Maximum Retail Price fixed , as above , within the stipulated aforesaid time shall attract action under Paragraph 13 of DPCO, 1995 for recovery of overcharged amount along with any and all other appropriate action , under the provisions of DPCO , 1995 read with the Essential Commodities Act, 1955 .
3. Whereas , the National Pharmaceutical Pricing Authority monitors the prices of decontrolled (non- scheduled) formulations on the basis of data on price available in ORG - IMS on regular basis and wherein, from the data obtained from ORG - IMS it was observed that price of Voveran Emulgel 30gm tube formulation pack
7. The manufacturer/ marketing company for the above said formulation shall be required to take the requisite prior approval from the competent Authority for any change in the Composition of the above said formulation withwritten prior intimation to the National Pharmaceutical Pricing Authority.

3. जबकि राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण नियमित रूप से ओ आर जी- आई एम एस में उपलब्ध मूल्य पर आँकड़ो के आधार पर अनियंत्रित ( गैर- अनुसूचित ) विनिर्मितियों के मूल्यों का अनुश्रवण करता है और जिसमें कि ओ आर जी आई एम एस से प्राप्त आँकड़ों से देखा गया है कि मैसर्स जैन फार्मा ( प्रा. ) लिमिटेड द्वारा उत्पादित एवं मैसर्स बरजन हेल्थकेयर ( मैसर्स एल्केम का एक प्रभाग ) द्वारा बाजार में उतारे गये ओन्डम 2 मिलि वायल के विनिर्मिति पैक के मूल्य में जून 2006 से जून 2007 की अवधि के दौरान 10% से अधिक की वृद्धि हुई । सम्बन्धित कम्पनी को इसके सम्बन्ध में ऐसी मूल्य - वृद्धि के लिए कारण प्रस्तुत करने के निर्देश दिए गए थे । कम्पनी से प्राप्त उत्तर की परीक्षा की गई और पाया गया कि सम्बन्धित वर्ष के दौरान उक्त कथित विनिर्मिति पैक के लिए 10 % से ज्यादा की मूल्य- वृद्धि अनुचित और लोकहित के विरुद्ध थी क्योंकि यह उपभोक्ताओं पर बिना पर्याप्त औचित्य के अतर्कसंगत भार डालती है ।

5. The Maximum Retail Price fixed for the above mentioned formulation pack shall be implemented by M/s . Zen Pharma (P) Ltd. and marketed by M/s. Bergen Healthcare (a division of M/ s . Alkem) within 15 days from receipt of this order by issuing a price list in form V in accordance with the provisions of paragraph 15 of DPCO , 1995.
