का.आ. 162(अ) . केन्द्रीय सरकार पर्यावरण ( संरक्षण ) अधिनियम, 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार की अधिसूचना संख्यांक का.आ. 1533 ( अ ) तारीख 14 सितम्बर , 2006 के अनुसरण में राज्य स्तरीय पर्यावरण प्रभाव निर्धारण प्राधिकरण ( एस ई आई ए ए) , छत्तीसगढ़ ( जिसे इसमें इसके पश्चात् प्राधिकरण , छत्तीसगढ़ कहा गया है) का गठन करती है जिसमें छत्तीसगढ़ राज्य सरकार द्वारा नाम निर्देशित तीन सदस्य अर्थात् अध्यक्ष , सदस्य और सदस्य सचिव समाविष्ट होंगे , जो निम्नलिखित हैं :-

2. अध्यक्ष और सदस्यों की पदावधि इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीन वर्ष होगी ।
3. प्राधिकरण , छत्तीसगढ़ ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रक्रियाओं का अनुसरण करेगा जो अधिसूचना संख्याक का.आ. 1533 ( अ ) , तारीख 14 सितम्बर , 2006 में दी गई है ।

4. प्राधिकरण , छत्तीसगढ़ इस आदेश में छत्तीसगढ़ सरकार के लिए गठित राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति ( एस ई एसी ) की सिफारिशों के आधार पर अपने निर्णय देगी ।
5. छत्तीसगढ़ राज्य सरकार अभिकरण को प्राधिकरण के सचिवालय के रूप में कार्य करने के लिए अधिसूचित करेगी और यह सभी वित्तीय और संभारिक सहायता , जिसके अंतर्गत आवास सुविधा , परिवहन , और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवाएगी । प्राधिकरण के अध्यक्ष और सदस्य को बैठक फीस, यात्रा भत्ता/महंगाई भत्ता छत्तीसगढ़ सरकार द्वारा नियमानुसार संदत्त होगा ।
6. उक्त प्राधिकरण की सहायता के लिए केन्द्रीय सरकार छत्तीसगढ़ राज्य सरकार से परामर्श करके राज्य स्तरीय विशेषज्ञ मूल्यांकन समिति, छत्तीसगढ़ का गठन करती है ( जिसे इसमें इसके पश्चात् एस ई ए सी कहा गया है ) जिसमें निम्नलिखित सदस्य समाविष्ट होंगे :-- 1. डॉ. हरेन्द्र कुमार,

7. अध्यक्ष और सदस्यों की पदावधि, इन अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से तीन वर्ष होगी और एस ई ए सी , छत्तीसगढ़ का प्रत्येक तीन वर्ष के पश्चात् पुनर्गठन किया जाएगा ।

8. एस ई ए सी , छत्तीसगढ़ ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रक्रियाओं का अनुसरण करेगी जो अधिसूचना संख्यांक का.आ. 1533 (अ ) तारीख 14 सितम्बर , 2006 में दी हैं ।
9. एस ई ए सी , छत्तीसगढ़ सामूहिक दायित्व के सिद्धांत पर काम करेगी । अध्यक्ष , प्रत्येक मामले में एकमत होने का प्रयास करेगा और यदि एकमत नहीं हो सकता तो बहुमत का विचार अभिभावी होगा ।
10 छत्तीसगढ़ राज्य सरकार , अभिकरण को एस ई ए सी, छत्तीसगढ़ के सचिवालय के रूप में कार्य करने के लिए अधिसूचित करेगा और यह सभी वित्तीय और संभारिक सहायता जिसके अंतर्गत स्थान सुविधा, परिवहन भी है और उसके सभी कानूनी कृत्यों की बाबत ऐसी अन्य सुविधाएं उपलब्ध करवायेगी । एस ई ए सी के अध्यक्ष और सदस्यों को बैठक फीस , यात्रा भत्ता/महंगाई भत्ता छत्तसीगढ़ सरकार द्वारा राज्य के नियमों के अनुसार संदत्त किया जाएगा ।

NOTIFICATION
New Delhi, the 29th January, 2008
S.O. 162 (E) . In exercise of the powers conferred by sub- section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the Government of India notification number S.O. 1533 (E) dated the 14th September, 2006, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority (SEIAA) , Chhattisgarh (hereinafter referred to as the Authority , Chhattisgarh) comprising of three members namely, Chairman, Member and Member Secretary nominated by the State Government of Chhattisgarh as under:

2. The Chairman and Members shall have the term of three years from the date of publication of this notification inthe Official Gazette .
3. The Authority , Chhattisgarh shall exercise such powers and follow such procedures as enunterated in the notification number S.O. 1533 (E) dated the 14th September,2006.
4. TheAuthority, Chhattisgarh shall base its decision on the recommendations of the State Level Expert Appraisal Committee (SEAC) constituted for the State of Chhattisgarh in this order .
5. The State Government of Chhattisgarh shall notify the agency to act as secretariat for the Authority and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect ofall its statutory functions. Sitting Fee , Travelling Allowance/Dearness Allowance to the Chairman and Member of the Authority shall be paid by the State Government of Chhattisgarh as per State rules .
6. To assist the said Authority , the Central Government, in consultation with the State Government of Chhattisgarh, hereby constitutes the State Level Expert Appraisal Committee, Chhattisgarh (hereinafter referred to as SEAC) , which shall comprise the following Members:

7. The Chairman and Members shall have the term of three years from the date of publication of this notification inthe Official Gazette and SEAC, Chhattisgarh shall be reconstituted after every three years .
8. The SEAC, Chhattisgarh shall exercise such powers and follow such procedures as enumerated in the notification number S.O. 1533(E) dated the 14th September, 2006.
9. The SEAC, Chhattisgarh shall function on the principle of collective responsibility . The Chairperson shall endeavour to reach a consensus in each case , and if consensus cannot be reached, the view of the majority shall prevail .
10. The State Government of Chhattisgarh shall notify the agency to act as secretariat for the SEAC, Chhattisgarh and shall provide all financial and logistic support including accommodation , transportation and such other facilities in respect to all its statutory functions . Sitting Fee, Travelling Allowance/Dearness Allowance , to the Chairman and Members ofthe SEAC shall be paid by the State Government of Chhattisgarh as per State rules .
