बीमा विनियामक और विकास प्राधिकरण ( बीमाकर्ताओं की ग्रामीण तथा सामाजिक क्षेत्र बाध्यताएं ) (चतुर्थ संशोधन ) विनियम , 2008
फा. सं. बी.वि.वि.प्रा. विनियम/2/43 /2008.-प्राधिकरण , बीमा अधिनियम , 1938 ( 1938 का 4 ) की धारा 32 सी की धारा 32बी के साथ पठन करते हुए और इसके द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बीमा सलाहकार समिति के परामर्श से निम्नलिखित विनियम बनाता है जो बीमा विनियामक विकास प्राधिकरण (बीमाकर्ताओं की ग्रामीण तथा सामाजिक क्षेत्र बाध्यताएं ) विनियमन , 2002 जिसकी अधिसूचना भारत के राजपत्र , फा. सं. बी.वि.वि.प्रा. / 10/ 2002 दिनांक 17 अक्तूबर , 2002 को जारी हुई तथा भारत के राजपत्र फा. सं. बी. वि.वि.प्रा. /4/2005/37 दिनांक 30 जुलाई, 2004 को भारत के राजपत्र फा. सं. बी.वि.वि.प्रा . विनियम/ 3 / 2004 तथा जनवरी 3 , 2008 भारत के राजपत्र फा. सं. बी.वि.वि.प्रा./4/2005/37 को संशोधन जारी हुआ, अर्थात्: -
1. इन विनियमों का संक्षिप्त नाम तथा प्रारम्भ.-( 1 ) इन विनियमों को बीमा विनियामक विकास प्राधिकरण ( बीमाकर्ताओं की ग्रामीण तथा सामाजिक क्षेत्र बाध्यताएं) ( चतुर्थ संशोधन ) विनियम , 2008 के नाम से पुकारा जायेगा ।
(2 ) ये प्रकाशन की दिनांक से प्रवृत्त होंगे ।
(3 ) बीमा विनियामक विकास प्राधिकरण ( बीमाकर्ताओं की ग्रामीण तथा सामाजिक क्षेत्र बाध्यताएं ) विनियमन, 2002 में,

विनियमन 3 का तीसरा प्रावधान मिटाया जाता हैं तथा उसे अधोलिखित से परिवर्तित किया जाता है :
' जबकि प्रस्तावित है कि एक बीमा कंपनी अपना प्रचालन वित्तीय वर्ष के दूसरे भाग में प्रारम्भ करती है तथा संबंधित वित्तीय वर्ष में 31 मार्च तक छः माह से कम प्रचालन करती है, ( i ) इस अवधि के लिए कोई ग्रामीण तथा सामाजिक क्षेत्र बाध्यताएं लागू नहीं होंगी तथा ( ii ) वार्षिक बाध्यताएं जिन्हें विनियमों में बताया गया है अगले वित्तीय वर्ष से लागू होंगी जिसे प्रचालन का पहला वर्ष अनुपालन के लिए माना जायेगा । ऐसी अवस्था में जब बीमा कंपनी वित्तीय वर्ष के प्रथम भाग में प्रचालन प्रारम्भ करती है तब प्रथम वर्ष की लागू बाध्यता इन विनियमों में बतायी गई बाध्यता का 50 प्रतिशत होगी । '

InsuranceRegulatory and Development Authority (Obligations of Insurers to Rural or Social Sectors) (Fourth Amendment) Regulations , 2008
F. No. IRDA/Reg . /2 /43/2008.- In exercise of the powers conferred by Section 32C read with Section 32B of the Insurance Act, 1938 (4 of 1938 ) , the Authority, in consultation with the Insurance Advisory Committee , hereby makes the following Regulations to further amend

the Insurance Regulatory and Development Authority (Obligations of Insurers to Rural or Social Sectors ) Regulations , 2002 , notified on October 17, 2002 in the Gazette of India F. No. IRDA/Reg ./ 10/2002 , amended on July 30, 2004 in the Gazette of India F. No. IRDA/Reg ./3 / 2004; December 26, 2005 in the Gazette ofIndia F. No. IRDA/ Reg./4/2005/37; and January 3 , 2008 in the Gazette of India F. No. IRDA/Reg ./1 /42/2008 , namely : -
1. Short title and commencement. ( 1 ) These regulations may be called the Insurance Regulatory and Development Authority (Obligations of Insurers to Rural or Social Sectors ) ( Fourth Amendment) Regulations , 2008 .
(2) They shall come into force on the date oftheir publication in the Official Gazette .
(3) In the Insurance Regulatory and Development Authority (Obligations of Insurers to Rural or Social Sectors) Regulations , 2002,

The first proviso to Regulation 3 shall be deleted and replaced to read as under :
'Provided that in cases where an insurance company commences operations in the second half of the fi nancial year and is in operations for less than six months as at 31st March of the relevant financial year, (i) no rural or social sector obligations shall be applicable for the said period, and ( ii ) the annual obligations as indicated in the Regulations shall be reckoned from the next financial year which shall be considered as the first year of operations for the purpose ofcompliance . In cases where an insurance company commences operations in the first half of the financial year, the applicable obligations for the first year shall be 50 per cent of the obligations as specified in these Regulations . '
