आ.अ. ३ ( अ ). यतः, उत्तराखण्ड राज्य से लोक सभा में उस राज्य के 2 - गढ़वाल लोक सभा निर्वाचन क्षेत्र से निर्वाचित , मेजर जनरल ( से.नि. ) भुवन चन्द्र खण्डूड़ी ( ए.वी.एस.एम ) का स्थान उनके त्याग पत्र देने के परिणामस्वरूप तारीख 13 सितम्बर , 2007 को रिक्त हो गया है; और
2. यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप- निर्वाचन कराया जाना है;
3. अतः , अब , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 149 की उप - धारा ( 1 ) , तथा धाराओं 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा-
(अ ) उत्तराखण्ड राज्य में उक्त 2 - गढ़वाल लोक सभा निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 29 फवरी , 2008 ( शुक्रवार ) से पूर्व तथा उक्त अधिनियम के और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित करें;
(आ) उक्त निर्वाचन के सम्बंध में-
: 6 फरवरी , 2008 ( बुधवार ) ;
(क) नामनिर्देशन करने की अन्तिम तारीख
: 7 फरवरी , 2008 ( बृहस्पतिवार ) ;
(ख) नामनिर्देशनों की संवीक्षा की तारीख
: 9 फरवरी , 2008 ( शनिवार );
( ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
: 24 फरवरी , 2008′ ( रविवार ) ; और (घ) वह तारीख, जिसको यदि आवश्यक हुआ तो , मतदान होगा
: 29फरवरी , 2008 ( शुक्रवार ) (ङ) वह तारीख , जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा
नियत करता है; और
( इ ) 8.00 बजे पूर्वाहन से 5.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो , निर्वाचन के लिए उपरोक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

NOTIFICATION
New Delhi , the 30th January, 2008
O.N. 3 (E) . Whereas , the seat of Maj . Gen. ( Retd. ) Bhuwan Chandra Khanduri , (A.V.S.M. ) , in the House of the People , elected from 2 -Garhwal Parliamentary Constituency in the State of Uttarakhand has become vacant on 13th September, 2007 by the reason of his resignation ; and
2. Whereas , a bye- election is to be held for the purpose of filling the vacancy so caused ;
3. Now, therefore , in pursuance of sub - section ( 1 ) of Section 149 , and Sections 30 and 56 of the Representation ofthe People Act, 1951 (43 of 1951 ) , the Election Commission of India hereby :---
(A) calls upon the said 2 - Garhwal Parliamentary Constituency in the State of Uttarakhand to elect, before the 29th February, 2008 (Friday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the House of the People;
(B) appoints , with respect to the said election : ---
(a) the 6th February , 2008 ( Wednesday) , as the last date for making nominations;
(b) the 7th February, 2008 (Thursday) , as the date for the scrutiny of nominations;
(c) the 9th February , 2008 ( Saturday) , as the last date for the withdrawal of candidatures ;
(d) the 24th February , 2008 (Sunday ) , as the date on which a poll shall , if necessary, be taken;
(e) the 29th February , 2008 (Friday) , as the date before which the election shall be completed; and (C) fixes the hours from 8.00 A.M. to 5.00 P.M. as the hours during which the poll shall , ifnecessary , be taken on the date specified above , for the election .
