सा.का.नि. 64( अ ) संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयेग करते हुए , राष्ट्रपति केन्द्रीय सचिवालय सेवा नियमावली , 1962 में आगे और संशोधन करने हेतु एतद्वारा निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का नाम केन्द्रीय सचिवालय सेवा ( संशोधन ) नियमावली, 2008 है।
(2 ) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय सचिवालय सेवा नियमावली , 1962 में, नियम 12 में, उप- नियम ( 2 ) के लिए निम्नलिखित उप- नियम प्रतिस्थापित किए
जाएंगे , अर्थात्:-
" ग्रेड- I रिक्तियां अनुभाग अधिकारी ग्रेड के उन नियमित अधिकारियों की पदोन्नति द्वारा भरी जाएंगी जिन्होंने उस ग्रेड में आठ वर्ष की संस्वीकृत सेवा से कम सेवा न की हो तथा उस सेवा के ग्रेड-1 में उप - नियम ( 3 ) के अन्तर्गत तैयार की गई , चयन सूची में शामिल किए गए हों । "

NOTIFICATION
New Delhi , the 1st February, 2008
G.S.R. 64(E ) . In exercise of the powers conferred by the proviso to article 309 ofthe Constitution , the President hereby makes the following rules further to amend the Central Secretariat Service Rules, 1962, namely :-
1. (1 ) These rules may be called the Central Secretariat Service (Amendment) Rules , 2008.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Secretariat Service Rules , 1962, in rule 12, for sub -rule (2) , the following sub - rule shall be substituted, namely :-
"Vacancies in Grade I shall be filled by promotion of regular officers of the Section Officers ' Grade who have rendered not less than eight years ' approved service in that Grade and are included in the Select List for Grade I of the service , prepared under sub - rule (3 ) . "

सा.का.नि. 65 ( अ ).- केन्द्रीय सचिवालय सेवा नियमावली , 1962 के नियम 12 के उप - नियम (3 ) तथा नियम 23 के अनुसरण में , कार्मिक और प्रशिक्षण विभाग , कार्मिक , लोक शिकायत तथा पेंशन मंत्रालय , केन्द्रीय सचिवालय सेवा ( ग्रेड- I और चयन ग्रेड में पदोन्नति ) नियमवाली, 1964 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन विनियमों का नाम केन्द्रीय सचिवालय सेवा ( ग्रेड-1 और चयन ग्रेड में पदोन्नति ) ( संशोधन ) विनियमावली , 2008 है ।
(2 ) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. केन्द्रीय सचिवालय सेवा ( ग्रेड- I तथा चयन ग्रेड में पदोन्नति ) विनियमावली , 1964 के विनियम 5 में .
(क) उप - विनियम ( 1 ) और ( 2 ) के लिए निम्नलिखित उप - विनियम प्रतिस्थापित किए जाएंगे , अर्थात्:-
" ( 1 ) ग्रेड-1 हेतु एक नई चयन सूची प्रत्येक वर्ष में कम से कम एक बार तैयार की जाएगी यदि वर्ष की पहली जुलाई को उस ग्रेड की चयन सूची में पहले ही शामिल किए गए अधिकारियों की संख्या विनियम 3 के उप - विनियम ( 1 ) के अंतर्गत नियत पद संख्या से कम है । चयन सूची तैयार करने के उद्देश्य हेतु कार्मिक, लोक शिकायत तथ पेंशन मंत्रालय का कार्मिक और प्रशिक्षण विभाग संवर्ग प्राधिकारियों, अपने निजी संवर्ग एककों में शामिल अनुभाग अधि कारियों के ग्रेड के पात्र अधिकारियों के नाम संवर्ग प्राधिकारियों से प्राप्त करेंगे । "
( 2 ) ऐसे सभी अधिकारियों के नाम कार्मिक, लोक शिकायत तथा पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा उनकी वरिष्ठता के अनुसार व्यवस्थित किए जाएंगे। अनुभाग अधिकारियों की वरिष्ठता निम्नलिखित तरीके से व्यवस्थित की जाएगी ।
( i ) निर्धारित तिथि के पहले अनुभाग अधिकारियों के ग्रेड में नियुक्त तथा नियमावली की चौथी अनुसूची के पैराग्राफ -1 के अंतर्गत प्रारंभिक गठन करते समय अनुभाग अधिकारियों की चयन सूची में शामिल किए गए अधिकारियों के नाम उस तिथि से पहले निर्धारित उनकी वरिष्ठता के क्रम में व्यवस्थित किए जाएंगे । सूची में परिवर्धन इस ग्रेड की चयन सूची के माध्यम से निर्धारित तिथि के बाद अनुभाग अधिकारियों के ग्रेड में नियुक्त अधिकारियों, पहले वाली चयन सूची जो बाद वाली चयन सूची के आधार पर नियुक्त अधिकारियों , से ऊपर रखी जा रही है, के आधार पर नियुक्त अधिकारियों को मिलाकर किया जाएगा।
टिप्पणी : इस उप - खण्ड के प्रयोजन के लिए, सचिवालय सूची का अभिप्राय विनियमावली की चौथी अनुसूची के पैराग्राफ 2 में दिए गए सिद्धांतों का अनुसरण करते हुए प्रत्येक चयन सूची में किए गए संवर्ग - वार परिवर्धन का समेकित रूपांतरण होगा।
( ii ) उप - खण्ड ( 1 ) के अंतर्गत तैयार की गई अनुभाग अधिकारियों की सूची में, संयुक्त प्रतियोगी परीक्षा के आधार पर सीधी भर्ती के रूप में नियुक्त अनुभाग अधिकारियों , संयुक्त प्रतियोगी परीक्षाओं में मेरिट के क्रम में व्यवस्थित, बाद में हुई संयुक्त प्रतियोगी परीक्षा के परिणामों के आधार पर नियुक्त व्यक्तियों से ऊपर रखी जा रही किसी पहले की संयुक्त प्रतियोगी परीक्षा के परिणाम के आधार पर नियुक्त अधिकारियों के नाम सीधे भर्ती होने वालों के लिए आरक्षित रिक्तियों के कोटे के अनुसार उनकी भर्ती के समय अन्तरवेषित किए जाएंगे।

NOTIFICATION

G.S.R. 65 (E). In pursuance of sub - rule (3 ) ofrule 12 and rule 23 of the Central Secretariat Service Rules, 1962, the Department of Personnel and Training, Ministry of Personnel , Public Grievances and Pensions hereby makes the following regulations to amend the Central Secretariat Service (Promotion to Grade I and Selection Grade ) Regulations , 1964, namely:--
1. ( 1 ) These regulations may be called the Central Secretariat Service (Promotion to Grade I and Selection Grade ) ( Amendment) Regulations , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2.Inthe Central Secretariat Service (Promotion to Grade I and Selection Grade ) Regulations , 1964 , in regulation 5- (a) for sub - regulations ( 1 ) and (2 ), the following sub- regulation shall be substituted, namely :---
" (1 ) A fresh Select List for Grade I shall be prepared at least once every year if on the 1st July of the year the number of officers already included in the Select List for that Grade is below the strength fixed under sub- regulation ( 1 ) of regulation 3. For the purpose of preparing the Select List , the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions shall obtain from the cadre authori- ties the names of all eligible officers of the Section Officers ' Grade included in their respective cadres units .
(2) The names of all such officers shall be arranged in accordance with their seniority by the Department of Personnel and Training in the Ministry of Personnel , Public Grievances and Pensions . The seniority of the Section Officers shall be arranged in the following manner :-
(1) the names of officers appointed to the Section Officers Grade before the appointed day and included in the Select List of Section Officers at the initial constitution under paragraph 1 of the Fourth Schedule to the rules shall be arranged in the order of their seniority as determined before that day. Addition to this lists shall be made by including officers appointed to the Section Officers Grade after the appointed day through the Select List for the Grade , officers appointed on the basis on an earlier Select List being placed above those appointed on the basis of later Select list . The order of names shall be in the same order as in all the Secretariat Select Lists issued by the Department of Personnel and Training.
Note: For the purpose of this sub - clause , the Secretariat List shall mean the consolidated version of the cadre-wise addition made to each Select List following the same principles as laid down in para- graph 2 of the Fourth Schedule to the rules .
(ii) In the list of Section Officers prepared under sub - clause (i ) , the names of those appointed to the Section Officers Grade as Direct Recruits on the basis ofthe Combined Competitive Examination , arranged in the order of merit in the Combined Competitive Examinations , persons appointed on the results of an earlier examination being placed above those appointed on the results of a later examination , shall be interpolated according to the quota of vacancies reserved for direct recruit- ment at the time of their recruitment . "
